An oral contract was made on complaint date, the owner/photographer accepted the money in exchange for a CD of wedding photographs. This lady returned the $20.00 the following week indicating she would not send the CD. I returned the money to her with a letter stating she and I entered into an oral contract and she was obligated to carry the contract out. I asked her what would she charge for a CD copy of the photos taken and she said $20.00 on the complaint date. She could have as easily said "no" at that conversation, but she said "yes" for $20.00. She sells photographs on her website, so, therefore, she sells directly to the public. She is obligated to fulfill our contract.
