I have reviewed the offer made by the business in reference to complaint ID *** and find that the business has provided information in his response and that no actual offer was madeI will address the issues raised in that reply In addition, the business owner provided a PDF of a contract This is not the original contract and has added text I possess two yellow carbon copies of the original handwritten contract These were written and signed by Justin SlocumIt is not clear when the PDF was created In regards to the timing of the price requested, Slocum provided the number of $*** over the phone prior to receiving the check in person He never requested the remaining $and calls this a "$*** break" When Slocum called stating the amount due, I told him I needed to speak with him regarding the breach of contract and lack of quality of work, and he came to the property to do so It was at this point that I disagreed with the amount due since there was a clear variance in the contract I assume this is claimed due to no work being performed on the joists in the crawlspace but that has never been verified The concern in the breach of contract is that none of the load-bearing wall studs in questions make contact with the sole plate of the wall The original studs were left in place, and three studs were sistered with additional blocking placed parallel fashion and screwed to the original studs On one stud, there is no support beneath the stud at all Three other original studs were cut and left in place, and there are obvious visible gaps and no sistering support My concern is that the dead load of the above floor will negatively impact the wall causing further damage. I again made contact with the county building department in person and showed them pictures They advised that work on a load-bearing wall over the value of $*** does not qualify as an "ordinary repair" and subsequently requires a permit This applies to repairs not only "removal of a load bearing walls." I will continue to believe the county building department on this issue and not Slocum In regards to the trash can issue, this trash was placed in the trash can by Slocum employees Work was started on trash day after it was picked up Workers brought the rolling can from the street to the deck and filled it up I had to remove the construction debris from the can so it could be used for household trash as was its intended purpose No trailer was in proximity to the property Slocum stated in his response that I threatened him This is not true Slocum's actions on the day that I paid the check of $*** to him were extremely aggressive and rude Due to this, I put the check in his hand, and he continued to yell at me and step closer to me When he started to leave and then turned around to continue to yell at me at a distance of less than feet, I then told him to leave the property He took steps away then stopped and turned around again, and I advised him he didn't want to do anything else At this point, he finally left Following the complaint and Slocum's response, Slocum also called me to ask what I wanted as a resolution on Monday 06/05/ I was unable to complete the conversation and was forced to delay followup In this conversation, the topic came up that I did indeed tell Slocum to get off my property due to his attitude He did apologize for his actions and said he shouldn't have spoke to me that way On Wednesday 06/07/17, I conducted a followup with the county building department It was then that I showed pictures to building officials and reaffirmed the above information That afternoon at approximately hours, I spoke with Slocum by phone again I explained to him that his apology went a long way and that what I wanted was to know that my house is structurally sound I stated that I wanted a permit pulled and subsequent inspection by proper building officials He agreed to this I also advised that the permit would need to be obtained by Friday 06/09/so I could fulfill my 7-day reply time to the Revdex.com Slocum obtained this permit on Friday 06/09/which is assigned number *** We agreed that I would provide a date that I would be a**ilable to do the on site inspection The description on the permit states "Siding replacement and door and subfloor replacement IRC." This description does not mention the stud repair though other work is, but this is on the drawing for the permit which adds "sistered studs." Slocum provided this to me on 06/09/ In our conversation on 06/07/17, when Slocum agreed to the permit/inspection, I advised him that if it passes inspection, then I will cease seeking a refund and if it doesn't then we would require another conversation about what to do next Following a passing building inspection, I will consider this complaint resolvedIf the work does not pass the building inspection as promised I can and will get back to you at: [email protected]

I will address the issues raised in that reply.  In addition, the business owner provided a PDF  of a contract.  This is not the original contract and has added text.  I possess two yellow carbon copies of the original handwritten contract.  These were written and signed by Justin Slocum.
