At ***, as with any membership-based company, verbal
amendments to contracts are not accepted.
When the complainant first spoke with Mr***, it was indicated that
the cancellation could be processed without a cancellation fee due to the
contract being fulfilled and was now on a month-to-month basis. The member however, would still need to fill
out the form provided on our website and submit via email, as we cannot amend
verbally. The form was never submitted,
leaving the account open continuing to accrue monthly charges, therefore our
software automatically sent the delinquent file to collections
Due to the 3rd party agency only having the minor
member’s name on record, the communication was addressed to him. After speaking with the complainant and
updating our files, the correction has been made and the collections agency has
the correct data
On September 14th, the complainant called our
retention specialist to inquire about the membership. It was communicated to him that due to the
membership account being past due that if he reconciled the account and
returned the cancellation form that day she would not require a day notice,
which would have added another month’s dues to the account, as a service. The complainant declined the offer and
refused to pay the debt owed.
As noted, the collections file has been properly updated
with the correct person’s name, the minor is listed as the member and the
guardian is listed as the financially responsible party. The complainant has also been supplied with a
copy of their contract for their records

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  
As Ms. [redacted] said in the response, "When the complainant first
spoke with Mr. [redacted], it was indicated that the cancellation could be
processed without a cancellation fee due to the contract being fulfilled and
was now on a month-to-month basis."  That is what was communicated to me.  There was no mention at that time of doing separate paperwork.  No additional funds were requested and he indicated that the account was closed.  I had no reason not to believe him.  As I mentioned in my complaint, since the funds had already stopped coming from my account, it was communicated to me that the formal termination process didn't need to take place.  Then several months later, they decided to have a collections agency reach out to my family.As I mentioned in my complaint, I am willing to go above and beyond and offer up a month or so of dues.  I am willing to meet somewhere in the middle here, but [redacted] needs to cease the collections agency contact to my family.

[redacted],[redacted] would like to apologize for the inconvenience, as you may not be aware of we took out cage 5/70 mph out as an automated cage back in december of 2014 as we needed to convert the cage to a live hitting only cage to use for lessons, team and individual member hitting. As for cage...

4/60mph, we have had some daily issues,but these issues have been addressed on a daily basis. We have our hitting machine contractor coming in this weekend to fix cage 4 and update all the other automated cages. We would like to offer you a free month of hitting and also we would like to offer a free hitting lesson to your son.
