Review: I bought a Kirby vacuum with the understanding if I didn't like it I could return it. I called after one day indicating this vacuum was to heavy for me and to powerful for the small rugs I have and that it wasn't going to work for me. I was told this was no problem they would have the sales person come back out and pick it up. after a week I called again and was told a manager needed to be notified that this was not a problem. yet nothing still. then today I call and I was told they had never heard from and that I needed to mail in the return cancelation. I was told that I didn't need to do that because I had called within the time frame for a return notification. also the contract indicates I paid $1000 when I paid $700 .. I don't understand this either ...Desired Settlement: return and refund

Review: On the 10th of August 2015 my wife ([redacted]) was home and a Kirby representative showed up at our door claiming to clean our carpets for free. The salesman then proceeded to give my wife a sales pitch for a Kirby vacuum cleaner for $1200.00 plus $449.10 finance charge with an APR of 21.97%. I didn't see the unit or the contract until 1 week later. I ([redacted]) have since contacted the seller and was informed that what they did was legal and binding. I informed them that my wife does not have "power of attorney" over me and was not authorized to sing anything on my behalf. South Bay Kirby then referred me to the bank that holds the contract (United Consumer Financial Services). They offered to send me some paperwork to have me removed from the contract without re-writing the contract. We spoke to the Kirby company customer service on 3 occasions and they would not speak to me ([redacted])on the initial contact since my wife was the main person on the contract. My wife spoke to them and explained that we wanted the unit removed and the contract voided and that the sales man informed her that signing my name was completely legal. She then followed up with Kirby the next day and was informed that we would be stuck with the unit and there was nothing that we could do. I followed up on the 3rd day and also told me to deal with the financial institution.Desired Settlement: We want the vacuum picked up and all financial obligations voided with said bank

Business states that they have been in contact with the consumer directly. The consumer has decided to keep the vacuum and the first payment on the financial agreement has been made. The finance company offered him the opportunity to remove his name from the contract. He was mailed an affidavit that he needed to sign and return so his name would be removed. Even though the consumer did not meet the 15 day return of the paperwork deadline, the company still offered to honor the document beyond the 15 day window. The consumer indicated that he was not happy but did not wish to change anything and decided to keep the unit. The consumer was presented with alternative options in resolving the matter yet made the decision to keep it.

I am rejecting this response because: I did talk to South Bay Kirby and the only option was to have me removed from the contract which would have resolved nothing. Yes the first payment was made because if we didn't make it we would be in default. What we wanted was to have the unit returned and the contract voided because of a business practice the is inconsistent with integrity. The salesman had my wife sign my name on the contract without having her contact me regarding it. Furthermore, when my wife spoke to [redacted] to confirm that she signed both of our names on the contract they accepted it which is also inconsistent with good business practices.
