Complaint[redacted], son of complainant, states: On March 24, Sky Peaks (SP) insisted on my mother, an 85 year old SP resident with senior issues, on extremely short notice, because of a fight she had with a couple also residing at SP. I received 5 haranguing phone calls from [redacted] ([redacted]) from corporate headquarters (even though I told her I was at work) and a threat of a lawsuit from the other couple conveyed to me by [redacted], a local manager. Apparently, my mother had a fight with the couple three months before, something SP knew of but failed to tell us about until this latest incident. We could have done more with her medicine then and avoided the second incident.I complied with SP?s request, moving her out that evening and moving the rest of her belongings on March 26. I handed over the keys to Sky Peaks on March 26. The carpet needed cleaning, but the apartment was basically ready to rent on one day?s work. My mother was paid up through March 31. Now SP is insisting she pay through April 24 and is threatening to take her to collections. SP has refused my request to document when and what it has done to rerent the apartment.By failing to tell us of the earlier incident, SP bears at least partial fault in my mother having to leave as she did. Now SP is trying to foist all blame on my mother and our family.The fact that SP is not willing to provide us with proof that they made attempts to mitigate suggests that they did not act reasonably. SP's conduct is in bad faith. Nevada law requires mitigation of damages and good faith. Also SP refused to waive a $50 late charge for March. We routinely paid through the bank's on-line billpayer program. SP routinely received and processed such payments without complication. I requested the March payment in mid February and received a call from SP in mid March that no check had been received and promptly brought in a replacement check and provided proof of the earlier check being orderedDesired SettlementAs full settlement of all matters between my mom and SP, my mom requests a reduction of her total balance of charges from $2,692 to $1,321 (that includes a waiver of a $50 March late penalty described above).
