This firm represents SmartWheels of Fairfax. The above-referenced complaint was forwarded to us for review and response. It appears that Ms. [redacted] purchased a [redacted] from SmartWheels. Then, several days later, Ms. [redacted] began to believe that the seat was uncomfortable. She then asked Ted...

Britt to unwind her contract – that is, buy back the [redacted], and sell her a different vehicle. However, Ms. [redacted] insisted that in connection with the buy-back, she be provided with a more expensive vehicle, without a corresponding increase in the price to her. SmartWheels does not, and did not, warrant the (subjective) comfort of a seat in a vehicle. Ms. [redacted] had ample opportunity to satisfy herself as to the suitability of the [redacted] to her before purchasing it. As reflected in Ms. [redacted]'s complaint, SmartWheels sought to accommodate Ms. [redacted] by offering to unwind her purchase of the [redacted]; however, Ms. [redacted] made a demand (a more expensive replacement vehicle, without a corresponding increase in price) that was not reasonable. Accordingly, SmartWheels did everything reasonable to accommodate Ms. [redacted]'s dissatisfaction, but Ms. [redacted] was (and apparently remains) unwilling to resolve the matter about which she complains on reasonable terms.Please contact me if you have any questions.Sincerely,Timothy B.
