I am rejecting this response because: Sky has not really offered anything of substance to to correct the tremendous issues.As I mentioned before, we believe that arbitration is probably the best option as we do not feel that an acceptable options will be offered by Sky. The walls and ceiling in the bedroom need to be sheetrocked correctly, Sky has never commented on the walls but they are as bad as the ceiling, they just do not have gravity pulling on themThe ceiling is sagging and cracking after only a few months. The Pocket door needs to be replaced and the opening fixed to 1) not dig into the door and 2) have straight lines. We need to be reimbursed for the labor costs to install the trim left off of the kitchen(I believe it was $250, I can send a cancelled check if need be)The biggest issue is the shower tile, as we recently learned, it was not installed to code and plain sheet rock was usedAdditionally, the connections were grouted, they should have been caulkedThis has caused the connections to crack already (which will degrade the plain sheetrock quickly). I was not home on the day that the tile was repaired so I did not have the opportunity to get a picture, but please feel free to contact *** *** plumbing still needs to come and replace the shower, when they remove the old one perhaps there will be an opportunity to take a picture of the make up of the wall behind the tile in the faucet openingsSky could also pay for an independant sheetrock company to come and cut a spot in the wall to view the back side of the tile, and then have that spot repaired immediately if they doubt the statement from *** ***. This does not even touch on the emotional toll and increased stress that having such a poor work done on our house has created. Regards,

I am rejecting this response because: Sky has not made any efforts to rectify the situationAdditionally, we have new information towards the shoddy work completed by Sky. *** Plumbing (a sub-contractor hired by Sky to install the shower) sent out an independent tile installer (Please note he was hired by *** NOT by us) to fix the tiles that were damaged during improper installation of the shower*** *** Installation sent the attached emailThey found that the entire shower needs to be retiled.Or we will be subjecting ourselves to mold and eventual failure of the integrity of the structure. Citing "Tile was installed not even (bumpy).; Caulk was not applied properly at the corners.; But the main issue is the followed: the walls in shower stall were installed using the drywall instead of cement board.; This would not pass any inspection."At this time we would like to ask to be refunded for all monies paid for the demolition and construction of the shower, replacement of materials purchased, refunded for the cost to install the pocket door, the cost to re-sheetrock the walls and ceiling in the bedroom, and reimbursed for the cost to have the trim omitted and the cabinet replaced that has the hole cut improperly in the side of it. Alternatively, we wish to participate in Arbitration through the Revdex.com

Dear Revdex.com,I have included to the response below, prepared by our legal council in order to best respond to Mrs. [redacted]' complaint. Please know, at Sky Solutions we don't believe anyone or any company is perfect and we will always strive to be and do better. In this case, we feel any and...

everything we could do to please Mrs. [redacted] was done. We are very sorry for her displeasure with our services; however, we stand by our company and the work we performed and feel unreasonable expectations coupled with a hostile work environment caused by Mrs. [redacted] made pleasing her in this situation impossible. Sky Solutions, LLC has retained our firm to assist it with the Notice of Claim and complaint made by Mrs. [redacted]: As outlined below, Sky Solutions has already responded to these allegations and made an offer to address any of these issues. That offer was flatly rejected by your client who has now filed a false and misleading complaint with the Revdex.com in an attempt to damage Sky Solutions’ reputation. If your client truly wishes to resolve any outstanding issues, it is imperative that the parties work in cooperation. Sky Solutions will attempt to address each of the items on the list in your correspondence, most of which are general complaints. 1. Sky consistently hired sub-par. employees and failed to supervise them correctly resulting in shoddy work and the need for repairs. This allegation does not meet the requirements of C.R.S. §§ 13-20-801, et seq. It does not identify any specific element or otherwise identify anything for inspection. It is no possible for Sky Solutions to respond to general allegations. Sky Solutions denies that it has any “subpar” employees. 