My sunroom has leaked since it was installed. The supplier and contractor disagree regarding who is responsible for the repair.During the fall of 2009, I ordered a sunroom from [redacted]. I asked them if they had an install service and they said they worked with [redacted]. I entered into separate contracts with [redacted] and [redacted], one to supply the sunroom and one to install. I was a little worried about this situation and at the time, I asked what would happen if there was a problem; how would it be decided whose responsibility it was to fix? I was assured by both parties that they would work it out. The first hard rain occurred the following summer, and the sunroom leaked. I called [redacted] and they came out and tried to fix the sunroom with caulking, but the problem persisted. After repeated attempts at fixing the leaks over a long period, [redacted] said the cause of the leak was a design flaw and stopped returning my calls. I subsequently contacted [redacted] about the problem. They had somebody come and checked it out, and they say that the leak is an install problem. [redacted] says that they have been talking to [redacted] about the problem, but apparently the two companies are in disagreement about whose fault it is, because the problem is still not fixed. The last word from [redacted] was that they could arrange to have the sunroom fixed, but I would have to pay for it. Therefore, despite assurances from both companies that they would work out any problems, I am caught in the middle with a sunroom that has leaked ever since being installed. Business Response [redacted]1) [redacted] whom this complaint has been filed against is a manufacture of sunrooms not a distributor of sunrooms.2) [redacted] has never had any contractual obligations with Mr. [redacted] 3) The documentation supplied with this complaint clearly shows that Mr. [redacted] had a Material Supply Only contract with Solariums Direct Canada Inc. not [redacted]4) Solariums Direct Canada Inc. at no time has had a contract to provide installations services to Mr. [redacted]. Solariums Direct Canada Inc. had a contract to supply a material package to Mr. [redacted]. The Material Supply Only Contract was fulfilled in November of 2009. [redacted] or Solariums Direct Canada Inc have never entered into a contract or received any money to install a sunroom for Mr. [redacted]. 5) [redacted] is not a distributor or an installer of sunrooms. [redacted] is a Manufacture of sunrooms and related products. 6) Mr. Luckert states that he entered into a contract with Sunview Solariums, no such contract exists.7) On behalf of Mr. [redacted] has requested a third party to provide an estimate to address an installation issue (not a material supply issue) and will fax the estimate to the Revdex.com for furtherance.8) Mr. [redacted] may choose to hire [redacted] (provider of the estimate) or continue to work with [redacted] whom he paid for the installation of the sunroom to resolve the installation issue. 9) [redacted] will continue to provide at no charge a reasonable amount of technical support to Mr. [redacted] or whom ever he decides to contract to resolve the installation issues. [redacted] Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)This is a dispute between the contractor and the supplier, and I am caught in the middle. The contractor said it is a design problem and the supplier said it is an install problem. Before purchasing the sunroom, I specifically asked what would happen if there was a problem like this (i.e. a disagreement between the contractor and the supplier) and both said that if such a thing were to happen, they would work it out. This result has not occurred.
