Mr***,I represent Solimar Builders regarding the above case number, please contact solely my officeregarding this matterWe are in receipt of your letter dated October 28, regarding a complaintalleged by Ms [redacted] My client denies performing any work in an unworkmanlike manner,denies failing to perform work satisfactory to applicable building code and denies alleged unprofessionalbehavior.My client was primarily hired to renovate a bathroom, install new floors in several rooms andconvert a utility room back into a garage in Ms [redacted] 's residenceIt's my understanding Ms[redacted] became upset upon learning my client did not install new sub-flooring underneath the primaryfloors installed in the customer's homeMy client tells me that upon removing the original primaryflooring, several layers of old, unleveled and inadequate sub flooring were discovered that requiredremoval before new primarily flooring could be professionally installedThe customer did not allow fornew sub-flooring in the construction contract (enclosed as Exhibit A) so my client removed layers of old,unleveled and inadequate flooring until adequate sub flooring was exposed and then professionallyinstalled new flooringWhen the customer learned that old, unleveled and inadequate sub-flooring hadbeen removed and not replaced, she became irate and bas remained unsatisfied ever since.Ms [redacted] alleges that HUD inspected her home and demands money returned from myclient, however she fails to provide such supporting evidenceMy client tells me that he is incommunication with all parties and is diligently attempting to resolve any differences

Review: Based on a recommendation from my realtor, [redacted] of Varina and Seelman, I hired Solimar Builders to repair a HUD repossessed home I bought that had damage to floors and bathrooms and to turn an enclosed garage into a usable garage. The owner [redacted] was paid 50% up front by the mortgage company. He has been fired on the grounds of not performing the work in a workmanlike manner, not performing work to code and for unprofessional behavior that includes threatening me and my daughter and cursive and abusive language. Per the HUD inspector's report the mortgage company has asked that Mr [redacted] return approximately 50% of the money he has been paid to cover the cost to have his work removed and replaced in a professional workmanlike and building code approved manner. Mr. [redacted] has refused to return the money and would like additional funds he feels he is due. In the meantime I am living in a home with uneven sinking floors and improperly connected plumbing. I can not hire another contractor for the funds left in my escrow account and my mortgage was approved based on the assumption that I would have a certain value in my house when the work was completed. In other words the work has to be done. The mortgage company needs Mr. [redacted] to sign that he will not put a lien on my house and he refuses this as well as he feels he is due the money he received and more. If you need to see the HUD report I have a copy as well as the photos the HUD inspector took during the inspection. I just do not have the space to post them here.Desired Settlement: Mr [redacted] needs to pay back the money he has been asked to pay back by the mortgage company. He needs to sign a statement that he will not put a lien or any other claim against me or my property. I do not want him to finish or correct his work as I fear for my safety as he has proven to me that he is a person with a quick and abusive temper. Review: [redacted] has performed work on my home that will require me to re-pay someone else additional funds to repair. He has verbally assaulted me and threatened to come to my home after his release from his contract. His work has been inspected by a HUD inspector who has determined that should return approximately $7k to me that was paid up front to him based on approval by [redacted] to start the renovations, which the contractor refuses to return to me. This leaves me without the ability to make he necessary repairs on my home to make it habitable. It has also come to my attention that the contractor holds a Class C license working on my renovations bid that is over $21k, which is out of his scope based on his license.Desired Settlement: Since the contractor's workmanship has proven to be less than satisfactory and not up to code, I don't feel requesting him to manage any additional repairs would be sensible or sufficient. Given the nature of his work and the assessment by a third party HUD inspector, I feel the funds as determined by the inspector, should be returned to me so I can make the necessary repairs to my home. I also feel funds should be issued to me to compensate for the additional repairs I will have to make following his attempted repairs.

My client denies perfonning any work in an unworkrnanlikemanner and also denies performing any work outside the scope of his contractor's license.I've been told that HUD inspected my clienfs work and all parties are presently in theprocess of detennining a fair resolution to any discrepancies at issue. Furthermore, VirginiaCode § 54.1-1100 defines a Class C Contractor as authorized to perform construction serviceswhen (i) the total value referred to in a single contract or project is over $1000 but less than$10,000, or (ii) the total value of all such construction undertaken within any 12-month period isless than $150,000. My client.appears authorized to perform the work at issue because the totalvalue of all such construction lindertaken by my client within any 12-month period is less than$150,000.It is my understanding that my client is in communication with all parties and isdiligently attempting to resolve any differences.
