First, please note that the date of this complaint was 08/17/2015, but we were not notified until 10/05/when the client resorted to social media alerting us to the existence of the complaintWe had no prior knowledge.We are Certified Divorce Financial Analysts and we provide settlement
facilitation services to couples going through a divorce in an effort to find out-of-court solutions for property settlementsDivorce is a highly emotional event and we tend to see good people at their very worstOur role is to explore settlement options that are tax efficient and financially smart.This complaint is unfounded and should be dismissed for the following reasons:Wife(complainant) attended a free workshop of ours offered at the Fresh Start Women's Foundation and hired us on 02/17/to serve as financial neutrals in her divorce proceedingsShe paid the initial retainer of $Our process is to gather all financial statements, tax returns, etc, analyze and assess possible optionsShe also asked if we could hold negotiation meetings shuttle style, meeting with the parties individually as there was a history of domestic violenceWe agreed.We spent hours on data entry and analysis of their documentsAfter initial review, we let both parties know that we needed more information on Husband's two pensionsThey were unable to provide the documentation so I recommended they meet with the benefits administrator of the employerWife asserts in her claim that we should have been experts in pensions and fully informed of all provisions which is not realisticThere are thousands of different plans with different rules and without documentation, we would have no way of knowing the subtle details of each planIn total, we invested hours in data entry/analysis and hours in actual meeting time with both parties.Wife asserts that we dismissed her concernsHer concerns were very valid for her futureUnfortunately, this couple had very few resources or options to be able to provide for both parties in any meaningful wayWhile we understood her concerns, we didn't have any ability to change her circumstances or legal rightsDifficult news to hear for sure.As negotiation meetings progressed, we prepared different iterations of a proposed settlement (see attached) as the parties attempted to reach a compromiseThe last report presented to *** angered her and she felt it was very unfairThe information presented was simply what her husband had proposed and asked us to present(A sample of our work is attached)Wife had also shared that she had recently been diagnosed with Dissociative Disorder and due to mental instability wanted to appoint an advocate to help her digest and manage all of the information so she asked us to include her friend in all communicationAfter what she felt was an unreasonable proposal by Husband, Wife called our offices on 07/17/ELEVEN times in a period of minutes(see attached phone record.)She was speaking very erratically to our office manager and seemed quite distraughtFearing for her condition, we called her advocate to let her know what was happeningWe never heard back.The chief complaint was regarding refund of retainerHusband paid additional retainer of $by credit card on 05/20/Wife terminated the relationship via angry email shortly thereafterAs per our company policy, we refunded the remaining retainer balance to the party who had paid, in this case, Husband. I know the divorce process has been extremely difficult for this individual and she really wants someone to blame but in this case, we did everything we could to help this couple come to an agreementUnfortunately there wasn't an agreement that was acceptable to wife and the only option became litigation

Hiring Nancy Hetrick was the worst thing I could have done. She initially seemed so competent and knowledgeable, but I soon discovered this woman made mistake after mistake, which could well have cost me my future. She also was, in my opinion, untrustworthy, expensive and arrogant.

A few points:

1. Nancy made simple math mistakes on her EXCEL spreadsheets. These were glaring errors where, for example, the community amount and the separate amount did not add up to the total amount. When I pointed out errors, she would get nasty. I had to hire someone else to correct the errors that Nancy made on three spreadsheets. This cost me over $1,000. The CPA who corrected the numbers was shocked at the mistakes Nancy had made. Had I not had the numbers redone, Nancy’s mistakes would have cost me well over $100,000!
2. Nancy made nasty comments about me to my husband behind my back. My husband told me what was happening and expressed concern that Nancy was not being neutral.
3. Nancy could not seem to keep accounts straight. She continually confused a brokerage account (taxable) with an IRA even though we explained the difference over and over. And when I did explain her mistake, she would get angry.
4. Nancy tried to decide what was community property and what was sole and separate. Luckily at this point I had an attorney reviewing Nancy’s work. Had I listened to Nancy, I would have lost almost all community assets. My attorney had to spend much time explaining to Nancy how she was incorrect about the community property. I had to pay for Nancy’s time and my attorney’s time to the tune of thousands of dollars. Even after my attorney painstakingly explained legalities to Nancy, Nancy would ‘forget’ and revert back to old mistakes.
5. Nancy presented a settlement plan that she attempted to get me to agree with at a settlement meeting that my soon to be ex and I attended. During the settlement meeting Nancy announced that virtually all our property was my husband’s sole and separate property and that he did not need to give me spousal support. Nancy is not an attorney. It is not her job to determine these issues. It turns out that I WAS eligible for spousal maintenance under the law and much of the property WAS community. Nancy’s analysis & proposal that she attempted to get me to sign off on would have devastated me financially, while being unbelievably “generous” to my soon to be ex! After Nancy proclaimed that I had no “need” of spousal maintenance, she told my soon to be ex what a sweet spot he was in financially. I was in shock.
6. Nancy could not seem to understand logic. She initially told me that over half my IRA was community property. This was after I told her several times that I contributed for 25 years before I was married and less than three years after I was married. Indeed, the total amount that ended up as community property was less than 2% when done by an accredited CPA.
7. Nancy touted herself as being a forensic analyst, yet it was me who did ALL the analysis of accounts showing what was and was not community property.

