I reviewed the response made by the business in reference to complaint ID [redacted], and find the resolution is satisfactory with the fact that is all he would agree to.

We have the full correspondence back and forth (attached).  This very clearly shows that the story that Scenic Seitz fabricated is not true.  The trees died because they were larger trees and planted in mid July by the time they got out here to plant them.  Knowing this was terrible timing, the trees were very heavily watered.  twice per day with sprinklers and twice per day with a hose for suitable soaking.  As soon as it was noticed leaves started shriveling, we contacted them multiple times.  Our investment in making them succeed was apparent.  It was clear we were concerned and doing everything possible.  We live in a new build house and have many newly planted trees and shrubs so we know how to water appropriately.  Here is where Cory begins to falsify information. there was no inspections.  We were never contacted to say they were coming out.  They never contacted us and said they came out.  On 8/7, we confirmed they were dead and Cory suggested they could be in shock and come back.  There also was no phone conversation in 2015 advising the warranty would not be issued.  In March 2016, we advised they did not bud and we would like them replaced. On 3/18/16, Cory confirmed and said they hadn't hit planting season.  4/2/16, Cory advised the weather was too unstable.  4/29/16, too early for maples according to Cory.  If he advised our warranty would not be honored due to lack of watering, why hasn't this been mentioned during scheduling?  5/13/16  cory again confirmed weather has delayed them and he didn't know when he could replace them.  5/16/16, Cory couldn't confirm when they would be planted.   I then got Cory's number because my husband felt he was not providing enough information.  During the conversation, Cory offered to refund our warranty.  we were done dealing with him.  Proof of this is also in the correspondence.   6/6/16, I asked when the refund check would be coming.  Cory replied 6/7/16 advising he was checking with his supplier. Obviously none of this correspondence would occur if he in fact turned down our warranty a year earlier.  It seems he delayed the replanting so long his warranty expired and he is trying to skip out on ours.  The check never came.  Summer had come and another planting season gone.  We told him in frustration just plant them in October to which Cory replied again confirming his estimation on when they would plant them in the fall.  He confirmed this on 6/13/16.  Then when we followed up this fall, we received no reply.  Never is their correspondence or indication of a warranty issue.  Now he is trying to go back and make up inspections that never happened and accusations from over a year ago.  At this point, we don't want the trees as we do not want to work with this company in any way.  We only want our full refund since we never received the warranty we paid for. It is clear from the correspondence that they intended to replant them and clear they intended to give us our refund.  Now they won't give either because they never acted fast enough on their own warranty and we've lost another planting season.

Your order has been refunded, sorry for the inconvenience. In the future please consider a request on order for a delivery day of Wednesday on the same week as the order is just not possible during busy rushes...have a great week and good luck! Thanks

Mr. [redacted] called late summer 2015 (which was odd as it was the first time we ever spoke- all prior communications were with [redacted]), he was irate and upset that the trees were dead and I explained that they were not being replaced under our warranty. I explained the warranty process....

He was less then receptive and yelled and was condescending and rude. I explained that we are not responsible for loss of trees when lack of water is the obvious reason for the loss. The trees exhibited numerous signs of death due to lack of water. Trees which die so quickly in summer when it is hot its obvious water is the issue.I explained I would look into replacement through supplier but that was unlikely when trees lacked water and were loss during such a short window of time- (also signs of dehydration die off)The trees died during a dry late summer season due to non watering regularly. They were Sugar Maples which are native Ohio trees and simple to transplant with high success rate unless they don't get watered. The initial response from the client about watering was that "the sprinkler runs twice a day and when my husband has time he waters with a hose" which quite frankly that statement there says it all.  When having new large trees planted you must make time for watering 2x a day. These trees got cared for with multiple daily waterings prior to planting at the [redacted] residence. they were not stressed and in beautiful condition (in fact we refused first trees offered by dealer and opted for better specimens with matching shapes) These trees were not getting cared for as required by the customer in the warranty. A twice day sprinkling from lawn sprinklers will not soak the ground as I explained numerous times the trees were needing daily heavy soak waterings due to the time of year and heat. Immediately when contacted I addressed the watering concerns as it was hot during late summer. It should be noted that at each time the tree was inspected after planting the location and areas around showed zero signs of watering. Upon being notified of the issue we checked on the trees 4 different times. each time it was completely dry and no signs of watering recently had occurred.I explained that watering a light top watering will literally do very little for the trees. they needed heavy soaking waterings 2 x a day (via Facebook). The trees did not receive this. If it shocks and dies immediately after planting it is watering thats the culprit. The trees will make it longer before fade out if its another health issue with the trees like disease or bad trees. The trees arrived perfect and healthy and in good shape. Within a month the customers lack of watering created die off. We had a hot and dry summer in 2015.The client is responsible for the watering of the trees as outlined per warranty.These trees showed obvious signs of dry out and death by dehydration. We cannot warranty them for this reason.Obviously this is not the desired outcome in any planting and we are sorry it worked out this way, however we cant be responsible for trees lost due to lack of hydration. Regular watering is critical to any transplant success. Scenic Seitz is not responsible for the watering process the customer is. Scenic Seitz takes pride in all of our work and this planting was no different. In fact we went out of our way to try and get these trees warranted.Its not possible when they were not watered.We are forced to refuse this warranty due to lack of care of the trees on the property owners part.We hope you find better success in your next attempt planting.

As agreed with the client we have refunded the $36 for the entire cost of the kindling. It shows payment complete on mysystemit can sometimes take a couple days toshow on their accountthanks again
