We did speak to [redacted] today by phone, as his account is past dueThe membership itself, as was explained to [redacted] , was never cancelled, and no in-club cancellation form ever completedIt is solely the members responsibility to manage their membership account and payments, not that of the gym While we want and desire each member to use the facility always, membership dues responsibility does not rest with ones usage, so the fact that [redacted] feels owed a refund for a lack of facility use is completely falseAn example would be asking Comcast to refund cable services because you had not watched their programming or used their serviceWe did advise [redacted] the best and most expeditious way of addressing his account, is to visit and complete the necessary paperwork to effectively closeout the accountHe has not done so to this point

I have carefully reviewed the contract and it does not state that having direct deposit is part of the contract and it specifically states I can pay by check or other methods. Furthermore, it is unlawful to not allow someone to cancel their direct deposit when requested.Sincerely,*** ***

Yes, with regard to Ms***, we reiterated the policy on cancellation due to relocation, which was made clear at the time of enrollment and stressed at the time of conversation in the club with our club managerThe agreement is very specific with regard to what proof is acceptable when
relocation occurs, and what fees would be owedWe have, and always with all members, remain consistent with the language of her contractual commitments.While we sympathize with her situation, it does not absolve her from her contractual and financial obligationsShe has now disputed valid and correct payments on the account, which has resulted in a collections submittalWe encourage her to adhere to and ensure payments on the account, so as to ensure costly collections does not become necessaryIn the event no payment is made, as well as her initial joining fees repaid, collections will unfortunately occur

Mr. [redacted] was informed when completing his request to cancel, that he would have a final payment due on 7/15/16. He was also provided written notice of this final payment prior to leaving. While we appreciate Mr. [redacted] request to pay his final payment in the club, the billing is all done by third...

party when contractually scheduled. The final payment is due and owing, as the account cannot be closed out with an open balance. We strongly encourage Mr. [redacted] to ensure payment, so that his account can effectively be closed out.

While we appreciate the request of [redacted], the auto payments are required per the membership contract. This has been expressed to him by two employees in management. He also requested that the party he was calling on behalf of, would like to cancel their membership as well. It was also explained...

to him, that such a request was slightly premature given that the initial term of membership had not been met. It was also explained to him, as it was upon enrollment, that all billing is conducted automatically, and that payments at the club level are not accepted, as the billing is all conducted via third party billing provider. Having explained this several times, there is unfortunately nothing more than we can assist with at this time. We consider the matter closed.

Mr. [redacted] membership was cancelled as of this morning. We are more than happy to provide a refund for pervious months dues in question, we simply ask that Mr. [redacted] provide us a copy of his completed cancellation form, that he notes was completed on 3/25/15, as we have no record of this. knowledge, Mr. [redacted] does not have record of this either, based upon his conversation with our General Manager yesterday. We consider the matter closed.
