Complaint: [redacted] I am rejecting this response because:? Mr [redacted] knows? that our accusations are true he said in fact that they made a mistake when I last spoke with him? that is why they tried to get us to sign off with and Mutual Release at closing.? I have also forwarded my complaint to the Texas Real Estate commission you can not lie on the disclosure form.? I was a real estate agent these forms are put in place to protect both seller and buyer.? I was hoping that this matter can be settled through this venue Regards, [redacted]

Smart Buy Homes strongly denies all allegations of wrongdoing by Mr [redacted] in hisunfortunate complaintIn reality, our company has done everything we have ever been required todo and more with respect to Mr [redacted] and his houseWe have spent significant time and moneytrying to please this customer even when we had no reason or obligation to do so.Mr [redacted] and his wife purchased a home from our company in The contract providedfor an "as is" transaction with no warranties whatsoeverThese terms were in writing and wereclearly understood by Mr [redacted] , who is a real estate professional himselfNonetheless, shortly aftertaking possession of the house, Mr [redacted] called Smart Buy Homes, complaining that he wantedcertain dimmer switches replacedEven though Smart Buy Homes had absolutely no obligation todo so, it paid its electrician to go to Mr [redacted] 's house and change the dimmer switchesThen, thevery next day, Mr [redacted] complained that he did not like the way the kitchen faucet spray headworked and did not think one ofthe toilets was flushing properlyAgain, even though the house wasthen owned by Mr [redacted] , who had purchased it on an "as is" basis, we nonetheless paid a plumberto address his concerns, simply to keep him happy and because it is our practice to go above andbeyond what is required to satisfy our customers.The next month, Mr [redacted] did not think the home's 40-gallon water heater was sufficientfor his needs, and, again, with no legal obligation to do so whatsoever, and even though the originalwater heater worked perfectly, Smart Buy Homes voluntarily agreed to pay one-half of the price ofa new 50-gallon water heater and installed it for him.With regard to the roof issue, in April2012, Mr [redacted] contacted us and said he wanted tofile a claim under the insurance policy we had provided for the homeAs it turned out, there hadbeen an accounting oversight on our part, and there was $3,in an escrow account related tothat house from when the house had been purchased from us by an earlier customer, who had madea roof claim and had never replaced the roof(We later regained possession of the house and resoldit to Mr [redacted] .) Whether legally obligated to do so or not, with Mr [redacted] 's approval, we agreedto use that money to install a new roof on the houseBecause there was not enough money to do allthe roofmg and siding work that Mr [redacted] wanted done, we told him that we could install a newroof over the existing shingles (an "overlay") for less money, and he agreedWe ended up doingroughly $5,of work on the roof and siding and additionally repaired rotted wood on the houseat no expense to Mr [redacted] He and his wife were very happy with the outcome.Years later, in 2016, Mr [redacted] contacted us to let us know he had the house under contractwith a prospective purchaser who was attempting to finance the transaction through the VATheVA, as it turns out, is the only major lending source that does not allow overlaysRegardless, we hadprovided exactly what we promised and exactly what was agreed [redacted] could easily have foundanother buyerThere was absolutely nothing wrong with the roofThere has never been any probleminsuring the roof to our knowledge, and there was no need for Mr [redacted] to replace the roof.With regard to the baseless foundation claims, the allegations are simply untrueWhile weare unaware of what claimed "patches" Mr [redacted] may be referencing, Smart Buy Homes has neverdone anything to conceal any foundation problems, and in the history of being associated with thishouse (dating back probably to sometime around 2005), Smart Buy Homes has never been aware ofthe house having any foundation problems whatsoeverWe cannot imagine, in fact, what possiblepatchwork Mr [redacted] could even begin to claim could possibly have masked any foundationproblem so severe that it would have required concrete piers to fix as he claimed in his demandletter to usIn other words, we have never known the house to have any foundation problems, andwe have some skepticism about the existence and scope of the claimed problemRegardless, evenif the house had foundation problems, it did not, to our knowledge, have them when we sold it toMr [redacted] , and, in any event, we certainly never made any misrepresentations about foundationproblems or otherwise did anything improperIn fact, our company routinely looks for and repairsfoundation problems on houses prior to selling themWhen we repair a foundation, we provide thepurchaser a 0-year warranty on the foundation at the time of purchaseWe would have done thaton this house, but the house simply did not have foundation problems to our knowledge when wesold it.Despite his current complaints, Mr [redacted] and his wife have been so satisfied with the wayour company has treated them over the years that just earlier this year, they approached us aboutpurchasing a different home from usWe are sorry Mr [redacted] is presently unsatisfied, but we feelwe ~~ve done everything we could and more to please himI hope this adequately explains ourpositiOnThank you for your attention to this matterIf you should need any further informationplease do not hesitate to contact us
