Review: I bought a car and told wound fix dash light with car purchase, Dash light repair noted on repair car contact order and not honor, I ended paying for it and car dealer refused to pay for it.Desired Settlement: I would like to be refunded what I paid to fix dash light.

Review: On April 25, 2015 I executed a consignment and sales agreement with Source Motors, Inc. Auto Dealership number [redacted] at 951 Newhall Street, Costa Mesa, CA 92627.

Various correspondence occurred through the months with [redacted] indicating that he had several people interested a few of them out of state. Mr. [redacted] had contacted me on July 15th and advised that he believed he had a buyer that has committed to buying the vehicle. [redacted] indicated he would get as much possible for me and as close to the offering price as possible.

We corresponded through Email several times regarding establishing a date when I could come in to complete the paperwork, obtain payment and deliver the California DMV owners certificate. I met with [redacted] at his offices on July 29th, 2015 at approximately 4:30 PM. He had the paperwork all filled out along with a check and just asked that I sign the documents to finalize tehe deal. I questioned at that moment why I am transferring the car to Source Motors versus the actual buyer of the car since it was a consignment sales agreement. [redacted] indicated that this is how it has to be done and that he had already shipped the vehicle to a buyer in the previous week out of state.

After looking at the paperwork once I got home, I noticed several discrepancies in the paperwork as follows:

There was no sales price listed on the Vehicle/Vessel Transfer and Reassignment Form

The date of transfer and the release of liability form which was filled out by Source Motors listed the transfer or sale date as of July 14, 2015 when the actual date that I had signed over the over the transfer and received the payment was July 29, 2015.

There was no paperwork providing the actual sale price of the vehicle, the vehicle owner, a bill of sale which substantiates both the payment to me as the buyer as well as establishing the sale price from which the commission was calculated and owed to Source Motors.

I notified [redacted] the very next day on July 30, 2015 of these deficiencies and he agreed to provide me with all of the above items but was out of the office and needed a week to get this information together to submit to me.

I followed up with [redacted] on July 31, 2015 through email clarifying those items that I was requesting to ensure that the information requested was clear.

I did not receive the requested information the following week and followed up with [redacted] on August 10, 2015. He responded that he was not going to provide any of the information and that he is not required to do so.

According to the Consignment agreement it outlines the consignor's responsibility to with 21 days of consummation of the sale to provide the seller with the following:

Make an accounting to the consignor of the date of sale, sale price, any repairs necessary to expend on the vehicle and the amount that is to be disbursed to the seller. As a registered Automotive licensed dealer, I believe that there were many violations on this transaction.

Source Motors did provide an invoice on July 30, 2015 dated July 29, 2015 reflecting their represented sale price of $46,000 less the 6% commission which netted the amount of $43,240 which was the amount that they paid to me the buyer. Attached is both the invoice and the check payment that they had issued. It should be noted that this net amount is the amount that was placed by Source Motors on the vehicle transfer sent to the DMV versus the actual selling price of $46,000.

I would respectfully request an investigation of Source Motors dealing in this transaction and enforcement to have them provide me with the appropriate information to evaluate if I was paid the correct amount under the consignment sale agreement and whether I had paid the correct amount of commissions to them which at this point has been unable to verify based on Source Motors refusal to provide any documentation to substantiate the sale of this vehicle.Desired Settlement: To obtain the following items from Source Motors regarding the sale of 2005 SL65 Mercedes under sales and consignment agreement:

1) Sale contract signed by the buyer reflecting the sale price of above vehicle from buyer to Source Motors documenting the proceeds which the funds paid on the sale to the buyer were calculated as well as the commissions that were paid to Source Motors for sale of the vehicle

2) A copy of the wire transfer funds of the declared $46,000 from buyer to Source Motors documenting the proceeds which the buyer was paid as well as documenting the amount the commissions should be calculated and paid from seller to Source Motors under the consignment agreement
