Under warranty put in a claim 4 weeks ago items are still not fixed.
Put in a warranty request approximately 4 weeks ago for a leak in ceiling they fixed the leak but never came back to sheet rock the area and paint. Also they were supposed to be placing more grass in the back yard to fill in a hole. Warranty is almost up and just want items fix before warranty is up. Every time I call I get nothing but a run around and never receive a return call.

Desired Outcome

The water damaged area sheet rock and painted. The hole in the backyard filled in.

My husband and I have been out of town until today. I tried to go online to answer but it would not take me to the link.

Due to Covid19, we have only been processing emergency warranty claims to protect our employees and our homeowners. All homeowners were informed of this when they called in with any issues. As you can see, we did come to take care of the leak immediately. We did fix the paint, sheetrock, and the yard issues last week. All issues are resolved.

Catherine, with skylake construction, refuses to repair items in my new construction home that are within the first year warranty.
I closed on my home on Dec. 21, 2018. I was informed not to call for each needed repair, but to make a list of all items that needed repairing. After submitting my list, Catherine came by my home for an inspection & refuses to repair and/or replace the following: holes in my concrete in my garage, cracks & holes in my spare bathroom tub, my weather stripping on my front & back doors and my cracked window in my master bedroom.
I recently submitted a warranty request for the separation of the casing around the garage and the splitting post on my front porch. No one has responded to my requests.

Desired Outcome

Since I was told that everything would be repaired and/or replaced for free within the first year, I expect Skylake Construction to repair the concrete in the garage and the casing around the garage. I also expect the company to replace my cracked window, spare bathroom tub, weather stripping on both doors, and wooden post on my porch.

The homeowner took possession of the newly constructed home at the end of December 2018. As with all Sky Lake Construction homes, there is a one year builder's warranty to cover approved warranty issues. Normal wear and tear and damage that occurs from the home's occupants are not considered covered warranty items. Our warranty process allows a homeowner to submit a list of any warranty work along with any documentation for review through our warranty website: www.slcwarranty.com.

To address the specific items in the complaint, they are as follows:
Broken window: Having had possession of the home for more than 6 months, there was never any indication that we were responsible for the crack. The homeowner provided no documentation as to when or how the crack occurred. It was deemed a non-warranty issue by our warranty department since it was not present when the homeowner closed on the property.

Holes and cracks in the guest bathroom tub: This was assessed during a warranty site visit and deemed to be non-structural damage. The tub insert is made of fiberglass and can be damaged if something heavy is dropped on it. Sky Lake Construction cannot be held responsible for wear and tear and/or damage created by the owner or occupants.

Weather stripping: During the warranty site visit, the weather stripping was assessed, and the issue is occurring in the same place on each door. It was concluded that there has been repeated pressure placed on this area, such as a shoe or foot, when opening the door. It was deemed a non-warranty issue and due to occupant wear and tear.

Holes in the garage concrete: In the warranty submission list by the homeowner, this issue was cited as a singular hole in her garage wall. During the warranty site visit, it was decided that the concrete department will repair the hole in the concrete and have it filled. This was communicated to the homeowner, and the concrete warranty work will be completed by August, 31 2019.

Separation of the casing around the garage and the splitting of the post on the front porch: We have no record of these items being submitted through the warranty submission website for review. The post on the front porch was mentioned during a warranty site visit and inspected. The cracks that have occurred are due to the nature of wood and not because of defect. This also does effect the structural integrity of the post.

The homeowner submitted a list of potential warranty items in June 2019. On the list were 23 items. After review, 6 were deemed non-warranty items, of which 3 are cited in the homeowner's complaint (cracked window, door weather stripping, and hole in the guest tub). The reasons for the denial of these items was communicated to the homeowner at the time of the warranty site visit. During the site visit, the homeowner was given a list of covered and non-covered warranty items, which is also available on the warranty submission website. The items that were deemed approved warranty issues were assigned to a vendor, scheduled for repair, and completed - with the exception of the garage concrete which is scheduled for repair as stated above by August 31, 2019.

Some of the information that Skylake Construction provided in the August 14, 2019 response to my original complaint is inaccurate.
Cracked window in the master bedroom: This repair request was submitted on June 13, six (6) months after I moved into my house. I was told to provide a list of things that I found that were wrong, and not to call for each single thing I found. The list became so lengthy that I decided to wait until the summer to submit it. I am a school teacher, and it would be more convenient to have things repaired when I am at home all day. I discovered the crack approximately one week after I moved in. I have no idea when or how the crack occurred; I just know that I did not cause it, as Catherine suggested. The crack is on the outside of the window. There is nothing behind my house, and I do not use my backyard.
Holes and cracks in the guest bathroom tub: My adult daughter discovered the damage to the tub the night we moved into the house, as she was cleaning the tub. There would be no reason for us to place or drop anything heavy, or otherwise, onto the tub. The damage is not normal wear and tear created by us. Skylake workers place a lot of objects in these tubs during construction. Damage to my tub occurred either during installation or while the house was being built. Damage to the tub was listed on the builder walk-through sheet, but Catherine still refuses to replace, or repair the tub.
Weather stripping: The weather stripping coming apart from the doors is not in the same place, as Skylake's response notes. The weather stripping on the front door is coming apart in the bottom middle portion of the door. It is coming apart and hanging from the bottom left side of the back door. Weather stripping was also hanging from the side of the garage door, but Catherine fixed it during her warranty site visit. I open my doors using the door knobs; claiming that I use my foot or shoe to open a door makes no sense to me. As I told Catherine, we rarely use the front door, and use the back door twice a week to take out the garbage. The damage to the weather stripping occurred shortly after we moved in. It is not normal wear and tear, but either faulty installation, or sub-quality material.
Separation of the casing around the garage and the splitting of the post on the front porch: Skylake does have a record of these items. I tried to submit them through the warranty submission website late July, but the site was not working. I spoke to Laura, at Skylake. She told me that other people also had trouble with the site, and, to submit the request, with pictures, through the same website I used when one of the men, who was working on my air conditioner, almost fell through and created a hole in the attic. I submitted my request and pictures at warantyslc.com. Skylake's comment that I mentioned the splitting of the post on the front porch during Catherine's warranty site visit is completely untrue. I was not even aware of the condition of the post at that time, so it was neither discussed nor inspected. The post has large cracks that run from the top of the post to the bottom on parallel sides of the post. It also has large holes in it with pieces of wood sticking out, making it extremely dangerous.
There were not six (6) items on my list that Catherine deemed non-warranty items. The only items that she said were not covered under warranty are the cracked master bedroom window, the guest bathroom tub, and the weather stripping. On my list was my kitchen window that does not open, and she informed me that it was purposely designed that way.
I take pride in everything I own! After living in my home for almost a year, I have noticed many imperfections. I do not expect everything to be perfect, but I also do not expect my newly constructed house to look as if it is twenty years old.
In closing, when homeowners move into a newly constructed house, they are excited, and often do not see things that are wrong. These things are noticed only after homeowners settle into their homes and begin to use things. They expect for major things to be done correctly. They also expect the builder to have integrity, and stand behind his product and his word.
I would like to keep this case open. Jerry M has an appointment to repair the hole in the concrete tomorrow, August 29, and to review the other complaints.

The warranty issues were discussed between *** and Sky Lake Construction during a site visit. A mutual agreement was reached concerning warranty items that will either be replaced or repaired. All warranty work will be completed by September 20, 2019.
