Prior to Nicole [redacted] submitting these documents to us for service upon her ex-husband living in [redacted] [redacted] , it was very clear that we would “make three to five attempts” at service by the deadline of 1/12/for the $service feeOur server made three attempts in the time frame given and attempted after 4:00pm as per the request of Ms [redacted] We did exactly what we said we would doMs [redacted] had told us that her ex-husband was “home all weekend” the weekend of 1/9-1/yet when the server made an attempt on 1/10/and no one answered We cannot force individuals to open their door if they do not want to open or do not want to be servedIn this industry, no process serving company can guarantee serviceOn 1/14/16, Ms [redacted] called our office very upset that the documents were not servedContrary to what was listed in the 1/14/complaint, I did offer to resolve this multiple times throughout our conversationI informed Ms [redacted] that if she would attain a new court date, we could and would make two additional attempts to serve her ex-husband at no additional costShe refused this offer and requested that we generate and send her an affidavit of non-service which is exactly what we didRefund denied

I was never told that rush service was recommended or even available, My ex could have been served if they would have made attempts when I paid instead of waiting several days to start

I understand that customer is upset that her ex-husband was not served but we cannot guarantee service and have offered to resolve this issue by making additional attempts at no charge in which the customer rejected. The reason I did not offer rush service on this paper is that I knew that the *** *** server was unavailable to make attempts on a rush basisTherefore, when I had been e-mailing the customer about our service and fees, I only stated the rate for routine serviceOn 1/7/16, I had e-mailed, “We charge a flat rate of $for service to *** assuming one person is attempted at one addressThis fee includes 3-attempts if needed.” In addition, the customer never made any indication that she wanted attempts made immediatelyShe told me the court date associated with the documents and I informed her of the final day to attempt and that we would make three to five attempts in that time frameBy sending us the job via e-mail and paying via credit card later that day, the customer agreed to those terms. Our server did make three attempts on three separate daysUnfortunately, the party being attempted was either not home or did not answer the door on each of the server’s attemptsAfter our service time had expired, we let the customer know that the papers were not servedI then immediately offered to have our server make two additional attempts to serve her ex-husband but that she would need to adjourn the court date first so that we could proceed with the attemptsI made this offer multiple times in our 1/14/phone conversation but repeatedly the customer turned down this offerClearly, we attempted to resolve the customer’s issue but she was not interested for whatever reasonPlease note that we did not have to offer these additional attempts as we had already met our obligation by making three attempts in the first place but I could tell that the customer was upset and I wanted to make sure the customer’s needs were met
