August 14, 2015. Enclosed you will find a copy of the bill of sale. Purchase price of the vehicle was $10,995.00. Total cost with license, warranty and GAP insurance was $14,191.30. Mrs. [redacted] did call right away with the problem. When this happens we do not turn it into the warranty company. This is something that should have been fixed before they bought their car. We did take care of all cost for the repairs. Enclosed are the work orders and part slips of the work that was performed on their vehicle. As far as call backs, our mechanic said he called and left a message saying that the vehicle was done. I cannot say for sure that he did. We were not able to provide a loaner car due to not having one available. In closing, we do try to make ALL of our customers happy. We are not sending her a bill because we did say that we would take care of all expenses. It appears that we haven't done enough for them. Some people only see the bad point and nothing else. Review: We purchased a vehicle in August 2015. We have had this vehicle to their shop 2 times now. 1st visit was due to two days after purchase, traction control and Awd was not working, fuel gauge read incorrectly, turn signals wouldn't turn off, the exhaust had a leak, and there was shaking in the front. All was fixed except for the fuel gauge cluster. They ordered the wrong part. We never received a call when this work was done. It took us to call, saying that it had been ready. No one gave courtesy call to us about wrong part. We were told they would call us when part was in, they were estimating Wednesday the following week. We called that thursday, not in. We called following Monday, Cheryl apologized for the delay. We scheduled for the following week on Wednesday 9/23. Derek dropped it off Tuesday. The Derek explained that there is no hot air blowing. The mechanic said he would replace it to ensure it wasn't the heater core. I heard nothing until I called Thursday around 2pm. They said the vehicle was already done and ready. Derek picked it up Friday before 3pm. On his way home he tested the heater. It was still not blowing hot air. I called smiths auto, Brooke said she would call me back. 1 hour 45 minutes later, I called her at 4:15 pm. She explained that the mechanic said it was working fine. Our service slip says "Test drive. Everything working properly". However Brooke said that the fuel light was on and they couldn't let it run long long enough. We should have been contacted then to see that problem through to ensure the problem was fixed. I asked Brooke what we could do to fix it before I return to work monday. I would be down a vehicle. No offering of a different car. She suggested I could go to a different shop. We said good bye. I decided to call back, a man answered the phone (they never tell you who you are speaking with), I asked him for the boss or whomever is in charge. He prompted with a "hold on I can't hear you" and put me on hold. I hung up after waiting for 5 minutes. I didn't call back, I don't like to feel intimidated nor should any customer feel disrespected. I am humble that they were repairing mishaps with our vehicle free of charge due to being newly purchased. But we don't deserve the hassle. We will be taking to a different shop. I was worried about a warranty conflict. So I called our warranty. There was no records that they ever put any of the work thru as a claim... I sure hope they don't send a bill to us being Cheryl said she would take care of us! I feel this business doesn't fully inspect a pre owned vehicle before allowing customers to make a purchase. I feel let down from Cheryl making me feel at ease of fixing the vehicles issues and the employees lack of respect towards customer care.Desired Settlement: Being that none of the repairs went to warranty claim, I wish this business does not try to send us a bill after this dispute. Being we were told that they would take care of this at no cost since we just purchased the vehicle.

Review: We purchased a 2004 Nissan Xterra on or about 1/28/2014 and about 60 days later we had to take it into Smiths due to stalling when it stopped and just not running correctly we were told it was a part not covered under the warranty. Then about a month later our transmission started slipping to find it was out of fluid took it to our mechanic had some repair done with what we thought was just a general problem turns out 3 mechanical visits later it was a major problem. Informed Smiths auto they told us it was not covered under the warranty. We have dealt with the vehicle leaking until it became a major issue. Then we had Smiths repair the problem and many other issues. They charged us 360.00 for the "repairs" to find approximately 2 days later our transmission is still leaking, engine light returned back on, ABS still not working properly, it has so many problems that I cannot fathom why they would sell us this vehicle. I in turn sent them a message that I was not covering the check due to the fact that they did no repairs they kept our vehicle for 2 weeks we lost work we struggled due to their incompetence. I believe they lied to us charged us and did no work we intend on having our vehicle fixed and planning on filing a lawsuit. They scammed us when they sold us a vehicle knowing it leaked transmission fluid and had major defects then refused to repair it when we complained until it was no longer covered then charged us for work that was never done.Desired Settlement: We want our vehicle fixed we want a reliable car that we were promised I want Smiths Auto to loose their business license I want our lost wages my bank account refunded they scammed us frankly I believe they willingly broke the law.

