This vendor continues to charge my credit card even though I have discontinued use of their service. At end of 3 yrs contract I changed to ADP.
On 7-29-2016 I signed a 3 years monitoring contract with Southeast Wiring Solutions for security monitoring services at my home, ***. I had just relocated to that residence having just purchased it and they were using this service from the builders. The service was generally poor, especially customer service. ADP later sold me their services well after the three years had expired for SWS service. SWS argues that the contract renews automatically, but the contract states that I can discontinue the service with a 30 days notice. ADP had promised they would handle the changeover including notifying SWS. SWS has continued to charge my card for the service I and no longer using (as I am now a customer of ADP) despite my numerous request that they discontinue doing this. They use the flimsy excuse that I'm still under contract and I must pay them $154 to terminate although the contract does not state this.
I want SWS to stop charging my credit card for service I am no longer using.

Mr. is in legal and binding contract with Southeast Wiring Solutions. We spoke to him on multiple occasions and communicated via email on both May 11th and early June and sent him and the Mrs. a copy of the contract. We have offered early termination of the contract with a termination fee which he refused. We have stopped auto charging his form of payment per his request but the invoices and balances are still due as the account is still active based on the current term of the existing contract. I have also included a copy of this contract. We are still offering early termination per the cancellation clause of the contract if Mr. so chooses to accept our offer.

My 3 years contract with this company was completed. They insist on it being automatically renewed which is incorrect as you cannot have automatic renewal of a binding contract. Where is the consideration for the new contract as consideration cannot be past. The contract was renewed without my knowledge or consent as I was never happy with the service. They continue to be unreasonable and the imposition of a penalty to exit a non existent contract shows their incredulity.
The contract in question specifically and clearly states the renewal is automatic and customer acknowledged that clause in the contract when he signed it. Our position at this point is to offer Mr. an out of the contract with a penalty. We have made an offer of early termination and that offer still stands. If Mr. does not want to accept our offer we have no choice but to proceed with collections as the contract is valid.

Florida Statute §501.165 requires that automatic renewal provisions in service contracts be clear and conspicuous, and that the consumer be notified no less than 30 days nor more than 60 days before their contract automatically renews, if the initial contract is 12 months or more and if it automatically renews for more than 1 month.
Additionally, the Federal Trade Commission has attacked automatic renewal clauses in recent years through enforcement of the Restore Online Shoppers Confidence Act ("ROSCA"). ROSCA requires that automatic renewal clauses (a.k.a. "negative option features") for goods or services purchased on the Internet be clear and conspicuous, that the business obtain the consumer's express informed consent prior to charging their card, and that the business provide simple mechanisms for the consumer to cancel.
