Response to ComplaintIncluded you will have original quote and drawings, not all items on quote were done.The step treads were to be similar to the steps in the subdivision green space (pictures attached)The cracking she refers to is the gap between the two step treads on each step, we had to redo the mortar several times because when we ask her to stay off the steps for two days she would call the next morning and say that they cracked when she walked on them, never allowing the mortar to set up.Natural stone will never be exactly even.If you will look at drawing there was not going to be a landing at the top but we added that and a step to allow her access to the drive wayThis was done at no extra charge.We also moved all of her existing stepping stone to her rear entrance door at no charge.The irrigation was never part of the original estimate There was no wall against the house only bricks covering the waterproofing that was above the patio height, this again done at no extra charge.As per drawing the steps were always going to be away from house.The patio went to as far as possible to the end of the house, photo included.There was no discussion about the use of pea gravel on the inside of the steps and at the bottom.We did install plants down the house side of steps and at bottom, again at no charge and they will return to life in the springWhen we realized the outside slope from the steps to the neighbor property we put down landscape cloth, large flat rocks and mulch, again at no charge.We feel that with all of the extras done at no charge that we have completed the projectI was unable to attach photos so am mailing them to you today.Thank you,Mike

The issue with the steps they installed as compared to the ones in the green space is that the ones they installed are cemented horizontally on the long side rather than vertically on the short side, and under the cemented areas it is not fully supported or supported across the front edge of the steps. I also never walk on the steps before I was told that I could. They were caution taped off. The last day they were there, I was told I could walk on them. Another gentleman was also at the house when we were told we could walk on them. He did not due to his weight, and that the cement where they filled spaces that had cracked was not completely set. I did not have stepping stones. One day I came home, and they had cut all the steps off about 10". It was those pieces that he put on the ground by the back door.  I still do not understand why they cut all the steps off.  The irrigation was already in place.  They dug it up and never replaced it.  Mike told me he was going to put it on the Other side of the steps since the change in the original plan that they made now had plants on the other side of the steps. I thought that space was originally going to be patio. The landing at the top of the steps was discussed from the beginning before they ever started. Rich and I had agreed that the steps needed to be connected to the driveway somehow so people didn't have to walk in the grass to get to the stairs if the steps were not going to meet the driveway.  The "extras" that he is referring to were done to have a finished look. I was told when they finished the space would be complete. The drawn plans were very vague. Rich stated that he purposely did that so that if we made changes, we would not have to go back to the HOA to get another approval. I trusted that e was going to do what we verbally discussed and agreed on when it came to the details.  Throughout the entire process he kept assuring me that it would be finished and look nice, and to trust him since he knew what I was expecting.  I will send additional pictures if needed of the pieces of the steps by the back door or the irrigation that they left in a pile on the ground if needed.  The rest of the pictures are attached in a google doc since the file was so large. Please let me know if you need any further information. [redacted]

The fact is that she got another quote from an other landscaper for $14,000.00. Rich my business partnerwho was a friend of [redacted], said exactly " I can build you a patio and pit you in some steps for $6,500.00.All this other detail about this area is that it was just pathway up a steep hill and now you can easily walk upand down. If you look at the approved ( by homeowners association) plans ( already provided ) it was simplysteps, therefore they were not different. Clearly she is making this up and misrepresenting the facts.   Again I might be repeating myself however it is an absolute certainty that Rich just said that we will build you some steps, all of the other comments are just not exactly the truth. the existing area you could not safely walkup and down and now you can easily.  In closing, we always try and make our customers happy. In this particular case for her $6,500.00 project weinvested $8,000.00 in materials and labor. I do not see how we can do anything more, she received more than she paid for and certainly way more than she was promised. Thank you,  Mike
