I recently purchased a used car 1987 Chevrolet Celebrity from SMDWOODS and the car was totally misrepresented as sold on eBay. Yes it's 30 years old! I didn't expect it to be perfect and last forever. I told Mr. Woods I needed a good running 2nd car that wouldn't leak fluids and that wouldn't cost me anymore than $3K He assured me it was a good running car and had no leaks as he advertised it is a "remarkable" running and driving car. I blame myself to have trusted this man as I should of test driven this car longer than I did when I purchased it. I drove 3 1/2 hrs to purchase this car and I was already invested with a little bit of money in the cost of a tow dolly, fuel, toll expenses and my time before I even looked at it. I did test drive it unfortunately for only 5 - 10 min on a small lakeside Rd. I should have driven it longer on better faster improved roads to get this car to develop the problems I encountered when I got it home. Anyway I did purchase it as it did run and drive fair enough but still not "remarkable". I'm good with working on cars so I knew I could take care of any small problems. After making the purchase I did tow the vehicle which was towed across Massachusetts and back to my home in NY on all improved highways. I traveled very cautiously at a speed no greater than 55mph. This is a front wheel drive car so I knew to tow it with its front wheels up on the dolly with its rear wheels trailing on the roadway. When I got the car home I took it for a longer ride (approx. 15-20 min) than I originally test drove it. Upon driving it the car the power steering started getting really noisy on turns and then the car shuddered and bucked, it wouldn't move faster as I stepped on the gas. I knew it was a transmission issue. I managed to idle the car back towards my residence and when I was just down the street from my home the car stalled out. I towed the car back to my driveway as I knew I would have to look at it mechanically. I checked the transmission fluid and the power steering fluid and both were very low. The power steering fluid was filthy. Mr. Woods claimed the car was recently serviced. I added fluids and that resolved the transmission and power steering issues. I did manage to get the car started again after sitting a couple of hours and as it was parked idling for 15 min. it stalled out again to which I had to wait another 2 hrs to restart it. I began to inspect the car and as I did I did notice it leaking oil in my driveway. I also noticed that Mr. Woods did not have a new catalytic converter installed on the car as he said he was going to do so. I decided to check the spark plugs for spark and the plugs were all good, however I had to replace all the spark plug wires as two of the wires had corroded pigtails and the others were somewhat aged. I managed to get the car started again and running but I just went on to stall again. I knew that I would now be getting deeper into this car as the problem was not easily identifiable. I decided I could not put anymore money into it as I could only go as High as $3K when I purchased it. I contacted Mr. Woods to see if I could get this car refunded. However Mr. Woods had his defenses set right into action from the start claiming that the car ran great for him prior to my purchase and that damage may have occurred to the vehicle as I towed it. I sent him pictures as there was no cosmetic damage. But he claimed I must have not removed the driveshaft when I towed it back home. I told him it was front wheel drive that it had no transmission linkage to the rear wheels and that it was towed with its front wheels on the dolly. He also said the car was recently serviced and the fluids were good. He claimed that he may have been misinformed by his mechanic about the catalytic converter not being replaced with a new one. I was now angered as I knew this man would not be honest and give me a refund. This car was not remarkable as he claimed and it died on me the very night I brought it home. I had no reason to be dishonest with him as I desperately needed a good running car before winter and I certainly wouldn't have driven to Massachusetts from central NY to want to buy a problem. I very much wanted this car to run for me. And now here this pile of junk sits in my driveway until I can sell it to recoup some of my loss. Mr. Woods did offer to have a new catalytic converter installed if I brought it back to Mass. I took a chance once and lost money. I certainly wasn't going to waste more money and time bringing it back to him. I decided not to persue Mass lemon law as it would require more money in attempting to fix the problem first and it's not going to be cheap to tow this vehicle to a shop, to diagnose it, then repair it. I have run several tests on it and I believe it to be fuel pump related. Not a cheap easy fix. BTW when Mr. Woods said he would replace the catalytic converter if I towed it back to him, he had another defense in place as to not providing a refund, eluding to the possibility of my damaging the car as I worked on it. Something I found insulting as I have worked on cars for a very long time and I know what I did could not possibly have done damage to this car. Oh yeah, and he insisted the car didn't leak on him yet I have oil stains in my driveway from this car. Mass does allow you to void sale and get a refund if the car does not pass inspection within Mass after a very short period of time. I wasn't going to throw more money into this deal in attempting to void this sale by towing it back to Mass. And who knows if it would have failed it appears that Massachusetts inspection is just a safety inspection. No, I have to eat this lousy deal as the person I bought it from was not honest to begin with. But like I said I blame myself as I should have driven a little longer and worked it a little harder when I test drove it. I paid a price and this man should too! Don't rely on Stephen Woods to be honest with you!

