Dear sir, in response to your email dated August 29, 2016, my suggested action for the resolution of the complaint is a 'billing adjustment' or a full refund in the amount of $999.00 plus tax, if any. Apparently, the respondent business establishment did not perform any of the suggested actions and I still consider the complaint not resolved.Thank you very much.

Hi [redacted]We received another letter dated Monday August 29th with an update.We have taken care of Mr [redacted]'s concerns in this same attached letter. His plates were picked up the same day. There was a language barrier , he misunderstood us offering to take the vehicle back and giving him a full refund.Mr [redacted] choose to keep the vehicle and is very happy with his purchased and apologized for his behavior towards our team members.We understand his frustrations but this was not our fault in anyway. Review: Salesperson sold me tires that according to him were supposed to last for 40,000 miles. I had specifically requested these because my car is rear wheel drive.Tires have worn out in less than 7000 miles.(Also at the same time took my car in for an oil change. Salesperson convinced me I had to change my tires, all the wiring and and air filters in the car. I have an S Class Mercedes that had less than 50,000 miles at the time.I did not complain at the time because I believed him. Later found out it was not essential.This is an issue now because I have to by tires again - so the entire service experience was unfair.)Desired Settlement: Replace tires that will actually last for 30000-40000.

[redacted], the Service Manager at the Siry Auto Group, offered me an acceptable resolution to solve the problem with my tires. All being well the problematic tires will be replaced this coming week. They have agreed to waive half of their cost of replacement, and to service and fit both new longer lasting tires at no charge.

[redacted] has been cordial and I would deal with him again.

Review: I did not need the GAP Insurance anymore. Called in to cancel it in September of 2012 to dealership and [redacted] GAP Insurance department. When I checked my auto account with [redacted], the change had not been made. I called [redacted] the rep. stated that it was never canceled, and to call the dealership and the Insurance department handling the GAP claim. I did that, they said they never received the claim. So I filed another claim in January 2013. Kept a paper trail. Called on the first week of March,2013, to the GAP claims department the rep. said the check was sent out in the beginning of Feb.,to the dealership. He gave me the check number and the amount. Called the dealership again, the lady said she sent it to [redacted] on March 5, 2013. Do not understand why she waited so long if they had the check since feb.. So I then called [redacted] back, the rep. said he never received the check, I called back the GAP claim department and Siry Auto group, I have been getting the run-around and no payment has been returned to me, which now this process has been going on for 7 months and the payment amount amount is less than what I should have received due to their irresponsibility. The dealership also lied and said the vehicle had never been in a accident and it has front and back repairs, I found that out when I took the vehicle in to the mechanic for maintenance. Please can someone help to get these corrupt people. Thank you, [redacted].Desired Settlement: I would like my account to be adjusted and the payment to be sent to me or applied to my account. My account should have a balance of $3100.00 or something around that range. The purchase price total was $10,000.00 my deposit I gave was $4,000.00. I made payments last year starting in October,2012 and minus the GAP insurance which was purchased at $900.00. The dealership also lied and said the vehicle had never been in a accident and it has front and back repairs.

We are replying to the

complaint submitted by Ms. [redacted]. We appreciate you giving us the

opportunity to address this matter.

We have reviewed the

statement sent to you by Ms. [redacted] and understand her

frustration. Having said that and as explained to Ms. [redacted], it is not our fault

that she took the wrong approach and cancellation process of the Gap insurance

for her vehicle. Ms. [redacted]

simply did not follow the correct steps required by the Gap insurance company

([redacted]), hence delaying the process.

As soon as we were

aware of the request by Ms. [redacted], it took a few days to help her

with processing the cancellation, which was prorated and the balance was

forwarded to her lender [redacted]. Again had Ms. [redacted] taken

the proper steps required by Gap insurance company ([redacted]), she would not

have experienced the delay with her request.

We are confident that

you recognize that we are sincere about our customer’s satisfaction and that is

why we fully participate in addressing any issues, and do our very best to

alleviate any situation calmly.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

I responded appropriately to the GAP cancellation in a timely manner, proceding with the information I was giving from the dealership insurance rep(Bruce) on 9/3/12, myself and my insurance company were on the call. It is not my duty to teach the customer representatives their job. That is why I followed up and checked, to make sure it was done correctly, when I saw that it wasn't, I contacted the GAP Cancellation rep who gave me the correct information and I sent the forms out that day FAXED to all whom it concerned 1/15/13. I contacted the Cancellation rep on 3/1/13, due to I never received a response from the dealership, if they had received the paperwork. The rep from the GAP cancellation said the check had been sent to the dealer on 2/14/13, I should have received it in the mail, and I should call the dealership. I called the dealership, 3/1/13 left a message no-one returned my call. I checked my [redacted] auto account and there wasn't any adjustments made. I then called the dealership again 3/11/13 and spoke to a rude lady who said she sent the check out on 3/8/13, no way should it have taking over a month for it to be applied to my account, which it posted on 3/29/13. There still has not been an adjustment to my account. The total price was $10,000.00 including the GAP Insurance. I put down $4,000.00, so I should not still have a balance of $6, 120.00. Which I do not know how that was possible in the begining even if there is interest!!! My contract needs to be updated immediately! I am still paying the same amount as if the GAP Insurance is still attached!!!! This company is very misleading and cricked. To steal and lie to someone who is at your mercy if very dishonest and should be shut down.
