Good Afternoon, Mr ***, Signed a contract with Southern Image to build his home 8/5/16He requested that we design and draft his plans and that the price of the drawings would be added to the mortgageHe gave us $in cash to go toward the plansAnd I reported those
funds to the bank as part of his down payment. Mr.***s total down payment on a construction to perm mortgage Could have been any where from 10-20% I only ask for 10% which was $35,to start his homeIf Mr*** had paid the total deposit due he would have been entitled to 90% of his deposit backWe ask him for the $35,several times and he did not comply When we realized he was not going to get his funding I billed him for the work We had doneAs per Article we are due any monies owed to sub contractors,materials or employees of Southern Image.I have received a letter from one bank denying him credit, but yet Mr*** has already contacted another builder to build his homeI have spoke to that builder about making sure Mr*** plans are complete for him to move forwardThere is even another Builders sign on his lot? I have attached a copy of the contract and his final billwhich he did pay Southern Image a discounted rate $4,on his plans which he has received .I have also included my design contract which shows my standard operations procedures on designing and drafting plans Which he did not sign because he wanted the plans add to the cost of his home.I have also sent you a copy of his home plans if I refunded his 10% which would be $I would not be able to pay my draft person or my designer. Cost of plans 7,999. Payment on plans 12/08/ 4,999. Mr***s deposit 8/5/ 2,000.Southern Image is Out $1,and Mr*** is talking to other builders?? I let him out of his contract to do business with me Artificial states that he must do his due diligent to obtain funding Has he found funding in less then months and left me hanging ?

If Mr. [redacted] had paid  the total deposit due he would have been entitled to 90% of his deposit back. We ask him for the $35,000 several times and he did not comply.  When  we realized he was not going to get his funding I billed him for the work We had done.