Nothing that Nancy did was of any value to me, only harmful.

Perhaps worst of all was the stress this woman caused me. I had no idea what was happening and could not sleep. After the settlement meeting I was so shaken I could barely drive. I decided then never to see Nancy Hedrick again. I looked online and found other reviews on Nancy that echoed my concerns. The same nightmares had happened to others.

Phoenix, AZ 85016I hired Nancy H[redacted], Smarter Divorce Solutions, under false pretenses. Iwas told by Nancy that she specialized in Specialist/Forensic, Financial Analyst, and could identify short-term a nd long-term effects of dividing the property, could analyze tax issues,pensions and retirement plans, along with creating settlement options that result in a win/win for both parties. My husband & I have a "457 Deferred Compensation", along with PSRS {Public Safety Retirement System) and he is employed in Public Safety (Arizona State Retirement System). She stated that she had worked with several police officers and was very knowledgeable of the pension and retirement plans. Therefore, my husband and I hired her. However, we received absolutely none of these services.I feel that retaining the services of Nancy H[redacted], Smarter Divorce Solutions, was an absolute waist of my time and money.After the free consultation, I believed that the divorce process would be fairly smoot h because the division of household property, retirements, insurance had already taken place prior to the first visit with Nancy. My husband and Nancy knew that due to a long term marriage (32 yrs.), it was known that I was entitled to one half of the retirements and equity in the house.The main issue was the amount and duration of spousal maintenance, to secure my financial future in the event that he would precede me in death, and dealing with the details of the retirements.There were inconsistencies in what she said, and what she actually did (or didn't) do. Nancy provided false information, the billing is extremely questionable, did NOT perform an accurate or "thorough Financial Analysis", completely ignored many of my concerns, was deceptive in her approach, consistently made mistakes, was unprepared at meetings, and behaved in an unprofessional manor. Also, Iwas not provided with the final bill or told that there was a refund,however, my husband was sent a final bill and given a refund. Nancy acknowledged from the beginning that my husband would bring in our income tax refund in the form of a check and that it was considered to be one half from each of us. Therefore, she had no right sending a refund to my husband and not me also.The errors that were made would have had an extremely negative impact on the rest of my life, and once done, would not have been able to be undone. My trust in Nancy's ability to help me make sound financial decisions for the remainder of my life was shattered! Iwould be foolish to trust my future to someone whose judgment and information consistently proved to be untrustworthy.Please note that as the Revdex.com website instructions state, I tried to solve this by going to Nancy, Smarter Divorce Solutions, however, on 7/17/15 I spoke to Ms. G[redacted], Nancy's secretary, and asked to schedule an appointment with Nancy to discuss the many issues that I had with her service .Nancy never called me to make an appointment . However,she responded by leaving a message on my friend [redacted] phone.[redacted] attended and witnessed all but one meeting with me and she was my advocate.The message that Nancy left was extremely disrespectful, demeaning, and she flat out lied! She made statements such as, "We're getting some pretty abusive phone calls from [redacted] and we'd like you to run a little interference for us." Iwas not abusive in any way! "She called our office like 8 times in 15 minutes." I can produce phone records to show that this is a lie. It was a lengthy message filled with ridiculous comments and lies. For this reason I will not have any contact with Nancy without a neutral third party present to see and hear every word that is said. Sadly, I do not trust Nancy to be truthful and her [redacted] of professionalism is appalling.We were far better off before going to Smarter Divorce Solutions than we were by the time I finally retained a lawyer ju st to get back to where we were when we started. Nancy did not provide what she said she would so fo r this reason Iam asking for a full refund (minus the $500 error made by Nancy in our favor and $14.80 for copies that Iasked for}. After deducting these things, the totalcomes to $1,7 16.Thank you for your time and I look forward to hearing from you.

I let her know the money was refunded to [redacted] because he had called and paid the additional retainer fee.After calling again she said she needed to speak with Nancy because she had "many" things she was extremely unhappy about and would be filing a complaint with the Revdex.com. She is very upset that she wasn't notified about [redacted] getting a refund check and that she should have received half of it. She requested a statement of her account which I emailed to her. Asked for her interference and for her to be [redacted] voice if we need to have a conversation to resolve things. After my message to [redacted], I never heard back from either of you and considered this matter resolved.[redacted], we spent many, many hours doing our very best to help you gather information and become informed about your options. I personally worked at the best of my abilities and followed my company procedures in every way. I understand that you were not willing to consider [redacted]'s last offer but I really don't understand how that turned into a personal attack on me. The offer came from [redacted], not me.My role was to provide the research and analysis to enable you each to make informed decisions about your negotiations, which I did. [redacted], what exactly are you requesting from me to settle this matter? Are you asserting that I did not do the work you hired me to do?
