SPM's property *** has fraudulently overcharged me amounts in excess of the rental agreement and final move-out invoice.
On May 26th, 2018 my husband and I submitted intent to move out to the *** in ***, TN at the end of the lease on July 26th, 2018. We later received a move-out invoice entitled "Notice to Vacate Confirmation" that reported our final rent amount from July 1st to 26th as $926.77; however, on July 3rd, 2018 we were charged $1155.74. The rent amount owed to the apartment complex responsible for the charge is $926.77 (as my lease ended prior to the end of the month), the trash/water/sewer charge was $50.74, the garbage charge was $25, and the short-term lease ("Seven Month Charge") was $35. This adds up to $1037.51, which is the amount authorized by me per the lease agreement and final move out invoice. This means they wrongfully overcharged my account $118.23.

My husband and I vacated the unit on June 21st, 2018 following an in-person move-out inspection with no charges incurred at that time. We turned in our keys and per the lease agreement and move-out invoice instructions received from leasing staff we terminated our utilities as required on the day we turned in our keys. On July 27th, 2018 the leasing staff charged an additional $32.19 for "final water/sewer - 07/02/2018 - 07/26/2018", on top of charging us $38.66 for water/sewer from 06/01/18-07/01/2018, and an additional "final water/sewer" charge of $5. As we only resided in the unit and used 21 days of water that would amount to $27.06, not $38.66. The additional utility charge for water/sewer of $32.19 and $5 are fraudulent charges in direct violation of the written statements, agreements, and the lease.

I contacted the office via telephone and in-person four times prior to the rent charge from 7/3/18 being processed by my financial institution. The office assured me they would remedy the overcharge on the account, but this never took place. On July 27th, 2018 the charge had still not been corrected so I notified *** and CC'ed *** via email on July 27th, 2018 contesting the amount charged by ***. I received an initial response stating the following:

"When we last spoke on the phone we clarified that if there is a return due to you that you would be getting that about 30 days after your move out. Your official move out date was 7/26/18. We are unable to touch any of the refund amounts until that move out day. Once that day comes around the move out statement is processes in the system here and sent to corporate to cut checks. I have been out of the office since July 19th. I will be sitting down to do the move out statements today. If you have any additional questions please don't hesitate to call or email."

I emailed *** again on 8/1/18 and 8/13/18 to follow-up on the status of my account. I have not received a final statement in the mail or via e-mail and they have refused to address the fraudulent charges at all.

Desired Outcome

The SPM Property Management owned apartment Legends at Oak Grove should refund me $118.23 for the rent overcharge in addition to the $11.60 water/sewer overcharge.

Upon finalizing your last statement, the aforementioned billing issues were adjusted and resolved with your final payment closing out your ledger with ***. Following these adjustments, we are under the impression no further action is necessary. While the response from *** reflects in part their actions taken to remedy their billing errors, I was still charged a "returned check fee" on my final statement despite the fact that the original ACH Debit from *** was indeed fraudulent (i.e., the amount reflected on my move out statement and the amount charged by *** were different and the disparities had been brought up on numerous occasions with *** staff). *** received a cashiers check from my financial institution with the final amount due; however, I should not be fiscally penalized for their ineptitude at maintaining appropriate account balances and dearth of fundamental book keeping skills. An adequate response is one where only the money that was originally owed is all that is paid and due. The "returned check fee" should be returned to me as the fault lies with ***. All funds including the surcharge of the returned check fee are already in ***s possession. It is at purely at their discretion to determine whether or not business ethics are a priority for their company.
