The attached letter is our response to the complaint which has also been sent to the complainant.Smithy's Plumbing Company Thursday, June 15, [redacted] ***Cincinnati, Ohio 45212###-###-#### In response and regard to the complaint from [redacted] and [redacted] .Mrand Mrs [redacted] contacted our company on February 17, to inspect an issue with thier upstairs toiletUpon inspection the plumber on site, Al, recommended that the toilet be replacedMrSmith sugggested that they purchase an "American Standard" or "Kohler" brand toilet that he would pick up from our preffered plumbing supplier [redacted] Plumbing Supplies.At this point Mrs [redacted] insisted that they wanted a "Toto" Brand toilet and had a specific model picked out which she said her son in New York recommendedShe also insisted that we purchase the toilet from [redacted] ***This was the first and very last time we have ever made a special order with this companyThe specific toilet she had requested is not sold in our area stores so it had to be special orderedWe went against company policy when purchasing this toilet due to this very situationNormally when an appliance is specially requested we require the customer to order and supply the productDue to the customers request that it would be difficult for them to retrieve the toilet we agreed to pick it up for the [redacted] s.When the toilet finally arrived at [redacted] we picked it up and installed it the same day, which was Thursday March 2, It wasn't until Sunday afternoon March 5, that Mrs [redacted] called complaining that the toilet had started leaking that morning and needed attentionWhen MrSmith arrived, shortly after recieving Mrs [redacted] s call he noticed that the back corner of the bowl had snapped completely offWhen asked Mrs [redacted] replied she had leaned back against the tank while using it, as she does to sll her toilets, just before the leak began.The [redacted] s were informed they needed a new toiletMrSmith told the [redacted] s that the toilet did not malfunction, it had been broken due to misuse but our company would attempt to contact the manufactuer and the [redacted] it was purchased at and try to get the money refundedThen agreed to purchase the toilet he originally recommended and install it for themThe [redacted] s also requested that we hold the broken toilet while we tried to contact the companies.MrSmith then went to [redacted] Plumbing Supply and purchased an "American Standard" toilet to installWe also gave the [redacted] s a $credit on the labor for the second toilet installed and material usedFurthermore, the customer was not charged for the water restoration in the first floor bathroomAlfter the toilet was installed our company immediatly attempted to contact the two above mentioned companies"Toto" replied after requesting pictures of the broken product that the misuse did not hold up the warrenty [redacted] gave us the run around for weeks calling manager after manager and getting the same response, that they could not refund the money.After almost two months of getting nowhere we informed Mrs [redacted] that we had no luck and she was also very welcome to try as wellWe informed Mrs [redacted] that we no longer had time or space to deal with or keep her broken toilet in our warehouse Almost a month later she says she has talked to specific mangagersWe called them and they had no recollection of speaking to the customerFinally, she calls for the last time and speaks to *** Who then says that if the toilet was covered under warranty he would replace it if we could bring the toilet in.Unfortunatly, we are a small company so the toilet was then gone and Mrs [redacted] was aware of this factWe do gaurauntee our work and any product that we recommend to our customersWe sincerely apologize that this was not the case in this customer's situationMrs [redacted] was never told we could get her a refund for the toilet she brokeThe two checks she wrote in March were on the days the work was completedThe pick up reciept also shows the order date and pick up dateShowing that Mrs [redacted] is a bit confused in her dates and facts.This complaint is innacurate in the facts and offensiveIt is very unfortunate that the [redacted] s were hoping we would pay for the toilet they broke but this is just not possible due to the fact we recommended against this particular brand toilet.Thank you for your concerns and have a wonderful daySincerely, Smithy's Plumbing Company

The hole in the pipe was not there before smithy plumbing was there The picture taken was taken after the hole was seen The plumber didn't refuse service, he just left Other plumbers told me that smithy's plumbing was in the wrong for the poor service they provided

MrSmith's response was not accurateThe toilet he installed was either defective or he did not install it properlyIn any case, the toilet cracked in half shortly after he installed itSince it flooded my bathroom and my downstairs bathroom as well, I immediately called MrSmith and he returned that same day Two days later, he removed the broken toilet with the express understanding that he would return it to *** *** and try to get a refundHe never returned the toilet to *** ***Instead, he threw it away and blamed the manufacturer and *** *** *** has a day return policyThey would have provided a refund if MrSmith had actually brought back the broken toiletThere is no way humanly possible for this new toilet to have broken in half unless it was defective or improperly installedMr.Smith has not been honest with usWe never authorized him to throw away the toiletInstead , he kept giving me excuses for not getting our refundI would never recommend MrSmith as he DOES NOT STAND BEHIND HIS WORK

Plumber notice several things wrong with kitchen sink ( ks ) plumbing while starting diagnosis on ks drainage clog) P-trap w/ wrong slope ) stainless steel bowl underneath ks ,cabinet bottom severely damaged from water , and water present in bowl and on bottom of cabinet) water
dripping off ks branch interval Plumber addressed concerns w/ Mrand Mrs*** Both Customers stated she originally installed continuous ks waste & he used a drain flusher in attempts to remove the clogI was directed to just auger ks DWV line Plumber took a picture Plumber augered one time for fifteen footRetrieved cable, corrected p-trap, and started to perform testingPlumber immediately notice water shooting from ks branch interval barely making the bowlPlumber informed customers of the leak and it will need to be corrected before proceeding any furtherPlumber gave a bidPlumber was accused of damaging the systemPlumber showed the picture he had taken and tried to explained he did not damage the systemPicture shows paint that has wore away & a reddish-yellowish brown flaky coating of iron oxide that has formed on the steel by oxidation which formed a pen size hole behind the hub of the teeThe situation wasn't resolving and the plumber asked to be paidPlumber collected a check & informed the customers that Smithy's Plumbing no longer wanted to provide servicesNO employee of Smithy's Plumbing Company will not work under such venomous, vicious , bitter, unkind , & rancorous conditionsCheck bounced on 10-18-Smithy's Plumbing will pursue the matter in small claims
