To the Revdex.com, My name is Joseph C [redacted] and I am responding to a letter that I received from The Revdex.com in response to a complaint that a past customer filed against my painting company, Skyline PaintingI will address the items as they are listed in the complaint ID number [redacted] The contract was dated and signed September 19, 2016, not October of The contract clearly states that the customer understands that the painting project will start on approximately October 30, 2016, weather permittingIf weather does not permit, the customer understands that the project will start in the Spring of When contracts for painting are signed so late in the Oregon painting season, I always inform the customer of that possibility because of Oregon's unpredictable Fall weatherThe project started in June 2017, which was Spring of and was what the contract had specified The customer arrived home after the front of the house was paintedShe said that she understood that the cedar shakes on the front of the house were not to be painted, (they were currently stained) she and her father thought now that they might not match the color that she had chosenShe requested that I now paint the stained shake area of the house which was not to be painted in the original price since they were not previously paintedI agreed and painted this previously unpainted area of the houseI believe that the customer understood that there would be an increase in the original priceYou normally never paint an unpainted area on a property unless the customer requests it at the time of an estimate, and the customer made it very clear that this stained would area was not to be paintedI believe that she is trying to get the extra work done without a chargeMy only error is not immediately completing and addendum to the contract adding this additional workThe extra painter that I used was on the property when the customer requested the additional work can attest to the conversation that took place around that request The paint was purchased in gallon containersThe gallon containers are much less costly for the customer than gallon containers The job took all of the paint except for the last gallons of paint in the last opened gallon container which was left with the customer for touch up in the futureThe extra gallons of paint @ per gallon, would come to 225.00, not The customer asked if the extra paint could be returned and I explained that an opened container of paint can never be returned and ANY paint can never be returned when it is a custom color, which is what this customer choseWhy would I pay for paint that is in the customer's possession and that I have no use for? I in no way bullied this customer or her motherI did tell them if they refused to pay the final payment, that my only recourse would be to file a construction lien on the property, especially since they were planning on listing the property for sale immediatelyThe customer was given Lien Notices that the state of Oregon requires, and signed them along with the contract in September of As a contractor, this is the direction that I have been given by Oregon State, although I have never needed to file a lien notice on a customer's property I believe that because I completed the project in less time than I originally anticipated (which was not less than hours) because I brought in an extra painter and was able to complete the project in less time, the customer feels that she is somehow entitled to money back I felt that this was to the customer's advantage since she was anxious to get the project completed as soon as possible with the purpose of selling the property I have been a painting contractor licensed with the State of Oregon for over yearsI have an excellent record with the state of Oregon and have always had an excellent rating with The Revdex.comI am sorry that this customer has filed this complaint, but I in no way am responsible for this complaint Sincerely, Joseph C [redacted] Skyline Painting License number # [redacted] Palomino Way West Lin, [email protected] Ph:503-635-

Complaint: [redacted] I am rejecting this response because:I have dealt with contractors over the past months in my homeNone have broken their own contract, bullied myself or my family or come up with extra fees at the last minuteMy initial contract says there are no exclusions to the home being painted-having not painted a home before, how would the shakes above the garage NOT be part of the entire home? I was never asked about this prior to arrival to do the job and I asked what people normally do and was told by JOSEPH they should be painted-talk about a shady businessman! At that time it should have been stated in writing what the extra cost would be, not when writing the check and being shocked by an extra fee-not only that, my garage door was supposedly included in the original estimate (though I was never asked on this either) and it did not get painted nor did a post that most certainly was included in the whole home also but now was unsafe to paint-funny the painter I hired days after this complaint painted the post, my garage door AND the places on the home that Skyline Painting left pieces of trim completely unpainted on one side of the home but painted on the other sideHad he not completed the job and demanded I leave payment while I was at work I would have seen these blatant mistakes on the front of my home before he leftIn addition my new painter tells me there over gallons of paint left and any professional should have known to buy smaller quantities to not stick me with close to $in extra paint (he has stated this to my lawyer this is not something I knew anything about).Overall, it is not about the $that he most certainly owes us, it is about a very shady business that should never be overcharging people (painters say you absolutely did) or bullying single women (which my neighbor will attest to)I have also filed a complaint with the Oregon Contractors board Sincerely, [redacted]

The extra 3 gallons of paint @ 75.00 per gallon, would come to 225.00, not 500.00. The customer asked if the extra paint could be returned and I explained that an opened container of paint can never be returned and ANY paint can never be returned when it is a custom color, which is what this customer chose. Why would I pay for paint that is in the customer's possession and that I have no use for?   4. I in no way bullied this customer or her mother. I did tell them if they refused to pay the final payment, that my only recourse would be to file a construction lien on the property, especially since they were planning on listing the property for sale immediately. I have not in any way come up with added charges or bullied this customer. If indeed the previously stained (not painted) shakes had been included in my contract with this customer, I would have painted them without any additional charge, no questions. The customer is well aware of that fact and is just attempting to have them painted for free. She came home after the front of the house was painted and specifically told me that she and her father had changed their minds, and now wanted them painted. I complied, but should have done an addendum to the original contract. In retrospect, I also should have put this same shake area in the contract as an inclusion. I did not do so for the following reason: If a house has a natural brick fascia and everything else was cedar siding, a painter would not paint that brick unless the customer requested it, even though the cedar siding was being painted. It would not be included because it was not currently painted and was natural brick. In the same way, this cedar shake area was not previously painted and was treated naturally, although the rest of the siding was painted. In addition, the customer specifically requested when the job was bid, that this cedar shake area be left natural and not painted. I believe that she has a clear understanding of this, later changed her mind, and now wants it for free.As far as the extra paint is concerned, there are approximately 3 gallons left from the 5 gallon can, not 5. This is the customer's custom paint and was left in her possession on the job site. There is no way to know ahead of time exactly how much paint will be required for a job because all surfaces absorb the material differently. No reputable professional painter would say exactly how much paint is required ahead of time.  Why this customer continues to say that there were 5 extra unused gallons with a value of 500.00 of paint at completion is a mystery to me. Again, there were approximately 3 gallons remaining in a 5 gallon can at completion.At this point, if this customer wants to let the Building Contractor's Board make the final decision, I will meet with their representative on site, and except their ruling. I have been a licensed painting contractor with the state of Oregon for over 30 years with an impeccable record.