Let me explain that in MA a vehicle with over 125,000 miles is not covered by the Used Car Warranty Law. Rather it is required to pass inspection. I extended that coverage to you. The state of NH has informed me the car passed inspection on 10/27/2014, and regardless of my asking, no documents have been received stating otherwise. Regardless I have made efforts that I would have liked to have seen in your complaint. As it appeared I made no customer service attempts outside my obligations. - The advertisement did say keyless entry so I was happy to work with that with you. And you have the key. - [redacted] in Worcester did a poor job on a muffler repair that I had done right before the car was delivered to you. The muffler repair was one of the handful of efforts I made in attempts to insure you would be happy with the XC90. I / we had that rectified at [redacted] in Spencer. During the muffler repair the 02 sensor was damaged, so we made arrangements to rectify that. There is no way I can take back the fact that you and your husband are unhappy with a car you bought sight unseen, per your [redacted]s assessment. You had specified a price range you wanted to be in, and with little research on comparable XC90s, I hope you can gather that the purchase price was more than fair , and reflected the condition of the vehicle. Including the rear bumper, which photos I drew your attention too. On 12/22/14 I appreciate you informing me the XC90 now has 131,350 miles. I am happy that you are getting day to day use of the vehicle. As a mother who works in the medical field I'm sure you are not driving the XC90 ( "without rear brakes" ). I am sure you realize that you are not entitled to be driving a vehicle that would essentially be "free" for 2 months. I will not entertain buying it back. If this transaction continues to worsen , I can offer to attempt to find another vehicle for you etc. I belive this is a circumstance of buyers remorse, along with mechanical shops trying to procure work on a used vehicle, which should come as no surprise. They do not make generic bumpers for that model so would have to be factory which is well over 1,000 BC the hole is so large and deep it takes up all three parts of the rear bumper. I have explained time and again, I need the car to be left with me for work so that everything can get taken care of. I also have repeatedly asked for documents on inspections etc. I received none.- I was not informed of the licence plate or bulb, otherwise it would have been no problem to take care of.Not inspection related.- A OEM switchblade keyless entry key was ordered from my dealer , [redacted] in Worcester and mailed to [redacted]. She opted to have it programmed in NH to save her a trip to [redacted]What dealer programmed the key? Do you have a receipt? After I made many calls I informed you if you don't want to take the car to [redacted] that it will cost around $100 to have it done in NH. The 2007 Volvo XC90 we purchasefrom SMDWOODS AUTO weeks ago now requires a new engine and is unsafe to drive. We purchased a 2007 Volvo XC90 from SMDWOODS AUTO for $10,800. Several weeks after purchase the "low oil" light came on while driving with our two small children. There was almost no oil in the car. We have been told by three mechanics that the car requires a new engine (there is no oil leak) and is unsafe to drive. This is our only household vehicle. We contact [redacted] ([redacted] of SMDWOODS AUTO) to let him know about the first time the light came on, as well as when we were told by the mechanics that the car needs a new engine and he is unwilling to remedy this in any way. Desired SettlementWe would accept either a refund for our vehicle or a replacement vehicle that is comparable to the car we purchased (but with a functioning engine!) Informed [redacted] was on a road trip and that an oil light came on She inquired about what kind of oil the Volvo takes. Text message returned informing her that regular not synthetic was last used.9/18/13 - Email received from [redacted] informing me that she expects money for a new engine or money back for the Volvo.Along with the facts noted in an email to [redacted] ( attached) It is important to add, again the fact the vehicle was out of warranty when I was first contacted about [redacted]s concern. It has recently been disclosed that the Volvo now has 111,006 miles and clearly is being used for day to day use. No paperwork has been presented from a mechanic suggesting a tow or any repairs needed that is currently making the Volvo unsafe or usable, let alone an engine which certainly would be detected by the OBDI check engine light system well in advance of a failure that significant. If any such paperwork should happen to materialize at this point it certainly would be something I would suspect in the manor it was procured.Thank you again for your time and feel free to contact me should you need anything. I purchased a used vehicle from him and within the warranty period it needed a substantial quantity of oil. I took it to a mechanic and the mechanic informed me that, because the engine was consuming such a large quantity of oil, and there were no leaks, the car needed a new engine. Since that date, the car has consumed between 2-3 quarts of oil approximately every 800 miles. This is objectively too much oil for an engine to consume, according to the Volvo service station. There are no other explanations for the car's excessive oil consumption. The engine is faulty and therefore I'm requesting either a buyback or a refund of the cost of a new