Mr***,I hope you are doing well and had a wonderful weekend I appreciate your invitation to look at the project in person Unfortunately this is the busiest time of year for us and it is minimum of a half day dedication to drive to your residence and back I feel I have a very good understanding of the project via photos you have provided and photos *** took on-site I did however think long and hard about your project over the weekend and have come to a hopeful resolution In lieu of this dragging out and going through the potential Lien process I have credited your account $that is valid only today and will expire at close of business today This is a credit that I am offering to have this issue resolved today If you can give me a reply via e-mail that you accept this $discount I will consider this matter closed.Please advise as to how you would like to proceed Thank you in advance for your prompt attention to this matter. *** ** ***VICE PRESIDENT/MANAGING MEMBER

I hope you are doing well and have had a productive week We were contracted to complete Mr*** stamped concrete project and were able to remove the existing slate covered concrete pad and install a new stamped concrete landing back to the original dimensions Standard Operating
procedure for all stamped concrete projects involving any coloring of the installed concrete is to provide the customer with a color chart of all available colors that can be added into the concrete ready mix for their project and allow them to make the color selection so we do not have any issues regarding the selected color Mr*** upon completion of the project sent me the following e-mail: ***,Your concrete crew finished up this morning and the product they left me with is very satisfactory There were some issues however *** has probably informed you of the damage to my lawn I checked with *** *** *** and estimate that there is about $in damage Unfortunately, the damage cannot be repaired until fall and I am left with a damaged lawn until then I prefer to do the work myself so the $is for materials only Let me know how you want to handle this.***At that time an invoice was generated and forward to the customer As the weekend progressed I was forwarded a second e-mail regarding the project and he indicated the following: ***,Now that we have had time to better evaluate the porch we are quite unhappy with it As you can see from the attached photo, it is a blotchy mess When the porch was stamped the grey powder was evenly spread over the porch But somehow between then and the sealing most of the color was lost The result is something very unattractive It has no resemblance to the slate look we asked for Nor does it look like the pictures we saw of projects that were supposed to be similar.I look forward to hearing from you to determine where we go from here.***I personally contacted Mr*** on Monday, August 3rd to discuss the project It was confirmed by Mr*** that his issue with the project had nothing to do with the quality of workmanship, but the coloring of the new stamped concrete landing I explained very professionally that since he made the color selection that there was nothing we could do to change the color of the stamped concrete without removing the landing completely and re-pouring a new landing This is not something we feel liable for considering Mr*** made the color selection.I took the time to send him a photo of a past project we completed where the customer selected a much darker color during the estimate process before a signed contract was signed At the time of the color selection it is up to the customer to make sure the proper coloring is selected I have been in communication with Mr*** and was surprised to see him file a complaint with Revdex.com and indicate a dollar figure he is wanting for a discount This has not been discussed at all during our conversations.I am hopeful Mr*** will understand our stance as we progress towards a resolution

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
All Masonry management continues to ignore the main portion of my complaint.  I have no problem with the job they preformed nor would I have objected to the increase in cost if  only they had complied with the conditions of our agreement.  For the record I have paid them the total amount that they overbilled in order to prevent any lien they threatened to place on my property.  The issue is simple:  The agreement I signed with All Masonry contains a statement as follows:  "Any unforeseen work that exceeds 10% of the contract amount will require a signed Change Order from the customer." The increased price was an increase of 21.9% of the original quote.   I did receive an e-mail stating that the work would take an additional 2 days and 2 people to complete the job.  No where in that e-mail did it state that the e-mail was a Change Order or the amount of the additional charge or that it required my signature.  I falsely assumed that they were just notifying me that the job was going to take longer than anticipated.  It is to bad this company cannot admit they messed up and do the right thing and absorb the cost of their no compliance with our agreement.[redacted]President[redacted]

Mr. [redacted],I hope you are doing well and have had a productive week.  In response to Mr. [redacted]'s complaint I can say that during the initial discussions after the estimate had been provided to Mr. [redacted] we discussed the potential of the existing tree and root system behind the deteriorated...

retaining wall.  No where in our Masonry Bid to the customer did I illustrate any type of tree root removal.  This prompted the conversation that Mr. [redacted] has conveniently forgotten.  This was not included in the Masonry Bid due to the uncertainty of the tree root system behind the wall and our inability to fully ascertain the issue until the wall has been completely removed.  See below contract verbiage:Deliver Material, Set-Up Yard Sign & On-The-Job Time ClockDemo Existing Concrete Retaining Wall (Approx. 24’x2’)Dispose of All DebrisDig & Remove Earth for Concrete Footer – Install #4 Horizontal RebarPour New Concrete Footer (Approx. 24’x1’x8”)Install (Approx. 36LF) #4 Vertical RebarInstall (Approx. 90) 8” Regular CMU & Grout SolidInstall (Approx. 18) 4” Solid CMU for Wall CapInstall Drain Tile behind CMU Retaining Wall & Install #57 GravelClean Entire Job-SiteRemove Extra Material, Yard Sign & On-The-Job Time ClockMr. [redacted] was well aware that an extra charge could come into play and he replied by saying "it is what it is".  Once I received the call from my on-site crew and photos to substantiate the issue, I contacted Mr. [redacted] via e-mail to inform him that the root system was going to be an issue and it would add roughly two days to the project to have all of the root system removed so we could properly rebuild the retaining wall.  I did not receive a reply from Mr. [redacted].  Once the project was completed I forwarded Mr. [redacted] the project photos that he requested and the final invoice which included the change order for the root system removal.  Mr. [redacted] never called or e-mailed me with any concerns regarding the change order.  Once his "final" payment arrived he shorted the invoice the amount he felt wasn't fair and followed that deduction with the attached note.  I feel that we represented ourselves properly and professionally while delivering a clean and quality product as we always do.Thank you very much for your time and I am more than willing to answer any further questions or concerns you may have.Sincerely[redacted]
