Complainant has an agreement with [redacted] Financial to make any and all of their monthly payments on timeThe vehicle in question was not financed by Smartbuy Select Automotive NetworkComplainant did not make their first payment which was due on 3/14/They made a payment arrangement with [redacted] Financial for 3/21/This payment was also not madeAfter repeated messages and phone calls to the complainant, they still had not made a payment to [redacted] FinancialThis, in turn, put them as a "first payment default" account and vehicle was put out as a repossession by the bankComplainant did not cure their loan with [redacted] Financial in time, therefore, vehicle was repossessedAfter vehicle came to us, we have to recondition the vehicle for resaleCustomer should not be due any refunds by the dealership as this was their default on the contract, not the dealership's faultNo refund should be given since customer drove the vehicle for over daysIn fact, after all costs of reconditioning to the vehicle, depreciation for mileage added to the vehicle, and other costs, customer would actually owe the dealership but we have chosen not to proceed with legal action as long as this slanderous claim is dropped by the Complainant

Customer initially failed to provide us with necessary requirements for bank financingWe were continuously ordered to rush through car buying process, despite unforeseen happenings We later got the customer approval for the car that the customer wantedWe even helped *** find insurance,
as well as worked with the customer before and after business hours*** took ppssesion of vehicle and was extremely happy with her purchase*** drove the car for a total of three days The customer decided that they no longer wanted the car after entire process, reason unknownThe car is still covered under factory warranty and is at 28,milesThere were no accidents and one previous ownerWe offered to take care of car if anything was wrong*** refused. Our contract clearly states that refunds aren't givenHowever, we decided to let them do so

ON JULY 20TH MRS.& MR. *** WALKED IN OUR DEALERSHIP AROUND PM AND THEY WERE LOOKING FOR SMALL SUV, THEY LOOKED AT THE NISSAN ROGUE, THEN WE TOOK THEIR CREDIT APPLICATIONWE TOLD THEM TO COME BACK NEXT DAY TO COMPLETE THE DEAL, THE DEAL WAS GOING THROUGH LENDER ( SECURITY
AUTO LOANS), THEY CAME NEXT DAY WHICH WAS JULY 21ST AND SIGNED THE PAPER WORK AND THE LOAN CONTRACT ALSO SIGNED THEIR SERVICE CONTRACT MONTHS MILES EXTENDED WARRANTYON JULY 26TH THE LENDER CONTACTED US ABOUT RETURNING THE CONTRACT BECAUSE BOTH BUYER AND CO BUYER DID NOT HAVE JOB LIKE THEY CLAIMED IN THE APPLICATIONTHEREFORE WE CONTACTED THE CUSTOMERS INFORMING THEM TO RETURN THE VEHICLE WE EXPLAINED TO THEM THAT THEY CAN NOT KEEP THE VEHICLE BECAUSE THE LENDER CONTACTED THEIR EMPLOYER AND THE EMPLOYER TOLD THE LENDER THAT BOTH OF THEM NO LONGER EMPLOYED AS OF LAST WEEKWE TOLD BOTH BUYERS THAT IS FRAUD AND IT CAN HAVE REAL CONSEQUENCES.PAPER WORK CLEARLY STATED THAT IF YOU LIE ABOUT YOUR JOB OR INCOME OR ANY INFORMATION IN YOUR APPLICATION THIS DEAL WILL BE RETURNED AND WILL CHARGED RESTOCKING FEES AND DAILY RENTAL FEES AND MILLAGE *(PLEASE REEFER TO ATTACHMENT COPY OF BAILMENT / RESCISSION AGREEMENT ), WE REFUND THE CUSTOMER OUT OF THE $DOWN PAYMENT $

Complainant did not make their first payment which was due on 3/14/2017. They made a payment arrangement with...

[redacted] Financial for 3/21/2017. This payment was also not made. After repeated messages and phone calls to the complainant, they still had not made a payment to [redacted] Financial. This, in turn, put them as a "first payment default" account and vehicle was put out as a repossession by the bank. Complainant did not cure their loan with [redacted] Financial in time, therefore, vehicle was repossessed. After vehicle came to us, we have to recondition the vehicle for resale. Customer should not be due any refunds by the dealership as this was their default on the contract, not the dealership's fault. No refund should be given since customer drove the vehicle for over 45 days. In fact, after all costs of reconditioning to the vehicle, depreciation for mileage added to the vehicle, and other costs, customer would actually owe the dealership but we have chosen not to proceed with legal action as long as this slanderous claim is dropped by the Complainant.
