During my initial meeting with the ***, he asked me if it was possible to match the two new exposed aggregate driveway slabs with their two existing exposed aggregate slabsI explained to him the new pour will stand out against their existing slabs because it is new concreteI also explained to him if he applies concrete sealer on the new and old concrete the variation will not stand out as much. This instead will make the old concrete slabs vibrant again. After our meeting, I put together their estimate and emailed it to *** On the day of the job, the demolition company arrived and met with ***The owner of the company did a walk through with ***. He asked if there was anything he needed to look out for *** pointed out a sprinkler head in which the demolition company marked Shortly after the demolition begins, I get a call from *** stating the demolition company was destroying his yardI was nearby so I told *** that I would come by and discuss his concernsWhen I arrived all work had stoppedThe demolition company was clearly aggravated with the all that had transpiredIt had gotten so bad he did not want to continue workingThis was my first encounter with Debra, Joe’s wifeShe was riled up and complaining about how the demolition company damaged her grass and chipped a driveway slab that was not included in the demolition*** wanted the damaged slab replacedThe damage was a small chip that occurred when the demolition company was trying to back out of a sink holeThe sink hole was the purpose for the replacement of the driveway which had formed underneath the old driveway slabWhile attempting to back out the sink hole a piece of concrete in the bobcat bucket fell out and hit the good slab chipping itThis would not have occurred if he had exited the same way he entered, which was through the grassOnce again, the demolition company had already explained to *** the process of taking out the old concrete before they startedDo to the tire tracks forming in the yard Joe wanted to alter that process and cease going through the grass At this point, *** is looking over the grass and notices a sprinkler valve boxShe then states that they damaged the valve boxThe demolition company said that they did not know it was there and that Joe did not point it out during the initial walk throughThe only thing *** pointed out was the sprinkler headThe valve box could not be seen because it was buried under the grass*** then states that he thought a jack hammer would be used to take out the existing concreteI then proceeded to pull out the estimate which clearly stated a bobcat was to be used to refresh his memoryTearing out a driveway with a jack hammer is like a mechanic using a hand pulley instead of a mechanical lift to remove an engine By the time the demolition company finished their portion of the job they had replaced an additional driveway slab, the sprinkler valve box and two walkway slabsThe walkway slabs were at the exit point of the sink hole. While he was exiting the sink hole his bucket scrubbed the edge of the walkwayThe walkway wasn’t damaged but *** demanded that be replaced tooOnce again all this resulted from him exiting through the sink holeAll damages were paid for out of the demolition company’s pocketThe customers claim about spending money on repairs is not truthfulThe only additional money they paid out was for an additional slab in which they requested and the fill dirt for the sink holeThe demolition company removed the damaged sod (approx20- sq ft), but didn't replace the sod (approx$value)The homeowner still owed the demolition company $so *** stated that he would just call it evenThe customer’s claim about the demolition company just not coming back is not trueThe next day, my crew and I completed our portion of the job. Once we finished the job, Joe stated he loved it! He sent a text the next day stating how awesome it lookedThe following day I get a text from *** saying that the driveway looked ashyI reminded Joe again that he needed to seal the concrete*** then asked if I could pressure wash itTo appease his request I went over and pressure washed the new pour and their existing concreteAfter I was finished, *** came outside and said it looked great! I texted *** when I left to remind him once again to seal the concreteFour months go by and I get a call from *** *** *** *** daughterShe begins to tell me how bad the concrete looks so I asked her to send me a pictureIn the picture, I clearly see *** still has not sealed the concreteShe says that *** does not know what to do. I tell her that if she pays for the materials I have no problem sealing it for freeA week later, I go to their house to seal the concreteWhen I arrive *** comes out and begins to insult meI remind him that the reason the concrete looks ashy is because he did not seal it*** states that they do not want to seal it because it will stand out from the existing concreteShe then asks me if I will pressure wash and seal their remaining existing concrete and the new pourI told her that I would seal the concrete that I pouredThey rejected my offerI then stated if they did not want me to seal the concrete which I do not recommend leaving it unsealed I could put a citric acid on the new pour to remove the ash. They once again rejected that solutionTheir trial and error solution was to pressure wash the concrete with a stronger pressure washer based on what their friend told themI told them that would not solve anything, plus they jeopardize blowing the gravel outAt this point, I exhausted my attempts at compromising with themI had gone over and beyond, but they were unreasonableSinai Concrete always tries to find a median with our customersEvery attempt made with this customer was rejectedThis was the most eventful interaction in my years of customer serviceDespite the challenging environment I still tried to appease themWe did what we could doIf they just seal the concrete we would not be at this point The claims made by this customer and the actions taken are defaming under Texas legislationLibel defamation per se: damages are presumed to flow from the nature of the defamation itself and, in most situations, a plaintiff injured by a defamatory per se communication is entitled to recover general damages without specific proof of the existence of harm.