2. Found out from Sky contractor that Steve has a full-time job working the oil wells so he can only be there every other week. This was not disclosed. Aside from not being a defective condition that can be addressed through this process, the complaint misstates the legal obligations between the parties and standard industry practice. Assuming your client is referring to Steve Y[redacted], Mr. Y[redacted] is an owner of Sky Solutions as the general contractor for the project. There is no requirement in any of the documents that Mr. Y[redacted] be present full time at the [redacted]s’ project. It is not common for the owner of general contractors to be present at a project full time. Mr. Y[redacted] routinely monitored the work performed by the various trades as required.3. Sky suggested that if we ever wanted to update the window in the master bath to match the rest of the house we should do it now, we were unable to get the window immediately [redacted]n August 8, 2017 Page 2 {[redacted].DOCX / 1 } so Sky left the window sill off of the window to install the window at a later date. The window was not part of the original estimate, but the sill was. Both are still incomplete. The complaint here is unclear. The [redacted]s declined to have the master bath window be part of Sky Solutions’ scope of work, but asked Sky Solutions to leave the sill off because the [redacted]s intended to have the window replaced by another contractor. Now they are apparently complaining that Sky Solutions did not replace the window that was admittedly not in Sky Solutions’ scope or they are complaining that Sky Solutions left the sill off as requested. If the [redacted]s wish to have the sill installed, Sky Solutions can have it installed. Sky Solutions, however, is not responsible for work that was outside its scope. 4. [redacted] plumbing (a sub-contractor of Sky) installed a shower purchased by us. They drilled holes in the sides of the shower and through the marble tile to add L-brackets. This was not correct procedure. [redacted] said that they would order a new shower and fix the issue. They did not order the shower and now it is out of stock. No repairs have been made. Sky Solutions has already inspected the shower installation with [redacted] Plumbing. [redacted] Plumbing and Sky Solutions offered to fully repair and/or replace the shower with the same kind and quality. The exact shower unit installed is no longer manufactured. The [redacted]s have refused any other options, demanding that Sky Solutions replace the installed shower with a unit that cost thousands of dollars more. [redacted] Plumbing offered to make the repair at the same price point. The [redacted]’s are not entitled to a betterment. 5. Eddie (AKA [redacted] Construction) the (a sub-contractor of Sky) guy who did the work in the bedroom and the bathroom came back to look at the tile job in the bathroom. He stated that the issue was the material, not the application. Further discussion with Steve and Hector (another subcontractor of Sky). It was pointed out (by them): • that the tile was not level, it sticks out or is crooked in many places, The [redacted]s insisted on purchasing their own tile. The pieces varied in size and thickness. Eddie and Mr. Y[redacted] warned the [redacted]s that the inconsistency in the tile would result in an inconsistent surface and were instructed to proceed. • the pattern is not correct, there is a weird cut piece of tile in the middle of the wall....should follow a brick pattern Sky Solutions is not aware of any “weird cut piece of tile” which was not raised at the final walk-through. Eddie removed an accent piece at the [redacted]s’ request previously. • Sanded grout was used (this is what Eddie told us to buy) and the marble tile is scratched or dull around every grout line. And the grout is all over the place [redacted]n August 8, 2017 Page 3 {[redacted].DOCX / 1 } Sky Solutions inspected and offered to have this repaired at its cost. The [redacted]s declined. • The deck that the tub sits on slants into the tub so the water collects around the tub seam .... it should run toward the drain. Sky Solutions did not perform any structural work and was not asked to do so. The tub was installed in accordance with the plans. Sky Solutions has offered a $2000 credit, essentially forgoing the final payment from the [redacted]s. This amount specifically accounts for replacement of the tub and surrounding tile. • A " tool" was dropped by a Sky employee (this was acknowledged by Steve, Sky were the only people to set foot in the tub) and a cut is in the bottom of the fiberglass tub Sky Solutions did not acknowledge that a Sky Solutions employee caused this damage. It is noticeably missing from the final walk through. The tub was protected during any work. Sky Solutions confirmed it was pristine and