We received the complaint referenced above on October 24, and offer the following explanationAs the customer states in her complaint, she had become late for over thirty (30) days on her carpayment and we attempted to contact the customer, but did not receive a responseDue to the fact
that we were unable to make contact with the customer, we contacted the automobiledealer that facilitated the loan to attempt to confirm contact information on file for the customer, bairDebt Collection Practices allow us to communicate with persons other than the consumer forpurposes of acquiring location information about the consumer, as long as we identify who we ^eand state that we are confirming or correcting location information concerning the consumer, whilenot stating that the consumer owes any debtWe complied with these practices when we reached outto the automobile dealer, who was unable to provide us with additional contact information.• The customer reached out to us to make arrangements for missed payments on 10/12/16.• In the complaint, the customer makes reference to subsequent phone calls to several peopledifferent dales and states that personal information about the loan was given to themAs stated m thesecond bullet the Bank contacted only the dealer that facilitated the loan in order to confirm contactinformation on file for the customerThe Bank was within its rights, as described in the secondbullet.• The Bank maintains documentation of collection activities and communicationOur records indicatethat we attempted to contact the customer on 9/26/16, 9/28/and 10/12/16, but did not receive aresponseOn 10/12/16, we contacted the automobile dealer that facilitated the loan, but they wereunable to provide us with other location informationThe customer contacted us on 10/12/and wemade arrangements for missed payments.Our Privacy Policy can be viewed at www.solvavbank.com/home/privacv-policv.As described above, the Bank did reach out to the automobile dealer that facilitated the loan when we wereunable to make contact with the customerThis was done in order to confirm or correct location informationabout the customer; at no point did we state that the customer owes debtAs a result, and according to theFair Debt Collection Practices Act, we were within our rights.If there should be any other questions or concerns, please contact me at ***
