Here is a copy of the plans showing the new garageI also included a diagram of what ended up being my foundationI agree with my framer [redacted] when he told me that Solid Earth made a mistake when they were setting the formsInstead of setting the outside form to the correct mark, they mostly likely placed it on the mark for the inside form, thus the inch difference in the lengths of the garageIf Solid Earth is now claiming they just poured the foundation to the plans, then they still did not do so on either sideOne side is 28'2" and the other side is 27'9.5" and neither of those measurements are what the plans say to doSo any way you look at it, they did not pour the foundation correctlyI have said it once before and it is worth saying again, that at the time they were setting one of the forms, I watched them check for square (make a diagonal measurement from both corners to make sure they match) and also struggle with doing so, but after some discussions with the employees [redacted] I felt like they had it right They made a mistake, we all do, but when we do, we need to own those mistakes and do our best to rectify the situation, which is what [redacted] told me he would do by refunding me the $for at least the second time at the end of SeptOne more thing, [redacted] has never denied in these communications that he agreed to refund me the money, because he did infact agree to refund the money to me more than once

Revdex.com: I have reviewed the response made by the business in reference to [redacted] and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below [redacted] He is just mad that he and his crew screwed up and he feels like he is the only one that I am asking compensation fromLike I told [redacted] from day one, the framer did nothing wrongThe walls were already up and all but two of the trusses were as well before [redacted] mistake was foundTheir really wasnt anything they could do about it by then because [redacted] wasnt going to pay the framer to tear down a section of the wall and he also wasnt going to tear out a section of my new driveway and the corner of the new foundation inches into the ground to remedy the situation properlyIt would have cost a few thousand dollars to do that and $is a drop in the bucket compared to thatbesides the fact that he agreed to pay me the $on at least two separate occasions, in SeptAnd in Oct [redacted]

From the numbers provided, there was no way for the addition to be squareYour plans were incorrectAs the plans show, there was no stepThe step was not part of the original estimate or invoice, as I’ve stated all alongI’ve acknowledged my part in the situation and I’m willing to rectify it by writing off the $

*** * *** handles my written communicationShe does not send
anything without my okSince you’re uncomfortable with this, I’ll handle your
complaint myself.Yes, the step was outside of the scope of workIt was not
included on the estimate or the invoiceI did tell you that we don’t pour the
step until after framing and the floor is done, because we can’t pour the step
until thenI knew we’d have to address this later, which is why it was not
included in the original estimate or the invoiceThe signed document you emailed had your handwritten added
detailsYes, that’s my signature, but including the step is not something I
wrote or included in the invoiced amountThis signed invoice wasn’t brought up
until October, weeks after we’d started talking about me not sending you the
invoice for the stepI did not have *** send the invoice for the step in
September because I thought we would come to an agreement about me giving you
the step for freeYou did receive a copy of it in the letter she sent you
before you filed the complaint with the Revdex.comThe fact of the situation is that I worked to the plans you
provided, as my estimate shows When the
framer found out his trusses weren’t lining up, he continued to build without
me having the opportunity to remedy the situationHe framed the addition to
the same numbers you provided, I assume, and this why he didn’t catch the error
until he was setting trussesWhen I brought up that you should contact the
architect about the error in your plans, you said you could not because he
donated his timeThen when I asked about the role the framer played in the
off-squareness, you said he already donated other time around your home so you
couldn’t ask him for moreI was the only one you could ask for a refund from.I did not get a down
payment for the driveway you added to the project, just like I didn’t get a
down payment for the addition of the stepI generally don’t get down payments
for additional parts of a jobCan you show the dated plans to the Revdex.com
to show what we were working to? My offer still stands: I will write off the step.*** ***

