Review: I called Smolich & Smolich per their television ad that stated they will help you if your disability claim is denied, and also states they will help with filling an appeal. I called Smolich & Smolich on August 8th for assistance with my denied disability claim; gave general information they requested from me and on August 12th. I received a letter stating that they would not be able to represent me with my claim. In the letter they sent me it does not state as to why they would not take my case, they even state in the letter sent to me...and I quote, "Please understand that we have not investigated your case and are expressing no opinions as to its merits or the likelihood you will prevail." I don't understand how they made this decision without investigating my case or getting more information about my medical history.Smolich & Smolich did not even have the decency to explain why they would not take my case and when I called to speak with them they would not give me a legitimate reason that made since. Smolich & Smolich TV ad is misleading or should I say a RIGHT OUT LIE!Desired Settlement: I would like to find out from Smolich & Smolich why they did not want to take my case and why does their TV ad state they will take your disability claim if you are denied. I did not see any fine print on their commercial that states they will not even take the time to speak with a client or look at their medical history for further information.

Most of our Social Security Disability practice revolves around people that have had a long work physical history, are over 50 years old, and have suffered serious medical conditions (such as career-ending orthopedic injuries). For individuals that are under 50 yrs old, Social Security rules and regulations are quite strict. In order for an individual under 50 yrs old to be awarded disability benefits, they must general have strong medical evidence and doctor support which shows that they are unable to work in any capacity on a full-time basis in the national economy. Based on the information you provided to our office over the phone, we are unable to accept your case. We recommend that you contact another attorney who may be able to assist you with your specific situation.

Smolich and Smolich ask me only general questions,

such as the type of illness I have, my name and my dob. The

representative never requested any of my medical records or even ask how long I

have had my illness, so, how would Smolich and Smolich know just how strong my case would have been. Smolich never even extended the courteousness of having a lawyer or SSDI specialist call me to discuss my claim of disability. And the letter they sent me did not state any of the information that was forwarded to the Revdex.com.

The matter of the fact is...Smolich and Smolich television ad is MISLEADING and down right UNTRUE!! They don't even put in small writing that they may not take you case because of XY or Z.

This letter is in response to the complaint filed by Ms. [redacted] in regards to her Social Security Disability claim. Please note that an electronic response was previously filed by the Social Security Disability claim. Please note that an electronic response was previously filed by the undersigned on the Revdex.com website on September 11, 2014. A copy of the response page is attached hereto.

By way of background, please note that on August 11, 2014, Ms. [redacted] contacted our office by telephone regarding her disability claim after having seen our television commercial. During the call, our intake coordinator obtained some general information about Ms. [redacted]'s case and, after review of this information by an attorney, a letter was sent to Ms. [redacted] informing her that our office would not be able to take her on as a client. In our letter, we informed Ms. [redacted] that although we had not fully investigated her case, we suggested she contact another attorney regarding representation of her disability claim.

In our online response to Ms. [redacted]'s complaint, the undersigned explained that our office is unable to accept every case it encounters. There are strict Social Security rules and laws regarding providing disability for individuals who are under 50 years of age. Our typical clientele comprise of individuals who are over 50 years of age, have had a physical work history, and have suffered from serious orthopedic medical conditions. Unfortunately, based on Ms. [redacted]'s age, education and/or past work history, we did not find Ms. [redacted] to be an ideal candidate for legal representation. Therefore, a letter was sent to hear advising her of our decision.

Our firm receives hundreds of inquiries each month from potential Social Security Disability clients. Although we would like to help most of the potential clients we encounter, we are unable to accept every case that may have a potential of winning.
