David Y was our builder and quit the job via text message. The job was 40% complete and he had taken 60% of his fee as the general contractor. He told some of the sub contractors he was planning on quitting and took one more payment then quit via text message.
We, the homeowners, were taking care of all the costs to *** in Vancouver, WA. There was an oversight on their end and a bill was not paid before delivered. We had our credit card on file to pay prior to delivery. As we had numerous invoices and *** is less than organized our last conversation with them was that we needed to obtain our credit card statements (going back 5 months) to verify the invoices and what was paid and not paid. We were in good standing with ***.
Yesterday we recieved notice of a lien on our property from David Y (owner of Smart Homes llc, also known as NW Smart Homes - Revdex.com link goes to David's web site) for the unpaid invoices from ***. No communication from him prior. In speaking with the *** representative in Vancouver there is no reason for this lien. Just one more example of David Y's incapacity to be a respectful and competent builder.

Please accept my response to this complaint.

From the beginning of this project the working relationship with the clients and myself became tenuous. As issues arose I worked to get them resolved. As the project went on they became more and more demanding and it was clear that they were not going to be satisfied with the outcome regardless of the results. The clients were bullying and badgering me nearly daily. I chose to leave the project as it was becoming an untenable situation.

In regards to the *** account. It is true the clients were paying the invoices with their credit card. However, the orders were being placed on the Smart Homes account and therefore Smart Homes was being billed for these unpaid invoices. The clients were given ample time to resolve their questions regarding these invoices but were not acting in a timely manner to get the invoices paid. I had no choice but to file a lien on the property for the unpaid invoices.

Since the lien notice was filed the clients have paid the balance in full and the lien has been satisfied. I have attached a copy of the lien release.

I am rejecting this response because of what David Y of Smart Homes Llc is stating are not the facts but rather an attempt to keep his Revdex.com rating intact. I am more than happy to share all correspondence we had with Mr. Y to the Revdex.com in order to show the reality of what transpired. There are new issues and information regarding our experience with Mr. Y that came after my Revdex.com complaint which are further evidence of the lack of skill and knowledge on his part when building a home:1- Two other sub contractors informed us that he had stated to them he was planning on quitting but he took one more payment from us before doing so.2- Our rain/gutter drainage system has failed - so far at least one pipe was damaged upon back fill by him and/or his sub contractor. We have yet to inspect the rest of the system due to the weather and state of the soil around the perimeter of the house. 3- We have found that he did not properly slope the crawl space and we have standing water as it is not able to drain to the low point drain and he did not seal the concrete foundation which is now back filled. We have scheduled professionals to come and tell us the scope of what needs to be done and give us an estimate on how to fix his mistakes. 4- The budget he gave us we are realizing was not realistic as everything is thousands of dollars over budget which will cost us tens of thousands of dollars in the end. We understand that many new construction homes will go over budget but for example Mr. Y put a line item budget for all cabinets and counters at $27,140 which is impossible for the quality and quantity we told him we wanted when he met with us prior to building a budget. This is just one of many budget numbers that were not realistic.5- The house is also significantly behind schedule due to Mr. Y and his subs and after quitting he put us further behind schedule. There will be additional costs to us in order to extend our loan and the interest on the loan. The professionals we have hired since Mr. Y quit have made comments on the poor quality of his work (and his sub contractors work) justifying what we experienced. I am more than happy to have them reach out to Revdex.com if you need their statements. His rating and my complaint must be accessible to the public so others are aware of the experience we had so they can educate themselves if they choose to hire Mr. David Y/Smart Homes.
