I really want everyone to know what we have been dealing with over the past week with a paving company, Smith and Sons located in Inwood, WV. I called them last Monday for an estimate of how we wanted our driveway done as they had great reviews and pictures of finished work. We ultimately decided to widen the left side over to meet the porch and bring it straight down to the culvert and then to widen the right side down to the fence and bring it down to the culvert. I firmly expressed that we did not want asphalt infront of the porch. Upon negotiation we settled on a great price, or so we thought. I was promised a contract before the job was started and on several occasions since. I did receive an email with a proposal and cost. Last Thursday our neighbor sent us a picture of what they were doing. I then called Carl, (my only point of contact) and asked if he widened the driveway to the porch and he stated he didn't but could come back for a price of $500. I said no and I'll see him at 6pm when he was for the second time to give me a contract. When I arrived home I noticed their one ton roller parked in the middle of the freshly paved driveway! We met and I explained that the work done was not acceptable and needed to be corrected. He told me that he spoke with his "dad" and I could pay $250 for the cost of the material. I then reinterated that I am not paying for a correction as he didn't perform the original agreed upon service and of he's not going to fix the mistake I wasn't paying him at all and I'll see him in small claims and I'm not binded to anything as I still have yet to get a contract. He then got nasty and said he'd come back Monday and correct it. He left the paver and roller on our property. Later that same evening we noticed that we were unable to close our gate due to the asphalt over running the fence line. I mentioned this to Carl via text and he stated he would correct that Monday. Over the weekend my other half and I marked what we wanted. Well, Monday came and went without any communication from Carl. Tuesday, my other half made a phone call to Carl twice with leaving one voicemail. A return call was made with an excuse of his grandmother was in an accident and he told his secretary to notify us. I then recieved a text apology with being told everything will be fixed that day. Again it was not. We met again at 6pm and again I explained what we wanted done to correct the original job and was told that today, Wednesday, they will be out between 8-830am. The solution to the gate was for him to lift the gate to where it will swing closed. Today, I received a text that he would be there in 45 minutes (9am). At 905am he arrived with a coworker who I spoke with. I showed and explained again what needed to be done and that they can not manipulate the gate as it will void our warranty by that installer. I was then told they'd be back in an hour with the asphalt. At 1010am the man I had spoke with and his two sons arrived. They did not cut away the sidewalk and still put asphalt infront of the porch like I stated I did not want several times and even with me standing right there he did it anyway!!!! Then he had the nerve to tell me "that's not what I was told" when I asked where's the saw to cut the sidewalk so he could make a straight line. I don't care what Carl said, I'm the customer and that's NOT what I said!!! I then waited over an hour for Carl to come back with a contract and he never showed. I sent a text at 1215pm that I had to go to work and couldn't wait any longer. And now at 648pm, I got a text that he'll bring it tomorrow. Their dump truck and other items are parked on private property in our neighborhood. I have pictures of the job and screenshots of communication.

From: Carl S <***@***.com>Date: Thu, Apr 2, 2020 at 11:46 AMSubject: Complaint ID,***To: ***@myRevdex.com.org <***@myRevdex.com.org> Dear ***,I am responding back to the letter I received.I will try to the best understanding possible,I got a call to come out and give her an estimate when I got there I told her what I would do and the price,she agreed and I did the work.When I got back to start the job her other half as she calls him was there he advised me not to take the asphalt to the porch so I didn’t.So when she came home she said it was supposed to go to the porch,I explained to her that her other half told me to do it,she said that figures he never does anything like I tell him to donut he always gets it the way he wants it,so that wasn’t my fault so she wanted it to the porch I went and got extra material to go father and never charged her for the extra material or the extra work.I never ask her for a deposit or for any money up front,so I had to go out of town for a few days and when I got back I was going over to speak with her about any concerns she had but instead she blasted me out on social media, told me and my crew not to step a foot back on her property,so we texted back n forth trying to get her satisfied,She also stated on social media you are a gypsy you’re this and that,now mind you she said in her complaint that I have good reviews and pictures of work I have done,but any way she demanded $3000 refunded back to her plus $100 for her missing work.This is a racist woman she liked my work but thought she could get her money back.So I am leaving this up to you to decide what I should do and I will comply to the best of my ability.I have send an attachment of her first text after the job was completed.Thank you for your patience.

From: Carl S <***@***.com>Date: Sun, Apr 19, 2020 at 2:23 PMSubject: Complaint # ***To: ***@myRevdex.com.org <***@myRevdex.com.org>Dear ***:I am responding to your letter of complaint mailed on April 15 2020.I’m not for sure if *** revived my last letter I sent through email,but I agreed to do whatever she thought was fair,In the first complaint *** was seeking $1500.00 I noticed in this complaint she is wanting a full refund,*** husband,friend or whatever is the one that gave me the ok to do the work he told me where he wanted asphalt laid and where he didn’t,when I had completed the work that’s when she said oh it’s not where I wanted it referring to the guy I talked to she said he never does what I tell him to do.So I added on and done what she wanted and I didn’t charge her for the extra material or labor,at this point she was satisfied.Concerning the gate she told me it would void her warranty with that company if I was to fix it,so I didn’t,I try to accept the fact that the customer is always right but this lady is something else. I will refund her $1500.00 just for principal I don’t feel I owe her anything.So this is my side of the story and thank you for your patience.Thank you,Smith and Sons Paving

I have reviewed the response made by the business in reference to complaint ID, and find that this resolution is satisfactory to me.

However, I believe this company should uphold their signed refund sent to me in email with Carl's signature as attached in this email and previous for a total of $3,100.00 (which is exactly what we paid). In addition, keep in mind this company does not hold a WV business license and/or a WV contractors license. With this being said, since I was charged and paid over $2,500.00, as per state law states, this is a crime. Had I have been issued a contract as promised and requested on several occasions I would've known this company was not legitimate and would have ceased all work to be completed.

I contracted with Smith & Son's Asphalt Paving to pave my driveway. I was told it would be 4 inches thick which would compact to 3 inches. It is at most 2 inches thick and has already started breaking apart. The area where the driveway meets the road was an issue from the very beginning and they promised to return to fix it before the cold weather started. The area by the garage is so thin weeds were growing through. They promised to return to fix this area as well. At this point they have promised to come 11/4/2019, 11/6/2019, early December, early the second week of December, early in the new year... each text promises they will show up and then they do not - with no communication as to what is going on. Yesterday they said they would be here and then at 3pm they said they would bring their equipment before the end of the day. That was just another lie. We are tired of them lying to us about honoring their commitment to make the driveway as originally contracted. I have the text messages screenshotted so I can provide it upon request.

I have looked this company up and the phone number listed on the website is not in order. The number listed on this complaint is Carl S's - the owner.
