Dixie Chopper is more than willing to assist in getting to a resolution between Ms [redacted] and [redacted] ( Independent Dixie Chopper dealer) however Ms [redacted] made the business transaction with *** [redacted] so any refund or return would need to be facilitated between the dealer and the customerDixie Chopper understands that the independent Dixie Chopper dealer has made offers to the customer which they have refused being a upgraded replacement or selling the unit for the customer through their store frontAgain Dixie Chopper is willing to participate in a resolution that the customer and dealership can work out

Revdex.com:I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that the response would not resolve my complaint For your reference, details of the offer I reviewed appear below.Regards, [redacted] I am not satisfied at all with Dixie Chopper's response I went back to the dealer, Joe [redacted] , the day after I purchased the mower to do some tree work for him I told him then that the machine didn't handle like a new machine My mother drove it while she was in town and said that it does not handle smooth and she has used these for years The main comparison on the machine though, is the fact that I went to another Dixie Chopper dealer and drove a brand new model, just like mine, and it operated completely different....not based at all on what my mother thought when she drove this one No one ever told Joe that this machine is being compared to my mothers Joe [redacted] is trying to downplay the fact that this machine does not run properly Joe [redacted] never told me to return my mower to him for repairs He told me to just contact Dixie Chopper and that they can handle it The company, Dixie Chopper, says that they don't have any record of phone messages For a company selling very expensive products, it's hard to believe that you can't get a call or email back from them That is very poor service and to say that the email went to an idle account is unacceptable I tried to get this issue resolved with Joe [redacted] and Dixie Chopper since the day after I purchased it It's interesting that I couldn't talk to a person within the company when this issue first started Joe [redacted] knowingly sold me a lemon....a machine that he had been taking parts off of to put onto others(told to me by him) Obviously there is a warranty on this mower, but I shouldn't have to be having repairs done on what was sold as a brand new machine Joe [redacted] told me that I had days to return the mower I tried talking to him about returning it since the day after I bought it Like I said, I was told to contact Dixie Chopper, who never bothered to get back to me I want Joe [redacted] to honor what he told me from the beginning, that I could return it within days(which I tried to do, repeatedly) I have now made payments on this mower that I am completely dissatisfied with and am just now getting a response from them and only because I took it to the Revdex.com

Dixie Chopper has made arrangements with Mr [redacted] to resolve his issue with the seat on his Dixie Chopper machineMr [redacted] was contacted by our Territory Manager and has agreed to accept a seat provided to him via the Territory Manager

Dixie Chopper has reached out to Mr [redacted] and his local Dixie Chopper dealer after being contacted directly via emailNot receiving a return call from Mr [redacted] , Dixie Chopper has discussed with the local dealer how to address the current issue as well as reimburse the expense of the repair parts for the last repair for a cylinder head which should have been covered by the warranty of the machineDixie Chopper will continue to warrant failures as per our warranty policy within the term of the warranty Dixie Chopper will assure Mr [redacted] that if a subsequent failure occurs of the engine, Dixie Chopper will replace the Generac engine with a 36hp Vanguard at no expense to Mr [redacted] which will include a year Parts and Labor warranty of the engine from installation date to be administered by the engine Manufacturer

Dixie Chopper has reached out to Mr [redacted] and has agreed to make arrangements next week upon his return from vacation to evaluate his concerns and issues at his location and create an action plan to resolve his concerns

Dixie Chopper will agree to supply to the local dealer a Zee quiclk lift kit(P/N 902935) for Mr***Mr [redacted] will need to make contact with his local dealer [redacted] Tractor & Trailer to make arrangements to have the kit installedI estimate that the dealership will receive the kit early next week

Dixie Chopper did experience a delay in receiving Mr [redacted] s partshowever we have received the required parts and shipped them to the dealerHe have indeed setup minimum safety stocks for our service parts to ensure this does not happen again

Territory Manager has made contact with Mr [redacted] and the independent Dixie Chopper dealerHe has made arrangements with him to meet and address the steering issue he has described

Dixie Chopper has reached out to Mr*** On Wednesday March 16th as well as Today March 29th asking for a return call to Wes *** Director of Customer Care at either 765-246-Ext *** or Cell 765-*** he may also contact myself at 765-246-Ext*** or Cell 765-***
After deep investigation we believe that our independent dealer Mr*** is dealing with may have supplied Mr*** multiple times with an aftermarket pulleyWith the frustration Mr*** has had we also want to discuss the possibility of assisting in the non-related seat issue that has developed

