Sims Metal Management

To whom it may concern, I am filing this complaint on behalf of my wife,[redacted], I am her husband. September 11th, 2015 my wife took aluminum cans to SIMS Metal Management to turn in for cash. It was upon checkout; SIMS gave her $9.00 of the $9.36 owed to her. There excuse is they "round" off to the payee. There was no mention of credit for later. This is theft, embezzling, cheating patrons. The .36 cents is not monumental for 1 person, however, on a daily occurrence, per month, over a year, this adds up to a large amount of theft. /////Desired SettlementThis needs to be addressed. I am an out of town contractor and dealt with a buyer named [redacted] who provided quotations to purchase scrap metal. When I received the final settlement in the mail, Sims paid roughly 2/3 of the price they quoted. I have since given them an opportunity to right the wrong and they have done nothing. On February 9th I was quoted $.70 per ton for scrap metal, Sims actually paid $.50 per ton. After discussing the material with Mr. [redacted], I had no reason to disagree with him based on the description Mr. [redacted] provided.I quoted him $70 per ton for Unprepared and $50 per ton for torch during the initial phone conversation. There was nothing out of the ordinary about the discussion other that his need to have immediate service.Due to Mr. [redacted]'s request for immediate service, the trucks and containers were scheduled for dispatch the next day per his request.Mr. [redacted] did submit the paperwork in a timely manner I recall and SIMS staff processed immediately so things went smooth on our administrative side.The explanation is simple and SIMS does have photographic evidence to support our argument.Tkt [redacted]Graded as torch, paid as torch1.5 hrs in freight.21,000 lb's Ticket: [redacted]Graded as torch, paid as torch.19,440 lb1.25 hrs frieght In conclusion, SIMS provided excellent, last minute service. We paid what was discussed. The argument Mr. [redacted] is making is that the material is not torch, but is Unprepared. This has proven to not be the case which is firmly established by the accompanied photos.The sad part about this transaction is that Mr. [redacted] stated that " He wasn't worried about the price, he just needed service"SIMS provided excellent service and a fair price based on the material and market conditions at the time.Please contact me with any questions. At no time during the two weeks leading up to the equipment being removed did [redacted] indicate that he was changing the price. Additionally, the equipment was brought in on two separate trucks on different days and [redacted] did not indicate any change in price after the first load was delivered.I did not learn that they were going to underpay until two weeks after the equipment was delivered to them when I received the payment in the mail.[redacted] took advantage of my company because we were not local and did not get his quotation in writing and clearly reneged on our verbal agreement. He must know that this is not enough money to file a suit.My company has been doing this type of work for 10 years and have dealt with scrap yard all over the country and this is the first time one of the scrap yards have reneged on their verbal quotation.We believe SIMS owes us $380. [redacted] never mentioned a difference in price between unprepared and touch. [redacted] committed to look at the equipment before I arrived in Reno, NV.Now SIMS is claiming they have the right to change price without notice. If they planned to change the price, I should have be called before the material was processed and certainly before the second truck load was delivered.Consumers in the Reno area should be made aware of SIMS Metal's business practice.Final Business Response Sims is not responsible for you miss representing your material. As you say you have been in the industry for ten years. [redacted] assumed you know the deference between unprepared and torch cut, so he took you at your word. Scrap metal is a commodity and prices are subject to change without notice. Sims has always reserved that right.