engine. [redacted]Final Business Response Dear [redacted], Please let me be very clear that the first instance of [redacted] making reference to " oil " was with a voicemail. ( in white below ) This was two days after the expiration of her warranty. It was not a call to initiate a warranty claim or to express that the car was being returned but rather a inquiry as to if the XC90 required regular or synthetic oil. The mileage on the XC90 at that time is not something I am privy too. Judging by the miles being accumulated on the XC90, a fresh service should be needed soon. I would suggest that [redacted] ask about a very high quality oil and filter, along with perhaps a engine flush, that in which could help with her concerns. Should she choose to deliver the car to [redacted], for they and I to inspect. I may offer to pay for the above mentioned, should she authorize the service. Again I would like to be clear that I will not operate and assume responsibility outside the guidelines of the law/ warranty provided to her. I purchased a [redacted] from SMDWOODS Auto. The car has major oil leaks and rust and rot damage, needs oil pan and new back end including mufflerI purchased a [redacted] from SMDWOODS Auto on [redacted] 2015. I made this purchase based on ads that he placed on [redacted] and [redacted] that the car was inspected and serviced and ran 100 %. After making contact he informed us the car had a check engine light on and needed an 02 to sensor so he offered us a lower price than advertised of [redacted] and we accepted based on the estimate that the 02 sensor would cost a few hundred to replace. My boyfriend then received an email from the business owner offering to write a bill of sale for [redacted] to "save us some money on taxes" which I was unaware of until it became time to sign the paperwork. Against my better judgement I agreed knowing that I had his emails and my bank statements should I need to prove what we paid for the vehicle. Thank God I kept those. The car was delivered to me and not an hour later we knew something was seriously wrong as enginge oil was pooling on the driveway underneath the car not just under the front end but the rear ends as well. Turns out when I brought the car for inspection I was informed by my mechanic that the car needed a new oil pan and that the entire rear end needed to be replaced due to severe rust and corrosion and rot. They recommended I not go forward with inspecting the car as the rear end was in bad condition but I figured Id let the business owner know about the problems and he would make the repairs or refund some of the money. Thats what a good person would do. This was the first time we contacted the business owner to let him know of the problems. Several unanswered texts were sent, then emails. After my replacement of the 02 sensor the car was able to barely pass inspection because though these problems hinder the overall operation and value of the car they are not considered an immediate safety threat. The next day, just as I was warned by the mechanic the muffler fell off the car into traffic. The business owner finally contacted us after we sent a picture of the fallen off muffler in its rusted and awful state. He said to bring it to a location for repair, we confirmed with him that he also needed to fix the oil leaks and asked for confirmation for us to bring in to him and this went unanswered. I spoke to an attorney and the [redacted] of [redacted] and they told me I have a case and to sue him, which is what I will do should this not be resolved immediately. I emailed him such and he has done nothing but waste my time with emails back and forth telling me to bring my car to x location, then reneging and telling me not to bring it. Then trying to blame my honest mechanic for the problems though I have multiple estimates within [redacted] of each other and showed him costs via a simple google search of reasonable repair costs in my area. I asked him again today where and when I can bring my car for repair or replacement or refund and my email has again gone unanswered so here I am adding to the other negative complaints of his business hoping for nothing but a fair and honest resolution. While I am not due a warranty under the used car requirements due to the mileage of the vehicle Mass does have the implied warranty of merchanability law that states the car has to be in good and reasonable working condition for a reasonable amount of time. I qoute " Under the implied warranty, a product must do what it was designed to do with "reasonable" safety, efficiency and ease for a "reasonable" period of time. If it does not run properly, the seller is responsible for repair, replacement or a refund. "This is what I will pursue if this matter isn't handled in a timely fashion through this outlet. Id like the business owner to make the necessary repairs to the vehicle within the next seven days or issue me a full refund of my cost and repairs. Again recommendations not dire repairs. I don't intend to rebuild a vehicle post sale in attempts to make even part of a used vehicle new. I have gathered information that the [redacted] has been operated in four wheel drive. I have suspicion as to if that four wheel drive operation was done negligently off road. Requests for the vehicle to be returned to me have been disregard and replied to with ultimatum, expectation of guarantees I will not give, threat of online slander. More over the words " do not contact me " and " I will see you in court. " I am confident I have fulfilled my legal obligations and have hands tied.
