My complaint is in regards to deep scratches to the rear bumper of my vehicle which was not there beforeI contested the deep scratches on the rear bumper at the time I picked up my vehicle and was told by an employee that because it shows pictures were taken they will be able to support their claim that the deep scratches to the rear bumper was their prior and they will send me copies of the pictures hrs later I called for a status and was told blatantly that the pictures were deleted and that they will not be paying for any damage incurred
I will like for the company at hand to pay for the necessary repairs made to my vehicle's rear bumper or supply picture evidence that they stated they have in the document

I have reviewed the "offer" made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.First of all, there is no "offer," instead there is a weak explanation for stealing my car. There are NO SIGNS in the large, open area of the lot where most cars are apt to park. The one sign that's in the lot is in a far corner, and seems to only refer to the one, or few cars parked right underneath it: far from the other, wide open area of the lot. There are also NO SIGNS on the 3 entry points to the lot.And I'll point out again that the pastor of the Church we were attending FOR A MEMORIAL SERVICE FOR MY BROTHER stated that this "happens all the time with this company." And Simms a) refuses to put up more, bigger, and clearer signage, or b) refuses to let the church put up warning signs of their own.In the state of VA this is what's regarded as an Illegal Tow. It's predatory, and awful.Business owner needs to refund  the tow charge, as well as reimburse the taxi fare. ASAP. He also needs to improve the signage at the lot, and send images to me and the Revdex.com proving he has done it.

Revdex.com spoke to a representative from the company who stated that their contract with this apartment complex is for 24 hour towing. She also stated that they are not required to post their hours they tow, but simply the contact and other pertinent information to contact the business. She stated they...

were within the guidelines of their contract for this apartment complex and will not be issuing a refund.

In addition to our previous email, we are attaching a copy of [redacted] Towing Invoice which shows in the "Vehicle Condition" section where the driver noted "HSC All sides front and back" which means "heavy scratches...

and chips on all sides front and back". [redacted] has a pink carbon copy of the same invoice that he was provided as a receipt, and it has the same information as our copy.

company states there are two signs, one at each entrance stating that the lot he parked in was a private lot and that the towing information was on that 36x30 sign.

Review: Illegal towing. The company states that they offer 24 hour towing, however the apartment complex they towed my car from does not state that they have a 24 hour towing contract with them. Per the rental agent towing is not suppose tp start until 11pm. They are coming out to tow cars at 10:30pm. In addition they never tow during the day.Desired Settlement: I would like this company to show consistency in their towing time frame and or policy with the apartment complex. Colorado Apartments in Richmond City. There is no signage posted that states there is 24 hour towing at this complex. We were only provided with the 11:00pm Towing policy, which is also not in writing

Review: My family had several incidents with Simms Towing and Recovery. They have harassed my son-in-law and towed my vehicle several times improperly from a local apartment complex. On a couple of instances they would also release the vehicle to my son-in-law and daughter (who are not registered owners) without my permission, which was convenient, but illegal. They would also tow my vehicle at 9:30 at night and not answer the phone until 9:00 the next morning. Their hours are listed at 24hrs. Once we contacted them at 9:00 am, we would have to wait for someone to show up to the property because they were out towing more vehicles. On one occasion I had to wait 45 min for a representative to arrive to the property to release my vehicle. The last run in I had with the company was after they towed my vehicle from the apartment complex, they released the vehicle to my son-in-law. My son-in-law parked the car at my home, instead of the apartment complex and a week later, Simms Towing and Recovery stole my car off of my property, then lied to my son-in-law and said they did not have possession of my vehicle. My son-in-law went up to their property [redacted] (the owner) continued to deny having my vehicle, threatened my son-in-law saying he was going to get his gun if he did not leave the property. My daughter had to go up to the property and they released the vehicle to her (illegally) for $250. They would only accept cash, which is another illegal aspect of this company. They have handled business very shady caused my family much strife.Desired Settlement: I believe that I should be refunded at the very least, the $250 they charged for the last time they took my vehicle off of my property. Ultimately, I feel that Simms Towing and Recovery Inc. should be shut down completely. They run a shady business that is poorly rated on Google, Yelp, etc. They should be investigated and shut down.