When [redacted] and his wife purchased this vehicle, he did sign a Warranty Addendum Agreement (see attached). As far as our records indicate, the only time [redacted] has his xterra back to us for work was on December 16th, 2014. The warrant company covered ABS wheel sensor, sway bar links, right front wheel bearing, and a CV axle. We did not charge him the $100 deductible on this repair. Mr. [redacted] did have to pay for six spark plugs, knock sensor, intake gaskets, transmission kit, and four quarts of transmission fluid. We went to his house, and loaded his Nissan on our tilt bed and hauled it to our shop. Total bill for this was $361.80. When Mr. [redacted] came to pick up his vehicle he was happy with the bill and asked for us to hold the check until December 18th, 2014. This was agreed upon on December 17th, 2014. We deposited the check on December 19th, 2014. On December 20th, we checked our [redacted] message, and his wife had said she was going to stop payment on the check. It had already gone to the bank, but when the bank returned the check the check it was for insufficient funds. Receipts are in the enclosed. In closing, we do try to make ALL of our customers happy. From January 2014 to December 2014, the [redacted]'s put over 14,000 miles on their 2004 Nissan Xterra. His wife has written terrible things about Smith's Auto Sales trying to hurt our business. Review: Purchased a 2004 F-150 on 11-12-13. Drove truck approx. 15 miles & #7 spark plug broke along with coil pack. Returned to dealer, got a loaner, they had truck for 16 days They relaced all 8 plugs. Since then the truck has been in repair shop more than 60 days. We have had to replace the #1 fuel injector, a sensor, a fuel rail, ALL 8 plugs & coil packs, the right side catalytic converter, (smith's paid $775 toward that), right rear axle seal & both leaf springs, (smith's paid $100 toward these repairs, which were over $500), also replaced the muffler, which the seam split on. We had to replace the resistor for the heater. The A/C does not work. The engine is now being tore down, the truck misses, backfires, & oil pressure drops. [redacted], our salesman, told us about this great truck which was formerly his brothers. The warranty he ([redacted]) said we were required to buy is also worthless when it comes to the engine. We have only put 3000 miles on truck since the purchase date and approx 200 of them have been put on by the repair garage. We are well within the 24 month/24,000 miles. I am now responsible for all costs involved in engine teardown & may be receiving a used, smaller engine. I am very upset that I was sold a vehicle in such terrible condiition mechanically. Smith's told us they went over it with a fine tooth comb. I feel as if I have been lied to and taken for a ride witth this truck.Desired Settlement: I would like to be refunded any/all out of pocket expenses incurred to have this truck fixed correctly.

To Whom It May Concern:

This letter is in reference to ID # [redacted]. When the vehicle was brought back on the day of purchase for mechanical problems, it was offered to the customer that we would buy the truck back. The customers refused and stated that they wanted to keep the truck. They were then provided with a loaner vehicle free of charge from our lot. Repairs were made to their vehicle at that time with no cost to them. Then, on 2/18/14, Mrs. [redacted] called and was very upset stating that other repairs were needed to be done. She was asked what would take to make her happy and she stated that she wanted $775.00 to cover the cost and a check was sent to her in that amount. The copy of that check is enclosed. Then again she called and was upset about another repair that needed done. She was becoming increasingly difficult to please at this time. At the time of purchase the customers purchased a warranty and also signed a warranty addendum which states that they are responsible for any repairs not covered by the warranty. Both the warranty and the addendum are attached. We have tried to make this customer happy and went well beyond what we needed to do.
