After a heavy thunderstorm went through our area on the afternoon of July 14th 2015 our office started to receive calls from tenants about water coming into their basements and apartments. We received a call from one of the tenants at [redacted] that water was coming into her apartment. We immediately called Country Fresh Carpet Cleaning who said they were in the middle of a job and as soon as they were finished they would head over to the apartments and see what could be done. By that time we had fielded several other calls and talked with the owner who was aware of the situation. Our maintenance person was contacted to go over and help out in any way possible.
The tenant [redacted] did come into our office sometime before 5:00 pm. She said her apartment had flooded and she just moved in and was very upset. We explained that we were aware of the situation and someone was already over there working on getting the water out. We told her if she decided she did not want to continue living there, since she just moved in, we could give her the security deposit back and put her in something else. She took a list of available rentals with her and left.
We received a call from the carpet company later that evening saying it had begun to rain again and he could not keep up. He said there was just so much rain coming down the drains could not keep up and he was fighting a losing battle. He said the best thing would be to just wait till the rain completely passed and then pick up in the morning.
It was during this time that our maintenance person smelled something burning in the hallway outside apartment #[redacted]. He went to investigate and noticed one of the baseboard heaters in the hallway arched. The tenant in #[redacted] and her family were trying to move all of her belongings out during this time. The maintenance person told Ms. [redacted]'s family that it was not safe to be in the unit at that time and to stay out. He then contacted the Wooster Fire Department.
After checking the hallway and units they found no indication of fire. AEP was called out by the Fire Department to make sure there were no other electrical issues. We contacted our electrical company Water-Watts at the same time the Fire Department was called to check on the heater in the hallway outside unit #[redacted]. The all clear was given to us by the Wooster FD and AEP.
We told anyone that was there affected by the water that we would put them in a hotel for the night. When we went to talk with [redacted] her stepmom and father became very hostile.
They said she was now homeless and all her possessions were ruined. They wanted all
her money returned and all her items paid for. We proceeded to tell them that we would be
happy to return her security deposit in full, along with her first months and let her out of her 12-month rental contract. However, we told her we do not cover anything inside the unit that would be covered by her renter's insurance. We also offered to put her in a hotel for the night and move her to a different rental unit. She did want to stay in the hotel and wanted the rent and deposit back. However, she said she did not want to move into anything else we had.
After we made sure all those who needed to go to hotels were set up we left for the
night. The next day July 15th 2015 Ms. [redacted] returned the keys for her apartment to our office and picked up her check for security deposit and rent. She did not mention anything else to our office staff about finding another place to live. We have not heard anything from [redacted] or her family since then.

Smucker reality stated that they offered me a different apartment to live in however the apartment they offered me was " trashed from the previous tenant and not available at this time" and the price of the apartment was more than what I was already paying per the Smucker reality manager.
Also Smucker reality stated for me to turn in my damaged and ruined belongings to my insurance however rental insurance does not cover flood and it is not a insurance claim that " the drains cannot keep up" per Smucker realitys response.
Prior to the employees of Smucker reality leaving the apartment the night of the flood they wrote a note out stating that they would speak to the owner of the building and see if he would cover some of my damages. I have not heard back from Smucker reality with a response. They state they have not heard from myself or my family this is because I decided to take a more legal approach with the Revdex.com. I can provide a copy of this signed letter. I can also provide a copy of the fire department report stating the dangers of this apartment building. I can also provide pictures of damaged items not covered by rental insurance. I feel Smucker reality has not even spoke to the owner of this building to discuss paying for some of my damages and would still like compensation.
