To Whom It May Concern: Here at *** Poway we strive to provide an enjoyable living experience for all of our residents. We deeply apologize that we have not been able to exceed these expectations with Ms ***At the resident’s initial visit to the property a tour of our one bedroom floor
plan was provided since a two bedroom floor plan was not available to show at the time of their visit The two bedroom floor plan was discussed in detail and no such promise of a walk in closet was made. Floor plans were shown to the residents both online and in the office Also, no verbal or written promise was ever made to the resident they were first to reside in this apartment home nor did we infer the apartment homes were brand newOn all occasions maintenance responded and addressed all necessary repairs in a timely manner regarding the resident’s maintenance concerns. Additionally, in an effort to continue to upgrade our community we have recently upgraded all windows to dual pane windows. Unfortunately, the window install was scheduled after the resident had already moved in. However, proper notice was given in advance to the resident when entry was requiredLastly, the resident was informed both at the time of their initial tour and at the time of applying for the apartment home that they would be required to pay a security deposit of $400, as well as, a pet deposit of $500. Shortly after the resident moved in management found an accounting error on the residents account. Unfortunately, both the security deposit and pet deposit were not initially charged to the residents account prior to the resident paying their November rent. Therefore, the resident used the credit on their account towards their November rent. As of today’s date both parties have mutually agreed upon a payment installment plan to pay the balance owed by the resident in the amount of $828.00.Sincerely, *** ***Property Manager

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Now Miss [redacted] claims that we were not charged fully for our original deposit, and that is what accounts for the defaulted $828. Again, we were charged and paid a full $3,054 deposit (Pet fees included) without any argument. It was later that her incompetent staff contacted us and said their office had been in error and we were overcharged, that they would prorate the overage, etc. It is not my job as a tenant to do her staff's job and crunch those numbers for her. Then after this dispute arose, she decided that we had DEFAULTED on rent that we paid in the amount requested of us. She is constantly changing her claims on what is owed and why it is owed to fit her needs and cover her mistakes, rather than take accountability and fire the employee responsible. I cannot be bullied by these criminals any longer. Within a week of returning "home" with my newborn son, her office issued a 3 day eviction notice, which one of her employees explained to me was a scare tactic so I wouldn't follow through with my complaint. As for the verbal or written agreement to the floor plan. That is an outright lie. The words "completely remodeled", "brand new to you", "new carpets/new hardwood" and "walk in closet" were used [redacted] by [redacted] (the very same employee responsible for the accounting error that my family is being punished for)[redacted] Poway has certainly taught me to get absolutely everything in writing because these people are evil.Yes, maintenance does respond. And they are here responding to something at least once a week due to the cheap and shoddy craftsmanship they try to claim is a market value of $2,000 a month. I've lived here since September and still haven't taken a hot shower. Apparently it is my responsibility to choose if I should do dishes, bathe my son or shower? Prioritize, if you will. I agreed to pay the $828 only because [redacted] bullied us into it with the threat of eviction. I will pay it to provide for my family, but she her staff and their product have been a complete nightmare. It is not okay to treat people the way they do, and I will not withdraw my complaint nor will I stop complaining at any and every platform available in the hopes of saving anyone else the experience with [redacted] Poway.
