I have a signed contract (by *** owner of SMITTCON) dated November 3rd, 2016 to build a "New Carport Approx. 24' x 12' at a total cost of $20,155.00 plus HST. The Contract covered SmittCon supplying material and labour for 18 Installations of which only 10 have been completed as at June 16/17. On that date a third payment was made to *** for a total of $18,220.13. Since that date after several phone calls on which messages were left as well as emails to ***, we have not seen or heard back from Mr.. We were not alarmed at first as some of his equipment and tools are still on our property.
I am arranging with individual tradesmen to complete the unfinished portions of this job. It appears the contractor in question has disappeared and has sold his house at ***. I am not counting on *** finishing this job, but would not mind the return of some of the money he was paid for portions not completed.
Finish the job We would like the final 10 installations and products supplied as contracted. In addition to the contractual obligation his team created a hole in our dining room wall which *** said "he would see that it was fixed". The last I saw of *** or his staff was late June when he showed a building inspector the hole and reason for the hole in our dining room wall.
I was in touch via email a number of times prior to client going away , I also made 4-5 attempts to call her cell well she was away. Client has been away the whole month of July with no way to contact her. I have also just returned from being away .I have ever intention of completing project.There have been other issuses with slow progress payments based on terms of contract otherwise project may have been completed prior to her going away