actually had an employee spend an hour and half cleaning the tub prior to project completion. Upon information and belief, during the interim, Mr. [redacted] did some work in the tub and may have scratched it then. The [redacted]s also may have had a painter in after Sky Solutions finished its work. That said, Sky Solutions specifically took this complaint into account when it offered a $2000 credit against the final amounts owed on the project. • The pocket door installed by Eddie was hung crooked, it is still crooked, another employee of Sky, Scott, cut a lock notch in the door that was too big. Sky did replace the door and restain it, but scratched the top of the door during the staining process. After a couple weeks of use, there is a nail that sticks out inside the pocket door frame that is digging a grove into the door. It is also missing 2 pieces of trim inside of the molding. Sky Solutions installed a pocket door for the new bathroom. The door was replaced and restained. Mr. Y[redacted] personally installed the new door and confirmed that there were no issues with nails or other obstructions when the door was reinstalled. • Sky's employee, Hector was supposed to return to fix the issues on 6/14/2017. He stated that he would need to remove several tiles, remove the tub, lift the slope of the [redacted]n August 8, 2017 Page 4 {[redacted].DOCX / 1 } tiles on the deck, polish the scratches from the sanded grout, and a few other cosmetic changes. He did not show up. Eddie returned to level tiles, fix grout lines, and remove accent pieces at Mrs. [redacted]’s request. Mrs. [redacted] approved the repairs he made. Hector (owner of [redacted]), who did not do the original installation (and who is not a Sky Solutions employee), was not scheduled to return as a result. 6. The ceiling and walls in the bedroom have huge seams. The ceiling moves when you push on it. The drywall is not secured to the joists. We received an estimate from [redacted] drywall (also a subcontractor for sky aka [redacted] Paint & Drywall) to come back and repair the bedroom walls, the quotes between $1200 and $1300. [redacted] stated that they have concerns that the ceiling will continue to flex and crack. The ceiling was intentionally removed from Sky Solutions scope of work. Sky Solutions, therefore, did not do any work on the ceiling was not hired to do so. • Our painter was responsible for "skimming" the ceiling to remove the 2 different textures that existed, but he had NOTHING to do with sheetrock or the walls, We did request (at Sky's suggestion) that the ceiling texture be taken off of the original. Herein lies the problem. The [redacted]s removed the ceiling from Sky Solutions’ scope of work, but are not attempting to hold Sky Solutions responsible for completing that work and for preexisting conditions on the property that were outside its scope. 7. The electrician (a sub-contractor of Sky) told Jay that we could not ever turn on one breaker in the electrical box. That we had a short in the ceiling and it would cause a fire. This individual was also smoking marijuana on our property. Sky did fire this person and Sky did hire a different company to correctly wire the house. It is unclear what the complaint here may be related to electrical. The [redacted]s seem to be complaining that they brought a problem to Sky Solutions’ attention and Sky Solutions resolved it and had the electrical installed correctly and any required repairs made at Sky's expense. 8. Scott, a employee of Sky, was doing a very poor job at many things, he also told me he was showing up and did not, when I asked him about it he complained to Cassidy, and I was asked to not speak to any of the sub-contractors of Sky. (Scott was fired for his poor work). Again, the purpose of the Notice of Claim process is to address alleged defects, not air grievances about employees or subcontractors that the owner did not like. Based on the allegation itself, the alleged employee was removed. 9. Hector, (a subcontractor of Sky) was hired to install the kitchen cabinets, we also needed to have a pantry built, Sky recommended Hector, but suggested that we deal with Hector [redacted] August 8, 2017 Page 5 {[redacted].DOCX / 1 } directly. I only have a cell phone number for Hector. He has not returned or answered the phone. The kitchen cabinets and pantry are outside Sky Solutions’ scope of work. It is not Sky Solutions’ responsibility to find another contractor for the [redacted]s.10. Jobs contracted with Sky: • the sides on the island did not come to the ground, Hector added a trim piece to cover up the crack, he did not add the piece to the peninsula Sky Solutions originally bid the cabinetry. The [redacted]s declined and ordered discontinued cabinets separately from Sky Solutions in an effort to save money. Sky Solutions