I have reviewed the response made by the business in reference to [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.First of all, The step was never "outside" the scope of work. I spoke with [redacted] from the very first time we met about how I wanted the step done. He told me not to worry about the step at that moment because he never pours a step when he is pouring the floor of a garage, he told me it is always done after the floor is done and after the framing so that he can get the exact height and overall dimensions. [redacted] never ever mentioned this supposed "extra charge" [redacted] is now talking about for the step until after I asked [redacted] for a partial refund for the botch job to my home, after the step was already poured. He told me on several occasions he would send me the money. I have an email from [redacted] stating the refund would be processed if I supplied the signed paper from [redacted] stating that the step was included and that they would come back at a later date and do that. He signed the paper when I gave him the remaining balance in July, before the step was poured. He never mentioned anything about the step again until after I asked for a refund. In a phone conversation on Sept. 29th, he said that he ALWAYS gets a quote and down payment before he does any work and when I said that's right, and that is why you never sent me an invoice for the stepor asked for a down payment because it was included in the original price, he was taken aback and conceded. [redacted] never sent me an invoice for the step and today is the first time I am seeing this fabricated document, after I filed this complaint. They just don't want to do what they told me they would on more than one occasion. He had employees from day one there and me asking how and when we pour the step and he told me that when pouring a garage, he never pours the step until the framing is done and comes back and does that afterward, just like he did. They are lying when they say now that it was not included in the original price. I find it offensive that they are mentioning  the discount as if that is supposed to make up for any mistakes they made in their workmanship. I watched them measure for square when they were setting up forms and they still got it wrong, It is out of square and their is no disputting that fact. If they would have checked for square properly, we would not be in this situation we are now. They need to refund the money like they said they would months ago. Like [redacted] told me he would on more than one occasion and like [redacted] mentioned in one of her emails to me that I have included in the documents I am sending with the response. One more thing I would like to mention, [redacted] is not who I have dealt with in this manner, she is just and employee and I have been having have much contact directly with the employer as possible. I don't even know if [redacted] have seen this complaint or if [redacted] is just trying to "handle" this herself and I am very uncomfortable with this situation.

I have reviewed the response made by the business in reference to [redacted] and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below. Here is a copy of the plans showing the new garage. I also included a diagram of what ended up being my foundation. I agree with my framer(who builds multimillion dollar mansions for a living) when he told me that Solid Earth made a mistake when they were setting the forms. Instead of setting the outside form to the correct mark, they mostly likely placed it on the mark for the inside form, thus the 5.5 inch difference in the lengths of the garage. If Solid Earth is now claiming they just poured the foundation to the plans, then they still did not do so on either side. One side is 28'2" and the other side is 27'9.5" and neither of those measurements are what the plans say to do. So any way you look at it, they did not pour the foundation correctly. I have said it once before and it is worth saying again, that at the time they were setting one of the forms, I watched them check for square (make a diagonal measurement from both corners to make sure they match) and also struggle with doing so, but after some discussions with the employees by [redacted] I felt like they had it right.  They made a mistake, we all do, but when we do, we need to own those mistakes and do our best to rectify the situation, which is what Jeff told me he would do by refunding me the $500 for at least the second time at the end of Sept. One more thing, [redacted] has never denied in these communications that he agreed to refund me the money, because he did in fact agree to refund the money to me more than once.

At the end of May 2015[redacted] contacted [redacted], owner of Solid Earth, LLC for an estimate for the foundation of an addition
at her home. I’ve included the original estimate, the revised estimate, as well
as the estimate she signed and wrote additional information on for...

your
records.  Each of the estimates included
“as per plans,” which indicates Solid Earth, LLC would work to the plans she provided. The quote for the job came to $7,500, but [redacted] authorized a 10%
discount due to [redacted] personal story. [redacted] completed the work the weeks of June 8th and June 15th. At that time[redacted] decided to add a driveway
to the job. This resulted in an additional charge of $2,000, but [redacted]
authorized a 10% discount for that amount, as well. The bill for the work was
$9,500 minus a 10% discount, resulting in a final total due of $8,550. Invoice
#1212, outlining the work completed, as per plans, is included with the other
documentation. In August of 2015, [redacted] returned to the home to form
and pour a step [redacted] needed completed. This was outside of the scope of
work of the original estimate. In early September, I put together an invoice
for the step, which was $1,000 minus the 10% discount, resulting in a total due
of $900. At the end of September 2015[redacted] emailed asking
about a $500 refund as “a resolution to a problem” she said she had discussed
with [redacted]. I let [redacted] know, and he indicated that he had spoken again with [redacted], so I did not respond to the email. After receiving another email
inquiry about a $500 refund in October 2015, I called [redacted] to explain
that we could write off the invoice for the $1,000 step for her trouble. During this conversation, no
resolution was determined.Over the course of October and November, we have
attempted to come to a resolution with [redacted] in many phone calls and
emails. At this point[redacted] wants a $500 refund, but I have a balance
due of $900 for her on my end.

Their really wasnt anything they could do about it by then because [redacted] wasnt going to pay the framer to tear down a section of the wall and he also wasnt going to tear out a section of my new driveway and the corner of the new foundation 30 inches into the ground to remedy the situation properly.
