I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
You have the letter from Barnnett's Roofing's attorney; thank you for sending a copy. This letter referred to a repair dateWe did indeed contract Barnnett's in 2000, that to lay a proper layer in anticipation to our installing SolarWe have no complaint for the work done at that time. In February , 2013, We engaged *** *** to repair a leak which caused interior damageHe came and worked to find and repair the leakWe paid him $1,Mr*** recommended people to repair the ceiling and repaint that and the walls; we contracted same and paid them separately. Upon returning to Mesa from spending the summer in Payson, we were surprised to see that the interior had identical damage as before Mr*** said the leak had been repairedUpon calling *** Barrnett, he was concerned, and seemed ready to help, but spoke of having more or less retired from doing work himself, and would send (I believe his son-in-law)*** to take care of the situationAfter some wait, *** *** did come, find the problem and solve itHe also offered to take responsibility for the interior repair. For this we waited monthsWhen a "repair" crew arrived, it was one person who took one look at the damage, and managed to make it known in English that this was far too big a job for one personThis person had come to do the entire repair alone in under hoursThis person had no license nor insuranceThat was the end of help from Barnnett's RoofingWe had no use of our Arizona room for entertaining for months, and were unable to put up a tree for the Christmas season as we waitedFinally we sought estimates which resulted in our engaging *** *** ***Mel, who with a helper, in two days, did the interior repair for the very reasonable sum of $- the exact amount that Mr*** had said it would likely cost himWe believe it only reasonable that Mr*** pay us this fair and expected amount for promised workWe favored him with the time we spent getting his work done. expect that should we hire a lawyer who argues as well as does MrPotter, we should be able to collect more than this simple $repairWe have experience with courts and property damage; being landlords, and believe we know what to expect as fair and ethical due*** Barnnett has done many thousands of dollars work on our house over the years; I cannot believe we would have had this argument were he still managing the Company. This firm represents Barnett Roofing CompanyI am in receipt of a copy of your letter dated March 8, 2014, to Mr*** *** detailing a complaint that the Revdex.com ("Revdex.com") has received from *** and *** ***.
By way of background, Barnett Roofing
contracted with the ***s to complete roof repairs in 2000, for which the ***s paid Barnett Roofing the contracted price, In late 2013, the ***s contacted Barnet Roofing complaining of leaking due to roof problems and stated that they believed the problems stemmed from faulty work completed by Barnett Roofing in 2000, Under Arizona law, the time period for bringing a claim of faulty workmanship before the *** ** *** is years and a breach of contract claim in *** *** is yearsTherefore, the ***s should have made a claim for faulty repair by the latest in or for breach of contract in if they felt that the work was substandardClearly, the work performed in was satisfactory, as the ***s have not complained of any problems until 2013.
Upon receiving the complaint for faulty work from the ***s, although there was no warranty obligation stemming from the repair, Barnet Roofing agreed to send *** *** to the property to look at the problem*** visited the property and, free of charge, removed roof tiles above the leaking area, cleaning out the accumulated leaves and debris which were the likely cause of the leak and further replaced the felt underlayment, which had rotted-outBarnett Roofing only visited the property as a favor to the and did not charge the ***s for the visit to their property or for the minor repair work that *** performed.As the leaky roof had caused water intrusion, resulting in water damage to the interior walls of the home, *** provided Ms*** with the name of a repairman and painter that could repair the interior wallsMs*** eventually contracted with *** *** *** to complete repairs to the interior wallsThe ***s paid *** *** *** $for the repair workBarnet Roofing did not contract for or perform interior repairs to the ***s' homeAdditionally, Barnett Roofing did not seek nor was it paid compensation for any repairs to the home.
After paying *** *** *** for the repair work to the interior walls, Ms*** contacted Barnett Roofing, demanding reimbursement for the cost of repairs to the interior wallsAs previously stated, Barnett Roofing had not performed work on the roof since The work performed in was completed simply as a favor, and was not the cause of the damage to the interior wallsIn factthe damage to the interior walls occurred prior to Alan's visit and was evident at the time of his visit.
Based on the foregoing fact, the *** have no basis for complaint against Barnett RoofingBarnett roofing did not cause the damage to the ***'s propertyBarnet Roofing did not charge the ***s for the visit or minor repair work to their roof in And Barnett Roofing is not responsible for the ***'s payment to *** *** *** for the work the the ***s contracted with that company to performTherefore, I respectfully request that the Revdex.com close the above referenced complaint.