had to remove several walls based on the design [redacted]s wanted for the kitchen. This required cedar posts to accommodate structural requirements. The trim pieces Mrs. [redacted] ordered did not include trim for the posts. Sky Solutions was willing to install trim, but the [redacted]s refused to purchase the necessary trim pieces. Sky Solutions even attempted to help the [redacted]s locate trim for the discontinued cabinetry. • The back side of the peninsula is not connected to the ground The back side of the peninsula is secured and abuts the stove. It cannot be connected to the stove. Mr. Y[redacted] has attempted to explain this to the [redacted]s multiple times. There is no way of attaching it to the flooring without interfering with the placement of the stove. There is no defective condition. • The fridge cabinet was not secured to the floor, when Hector came back to connect the cabinet to the floor he did not screw up the feet on the fridge and there are huge gouges in the new hardwood floor. Sky Solutions was present the day after Fernando did this work and there were no scratches on the floor. • The cabinet by the fireplace, the hole for the outlet was not cut in the right spot Sky Solutions is not aware of any issue here and all electrical was confirmed to be installed per plan. This alleged issue was not raised on the final walk-through.11. Jobs with Hector not in the estimate with Sky (side work with us directly) • The pantry is 2 different colors, still in pieces • The microwave shelf is not complete [redacted] August 8, 2017 Page 6 {[redacted].DOCX / 1 } • Hector took the door used for color matching, a los to be used to create trim for the microwave drawer The cabinets and pantry referenced here are outside Sky Solutions’ scope of work. It is not Sky Solutions’ responsibility to answer for other contractors. Those issues, if any, should be raised directly with that contractor.12. The close on the front door was damaged during construction, it was not repaired and reinstalled. Sky Solutions denies any knowledge on this issue. The front door was working correctly during final walk-through and the [redacted]s have had other contrators onsite.13. I have not received the amended structural engineer recommendation letter and drawings. A copy of all structural engineer recommendations and drawing were previously provided to the [redacted]s.14. Steve scheduled to return on July 3rd and 4th to complete the projects. He is no longer planning to come. Mr. Y[redacted] discussed returning to do extra work outside Sky Solutions’ original scope related to incomplete work by the [redacted]’s separate flooring contractor as well as some additional work for a new window and a deck railing. Mr. Y[redacted] indicated the earliest he could do this additional work would be after July 3. After continuing disputes with the [redacted]s, Mr. Y[redacted] elected not to perform this additional work. It was not in the scope of work for Sky Solutions and the [redacted]s have not be charged for any of it.In addition to these responses, it has now come to our attention that your clients have filed a claim with the Revdex.com containing multiple false accusations or misleading statements in an effort to damage Sky Solutions’ reputation and business relationships. These include allegations such as: 1. Sky Solutions walked off the job. In fact, it repeatedly offered options to complete punch items that were rejected by your clients. 2. Much of the work is “shoddy”. As noted above, the Notice of Claim details a few items that constitute anything related to a defect or work quality. Even then, much of that is admittedly related to items that were outside Sky Solutions’ work and performed by other contractors. To baldly state that “much” of the work was “shoddy” completely overstates the allegations, let alone the actual facts. [redacted] August 8, 2017 Page 7 {[redacted].DOCX / 1 } 3. “[O]ur house was damaged by Sky contractors.” There is no allegation anywhere in the Notice of Claim of such damage. This type of attempt to damage Sky Solutions is entirely unhelpful in attempting to resolve this matter. Sky Solutions requests that the [redacted]s immediately withdraw their complaint and any other social media posts in a show of good faith. Otherwise, Mr. Y[redacted] of Sky Solutions has already offered to credit the [redacted]s $2,000, absolving them of any further payment on this project. This amount accounts for the cost to install a new bathtub and surrounding tile as well as other issues discussed above. Further, [redacted] Plumbing has repeatedly offered to replace the shower at its cost and, upon information and belief, remains willing to do so. Sky Solutions renews this offer in a good faith effort to fully and finally resolve this matter and close out the project.