Review: I went with to Simms Towing & Recovery on Monday January 20th to pick up my car and that's when I noticed that my car had damaged in the back due to them towing the car. I told,[redacted], the associate present at the time and she advised they took pictures before they towed the car based on the sheet she presented me and that she will ask the night driver ([redacted]) and they will have it emailed to me and if they do see where they caused damage they will take care of it. I waited a day to receive the email but did not receive any calls or email. The following day January 22nd, I called concerning getting a copy of the images that were taken prior to my car being towed and was told by [redacted] that they were deleted from his phone already he also said he saw where [redacted] left a note for him but he had already deleted the pictures. But yet he failed to call or even email me to give me an update on the situation. He also stated that the damage was there prior and they will not be taking care of it. According to their policies stated by [redacted] on January 20th they would compare pictures, because it should have a time stamp prior to towing and if damage was done they will compensate for the damage. Unfortunately [redacted] refused to provide the necessary evidence to support his claim that the damage was there prior to towing. He also refused to allow me to speak to the owner or his manager and also stated that they will not be compensating for the damage done. I would appreciate it if you would investigate this company and their practices.Desired Settlement: I will like to be compensated for the damage done to the rear of my vehicle. According to the form I received they towed the vehicle from the rear.

Review: On Monday, October 27, 2014, at 3:25 pm, I parked my car in a parking lot behind [redacted]). It was a fairly open “urban” parking lot, behind some buildings downtown. There were no readily visible signs in the lot, except for the church sign, which was prominently featured in the middle of the parking lot. Many parked there that day, because we were all there for my brother’s memorial service, RIP. When we exited the building at 6:30 we all discovered that our cars were gone. At first we thought they were stolen, and called the police. But then someone noticed a small Simms Towing & Recovery ([redacted]) sign located in the very corner of the lot. To everyone present, the Simms sign (which was very very small) seemed to indicate that only a few spaces, right under the sign, were under it’s jurisdiction. The center-and-other-side of the lot, where everyone was parked, had no such sign. In fact, save for the church sign, there was no signage. There was also no signage on the entrances or exits of the parking lot. The research I’ve conducted after the fact indicates this is an illegal tow. In VA you are required to clearly, and obviously mark the lot. There were no signs anywhere, except the small one in the far corner, and we have the pictures to prove it. Finally someone found the sign and called Simms, and they informed us that they were closed for the day, and that we’d have to wait till morning to recover our vehicles. This was unacceptable for 2 reasons: they had towed our cars after they “were closed,” but then magically couldn’t open the impound lot to let us get our vehicles back; and several of the people involved were due to drive home that evening, after the memorial service, to return to their families. Simms was unhelpful and unsympathetic. So when the police finally arrived, we asked the officer to talk to the company. He did, and the company finally agreed to let us get our cars for $125 in cash (no credit cards accepted, which is against the law). After a lot of arranging and scheduling, we managed to make our way to the lot, where there were other people waiting to retrieve their cars. After paying the $125 cash, we were allowed to get our property back. It’s important to note that we spoke with the pastor of the church, immediately after we realized we were towed, and he said “they do it all the time, it’s a scam, and they won’t let us put up our own signs to warn people, and they (Simms) refuse to better mark the lot.” This practice is called “predatory towing,” and it’s unethical and 100% illegal.Desired Settlement: I require a full refund of $125 (vehicle retrieval charge), cab fare ($45) to get to the lot, and better/clearer signage posted in the lot in question – so more people aren’t scammed into paying Simms for an unlawful tow.

Review: Hello This is in relation to a towing company that took my car yesterday. They required payment in cash to get the car from their lot and refused to accept any credit cards. Virginia law states that a towing company should accept credit cards for payment. We had to pay $125 in cash to get the car out of the lot or they would have refused to return the car. The car was towed from a private lot where a permit is required ( the permit was in the car and visible but had fallen from the rear view mirror )Desired Settlement: I would like a refund since what this company is doing is illegal and appears to fall in line with the notion of "predatory towing."
