Dear ***,In response to your e-mail dated June 6, 2014, I would like to inform you of the following:1. Several days ago I had a face to face meeting with *** ***He informed me that during his and his wife *** *** first meeting with *** in our sales office in ***, *** filled out the visitor registration card including name of realtor representing themWithin couple hours I contacted him on the phone to inform him, that I received copy of visitor card and the name of the realtor is not included (copy of the card was sent to Revdex.com)At this point I told him, that my company would still like to sell and build for them home but without paying sales commission to realtor who was not introduced to us at required time.2. We are top *** County Builder with great reputation and we still hope to improve our relationship with *** and *** and build for them dream house.3. This e-mail serves as a final offer and we are not willing to provide them with any more responses.Thank you.Sincerely,

Purchased a new construction home from the builder - items before/from/after the settlement walk through not addressed yetVery limited responses and have not addressed the issues so far
HVAC issues/DUCT work - Air condtioners not working- No response from Warranty or Emergency contact numbers
FINISHING issues (***)
Incorrect installation of fixtures
Grading issues with the property not addressed
Driveway issues
Installed dead vegetation/did not seed the property correctly - We reseeded and fertilized the property

June 5, 2014Dear ***:My name is *** ***, I am the sales manager for Southdown Homes, L.Pand a licensed real estate agent with *** *** Home Services, The following is a summary of my interaction with the complainant, *** ***:March 22,***
and his wife *** *** visited my model homeThey signed a visitor card and the Consumer NoticeThey went through a home under construction that they thought would work for their needs.March 23,*** and his wife returned with additional questions They took additional information about taxes, etc, and we discussed lots that might interest them.April 6, *** and his wife returned to see the home they liked as it was almost complete.May 17, *** and his wife returnedThey said they had been pre-approved for a mortgage and had contacted an agent about selling their current homeI gave them option pricing and homeowner specifications to help them decide between the floor plans they were interested in.May 24, ***, his wife and a Realtor came in, I gave them the latest lot premium listThey wanted to sit and review things, but I had an appointment already scheduledThey asked about 'the next step' and I gave them the Reservation Lot Deposit and Buyer's financial forms necessaryThey left the office and returned within the hour: I excused myself from my agreement of sale appointment, The agent started to give me the paperwork, but I told them they I needed to let them know first that "the builder would not honor the Realtor"*** announced, "Then we won't be buying here I" I then told them I would speak to the builder and get back to themThe agent agreed to keep the deposit paperwork for the time being.After speaking to the builder that day, I sent the following email to their Realtor and them-***,I am sure you understand a builder/seller’s position with regard to honoring an agent after visits from a prospect without an agentThey signed a Consumer Notice acknowledging my relationship with the builder on their first visit back in MarchHe is not willing to honor you in this transaction, but we have no issue with you helping and/or guiding *** and *** if they decide to buyPlease know that I do not make any additional money because of the lack of a co-op...had they brought you into the process earlier (not even the time) I would have no issueMay 27, May 28, June 3, I receive emails from *** and ***, jointly and separately, letting me know their dissatisfaction with the situation, stating on more than one occasion that they would not be buying a home here

I am rejecting this response because:
* Information provided by [redacted] was fabricated, She hand filled in the visitor registration card making it now invalid
* The builder never contacted [redacted](Agent) [redacted] called instead, they never tried to resolve anything (See email below stating that they will not pay our realtor)
* The traffic report included is inaccurate, [redacted] failed to mention that we told her numerous times a realtor would be involved in the process
* Our realtor called [redacted] and left a detailed message as well as make an appointment with [redacted] but she never returned her calls
* This was a response from [redacted]'s email to me and my wife: 05/28/2014 when she suggested our Realtor work for free:
Hi [redacted],
We have no issue with [redacted] being
there to represent you in the process. As I stated before, the builder will not
be paying any commission to her, but she is welcome to be there as you
representative.

Another email response from [redacted] 05/28/2014 I am not going to get into a
battle of words other than to say a Realtors job is to introduce a buyer to a
seller. ###-###-####
 
[redacted] never explained any disclosures to us, she basically told us it's for visiting the model home and to just sign it
[redacted] was plain nasty towards us and our realtor when we went to present her an offer, By her stating that the builder will not honor our realtor.We cannot trust her
 This issue needs to be resolved if we are to move forward, We told [redacted] that we will not purchase unless this is resolved . This issue also has us weary of what the 8 month building process will be dealing with [redacted].

I am rejecting this response because:
I did speak to [redacted], I personally met with him at his office and he said he would look into the issue.
The next day he called me stating that it's Pennsylvania's law to come in with a Realtor the first day or they will not pay our realtor to represent us if we purchased a home at Southdown. He informed me that his company can build us our dreamhome but we will be represented by [redacted] and not our realtor. Our realtor can assist but will not get paid.
[redacted] did not even make an attempt to resolve the issue, Every step has been reviewed and decided by [redacted] who is part of the main problem. He is allowing [redacted] to drag his company through the mud because she did something wrong and refuse to make it right with us and our realtor. Overall they are making this situation even worse to deter us from buying there at this point.
Also, the visitor registration card says nothing about not paying our realtor or Southdown as dual representation.
Overall, if I purchased there, I would be paying all realtor fees, not the builder. I don't understand why there is an issue.
This builder is being unreasonable, hence the problem at hand.

Review: On February 14th, my husband and I closed on our mortgage for our new home built by Southdown Homes in [redacted]Considering that the house was completed in the winter months, some of the outside surfaces were not painted and the landscaping was not completedWe were told by the foreman, [redacted], that when the temperatures became warmer, then they would complete the painting of the front door and columns on front porchWe were also told that they would be back mid-April to finish the landscapingThe landscaping includes grading and cleaning the lot, planting trees and shrubs and finally applying grass seedAs of April 21, these services have not been completedI have emailed and texted [redacted] at least times to ask when they would be able to complete these servicesI have not been told when they will be completed except that they will eventually do itMy house is not the only one that is waiting for these servicesThere are approximately 6-houses that need painting, grading, planting and seedingThe builder is continuing to complete other homes, besides the 6-homes already settled and occupied, that are near to closing, completing outside work while we continue to have to wait with no reason, explanation or date of expected completion.Desired Settlement: I would like the builder to complete the painting, grading, landscaping and seeding of my lot and others that are waitingThis should be the first and highest priority above other building in this development

Review: Visited [redacted] several times and met with sales person [redacted] in regards to purchasing new home. Told her we will be bringing our realtor when we are ready to purchase. Finally our realtor called her and scheduled a time to meet and we filled out the paper work to sart the buying process but was rejected by seller claiming that she could not accept our realtor as well as the paperwork to start buying our new home. Overall we were rejected from buying a home at [redacted] farms. [redacted] said the builder would not pay our realtor either if we did buy we would be unrepresented. [redacted] never mentioned before that there would be an issue until we presented the paperwork.Desired Settlement: I would like to speak to the builder because I believe there is Asymetric information between [redacted], the builder and myself.
