I just received a letter from you in the mail regarding *** ***As is the law, I had days from the date of move out to send a statement of deposit and any money dueMr*** moved out on February Therefore I had between February to March 2, to respondI sent out Mr***'s
disposition letter to him and a refund of $on March 2, Mr*** is in the process of cashing the check as it is pending at my bank. *** *** did not give me adequate notice of move-outHowever, as I mentioned to him I would be willing to work with himIn his lease it clearly states he forfeits his security deposit and pays rent until a new tenant is foundI was unaware that Mr*** did not read his lease or understand his obligations under his lease. The law is the tenant is responsible for all rent and any fees to find a new tenant. However, due to Mr***'s abusive nature I went ahead and only charged him $and gave him any rent money back since he insists I told him he could leaveThe $kept - is for $cleaning fee, $carpet cleaning fee, $for his portion of new carpet due to the fact that the carpet continued to smell like cat even after the professional cleaningMr*** had a cat that damaged the carpet by spraying or odor. Since his lease contradicted the law, we only kept the security deposit and did not charge a leasing feeHowever, when we talked I told him if he helped me out with leasing he could get a reduced leasing feeNow, why would Mr*** agree to this if he did not understand there was a leasing fee in the first place I believe I have taken care of Mr***'s allegations even before receiving this letter and perhaps Mr*** should maybe take a class on conflict resolution - sending messages that state "Not surprising that you are trying to *** me over, typical leasing company, only out to make money, don't care about the actual people living there." does not make the other person very cooperativePerhaps he shouldn't be such an abusive person in the future. Anyways, I acted with in the Landlord Tenant law in Washington State and returned his rent within daysAttached is the cashed check sent to *** ***it has the front and back of the check attachedThe check has been cashed. His original complaint was prematureHe asked for $and he received itHis complaint is resolved and having him continually attack my integrity isn't appropriateIf anything I believe I deserve an apologyI have had three lease breaks at this apartment during the same time frame and the other two apartments are very happy with my services and the results. I am rejecting this response because:  Owner of Smart Choice is still lying about what actually took place.  Claims that I did not give her notice that I was leaving, when I have email proof that I did as such, and got her approval that the agreement we made was still valid.  Owner was extremely lax about finding a new tenant, so I posted a Craigslist ad and received many responses.  Still waiting for my portion of March's rent as per the letter she mailed me.  Julie claims that I did not read my lease with the prior owners of the builing, however, she still fails to admit that we had an agreement that if I waited until February, I could move out with no penalty.  As far as being belligerent, it's pretty normal to get upset when you are being lied to and screwed over by a company.  I sincerely wish nothing but the worst for Julie J[redacted] and Smart Choice Realty, as they clearly are not a smart choice for anyone.