I dispute the statement that *** aren't aware I want to return thisThey are fully aware of this as I made this clear to him when I spoke to either Blaine or Shane on the phone Friday June around 4:in the afternoon. At that time I told him if I could have my way I would like this resolved by returning the mower and some one (either *** or Dixie Chopper pay the balance off. So they know this is what I am asking for. Furthermore he told me he couldn't make that decision at this time but would need to speak with some one in the office regards this but wasn't there at the time and would call me Monday June 13thI still haven't heard from them and they still have my mower and have had it since the middle of May. I still stand by what I say about wanting them to pay off the balance and keep the mower and also reimburse me $for the last payments I have made but haven't had the use of the mower. Furthermore this mower doesn't have hours on itI didnt' use this one for other lawns I mow as I didn't like putting it on a trailer and hauling it around. I used this one for my personal use here at home and used my old John Deere for the lawns I mow. Sincerely*** ***

The response from Dixie Chopper was not about my complaint it was for someone else. I am not Ms*** and I have never heard of *** ***I am not asking for my money back I just want my mower fixed

Currently Dixie Chopper is in contact and discussions with the Local Dealership *** *** *** and expect to have a resolution to this request by the end of the week11-4-

Warranty covers "Bumper to Bumper" for two years and "Parts" for the third year

The proposed solution of a full refund of the purchase price would be acceptable to meHowever, as of today (31OCT2016), neither Dixie Chopper nor *** *** *** has contacted me with such an offerIn fact, Dixie Chopper sent my lawyer an email that appears to be stalling for timeThe email states that Bradley C*** of Dixie Chopper had completed his review and that he had determined that the mower had been purchased from *** *** ***....the dealer I mentioned in the opening paragraph of both my Revdex.com complaint and every complaint email I've sent to Dixie Chopper to dateI also know for a fact that Derek B***, Lee H*** and others in MrC***'s chain have been speaking directly with *** *** *** on multiple occasionsAdditionally, MrC*** stated that he was waiting for a response from the dealer but the dealer has stated that their last conversation ended without a resolution and that he had to attempt to call Wes E*** at Dixie Chopper to get something doneAdmittedly, I do not know what is happening behind the scense because no one contacts me but it sounds like the two entities are at an impasse which shouldn't involve meI am still without a working mower as I have been for most of the season and I have waited patienly many times over the past few months for a solution, a refund, or for someone to contact me with a solution

Dixie Chopper has asked the Territory Manager to work with the dealership to gather more information and determine a resolution for Ms*** Territory Manager Andy R*** spoke to *** *** the
morning of July 8th on the matter. He stated he knew his customer was upset about the
product but she has not requested a trade
in or return so that discussion has not happened. He stated he will call
the customer this morning and offer to trade in the mower for another unit if she
is not opposed to another Dixie Chopper. He stated she has had some
issues but he would not call the mower a lemon at this point. Here are
the details:
Mower was purchased August
September 2nd 2015-Taken in for problems- Found water in fuel and
cleaned the carb. Not a warrantable issue
Sept 22nd 2015-Taken in for Belt problems-resolved
April 2016-In for routine serviissues
May 2016- Belt issues-Fixed and returned to customer
*** did mention that besides
cutting her own lawn the customer has a couple other properties she cuts. This is a residential mower and has no commercial warranty
*** was not sure how many hours are on the unit. He also stated that
this was the mower that was in her price range when discussing product and
budget

Dixie chopper has investigated this complaint by doing a warranty Claim search in which we found only one warranty claim for a Battery with failure date of 6/17/Dixie Chopper reached out to our dealer in Oklahoma, Joe *** Tractor Repair owner Joe *** has
talked to Mr*** via phone and was told by Mr*** that his machine does not handle like his mothers and he was unsatisfied with itJoe *** told Mr*** to return his unit and that he would fix anything that was wrong with itAs of today Mr*** has not taken his machine to the dealer for evaluationThe dealer has not been contacted again by Mr***I also asked the dealer what his return policy was and was told he does not do whole good returns that the machine has a warranty and that he would repair anything that would be a warrantable issue with it
If Mr***’s machine is not operating correctly arrangements need to be made with an Authorized Dixie Chopper dealer of his choice and the issue will be repaired under the warranty of the machineNot knowing what his mothers machine is I cannot tell whether his Dixie Chopper will/should handle and operate exactly like his mothers
I have also investigated Mr***’s concern of no response from Dixie Chopper and discovered we received an email on 6-16-that went to an idle email account that got missed (completely our fault)As for any phone messages there were none discovered from Mr***. Dixie Chopper has and always will stand behind their products and make any repairs that are a defect in material or workmanship for the original purchaser of a Dixie Chopper machine within the warranty period
Mr***’s request for a replacement machine, without giving a dealer neither an opportunity to diagnose what the cause of his dissatisfaction is nor an opportunity to repair it is unreasonable
