Regardless of what caused the failure, the vessel was purchased as a used boat in 2016 with no warranty whatsoever. We have attempted to help the customer by charging only half the cost of the initial repairThere is nothing else that we can do at this time. Thank you. *** ***

The customer's boat was purchased in September of at our Chautauqua facility. The boat was purchased "As-Is" with no warranty express or implied. In the spring of the customer brought the vessel to our Main facility in North Tonawanda to diagnose a running issue. The
issue was corrected and the customer was only charged 1/price as a gesture of Goodwill. Shortly thereafter, the customer again brought the boat to our North Tonawanda facility with an issue with the outdrive. Upon close inspection of the lower unit and the propeller, it was apparent that the customer had struck bottom as evidenced by the marks and gouges in the propellerThis grounding caused destruction of the gears in the outdrive. The customer felt that it should be covered under a warranty even though there was no warranty on the vessel at the time of sale. In either event, a bottom strike or grounding is not a warranty issue, to the contrary, it would be handled through the customers insurance company.At this time, we can offer the customer assistance in filing a damage claim with his insurance company and provide a written estimate. Once the insurance company approves the claim, we will order and install a new drive unit

[To assist us in bringing this matter to a close, we would like to know your view on the matterthe dealer is saying I brought the boat to them a second time for an issue with the outdrive which is not true. We had brought the boat into their facility wondering why the motor would no longer turn over since it had quit while we were out on the water. As to their response that the outdrive was damaged due to a grounding is untrue the boat when it quit was out in a marked shipping channel which we had mentioned when dropping the boat off for them to find out the problem as it wouldn't start. The service technician called and told us that it ran fine but the issue was in the outdrive and gave me a price to repair it. Which at that point I had said I wanted to talk with the owner (who was not in at the time) so he suggested I call him which I had but after 2 weeks with no call back I went and picked the boat up since he obviously was not planning on calling back.
