Good Morning, Our ATP has reached out to the manufacture to see if the paint that matches can be obtained for the spots that due not match.  The chair is fully functioning and this is considered cosmetic, but we are working to get the paint so the patient will be happy with her...

I am pleased that a MedOne representative is "reaching out" to the manufacturer of the wheelchair.  However, contacting the manufacturer is not the same as solving the problem.  Both the manufacturer and MedOne sold the wheelchair with warranties against defects in workmanship.  While it is true that the functionality of the wheelchair is not affected by the defects in the finish. the wheelchair is defective nevertheless.  If MedOne's view of its performance were applied to other industries, such as the automobile industry, a consumer would be required to accept a new car with scratches in the finish and have no recourse.  It is absurb to believe that the appearance of a product is not covered by the manufacturer's warranty.  MedOne is free to decide what it wishes to do with respect to the repair of the defective finish on the wheelchair.  I am not, however, required to accept the repair unless the repair cures the defect.  The finish on the wheelchair is powder coat.  I am not certain that an enamel touch up paint will produce a seamless repair.  Additionally, I am not certain that touch up paint is even available.  When the defect in the wheelchair was first noted in August, MedOne said is was obtaining touch up paint to make the repair.  When it had us return the wheelchair to it, Med One attempted to simply buff out the scratches instead of using touch up paint as represented to us.  In other words, MedOne did not obtain or use a touch up paint when it previous attempted to repair the wheeelchair. Incidentally, you should note that the repairs already undertaken by MedOne have exacerabated the problem.  The original finish on the wheelchair is matte, and, now, the buffed area appear almost glossy.  The defect produced by the repair must also be corrected. The complaint against MedOne should remain open until all attempts to repair have been made and the results of those repair are examined.
