I have reviewed the complaint filed by Mr. [redacted] and the associated paperwork that was referenced Inthe claim.Mr. [redacted] signed a boat consignment contract with this company on April 16,2016. In the contract, Mr. [redacted]AGREED to sell his 2007 21 foot Bayllner for a net amount of $ 15,000.00....

This amount Was subsequently amended byMr. [redacted], via email correspondence on July 8, August 10, and finally on August 16"*. The final email (August 16,2016)Indicated that he agreed to accept a NET amount of $ 10,000.00.The brokerage contract does not reflect any agreement for a brokerage commission of 10%, but rather, the contract justspecifies the amount the seller is willing to accept regardless of the actual sale amount.The confusion arises out of repair work and detailing that had to be performed on the boat prior to sale.Reviewing the electronic correspondence received from Mr. [redacted] and discussions with all the parties Involved, It Isapparent that Mr. [redacted] was confused as to the party responsible for these expenses.  Mr. [redacted] was under theImpression that he would accept $ 10,000.00 from the proceeds and this would cover the costs associated with therepairs and cleaning. This misunderstanding was presumably settled with the September 21" email from my office to Mr.[redacted] stating: "We would be happy to cleon/detail your boat for you as well as replace the distribution housing. I canarrange that with service, no problem, but I Just want to make sure you're aware that the cost to do the work will have tobe paid upfront. I cannot take the payment for the service out of the net gross of the toot..."The cost for the requested work was $ 897.20. This amount was paid by Mr. [redacted] as requested.— — We issued a corporate check to Mr. [redacted] in the amount of $ 10,000.00 as As was agreed upon In the contract thatwas signed and the subsequent electronic correspondence amending the original terms.Our company Is very dedicated to customer satisfaction. To that end, we would contemplate any reasonablesettlement that the customer would offer to help In correcting his misunderstanding.Please contact the undersigned with any further questions or concerns that you may have. If copies of theevidentiary documents that were discussed In this letter would help settle this matter, we will provide the same uponrequest.
