"">Southern Landscaping & Const., Inccontracted with Mr[redacted] to build decks which was modified three times, relocate a gazebo for construction and reinstall gazebo which was moved twice. The irrigation and seeding on Contract Job #14-10-384-LI was delayed until the spring due to the fact that Mr[redacted] changed his seeding specification to Bermuda seed which is a warm season grass instead of Fescue which can and should be planted in the cool season. Mr[redacted] was informed on the needs for temperatures between degrees F and degrees F for Bermuda success. His yard was all weeds and it took herbicide applications to kill the existing weeds. Mr[redacted] texted me several times and told me not to hurry up Bermuda seeding and to do what we had to do to kill the weeds. The problem is weed seeds live for 5-years ungerminated in the soil and you can not apply premergence when seeding. The complaints about the grading is partially true because Mr[redacted] has a very high septic system using plastic distribution box and plastic top ground chambers that are barely covered with soil and you are not allowed to modify septic installations. There were some low spots that we filled and reseeded. The Bermuda is 85-95% covering the ground. This was not a sod job and the seed was successful. A dump truck load of topsoil and two tons of prime bagged soil was added to the lawn. The irrigation system was approved by Mr[redacted]. The seeding job needs continual maintenance, not in any contract, to be successful. The final bill was sent with the amount due of $1,due on completion dated June 29, 2015. SLC, Incnever said we would not correct any low spots in lawn. Seeding never looks like sod and $3,is not excessive to turn 1/acre + of weeds into Bermuda. There was never a contract written for bed edgers not pavers for $11.36/LF the bed edgers fee was added to Contract Job #14-11-393-C, a Decking Contract for $1,for LF of edgers that is $10.91/LF. Mr[redacted] got extra topsoil for the lawn. Mr[redacted] sent an incomplete check for around $for final payment and it was never cashed. I texted Mr[redacted] that I did not want the $555.00. I told him I want all complaints withdrawn from Revdex.com, DPOR, Angies List and whatever else. SLC, Incdoes not claim negligence, fault, and declares that all contract work is complete and accepted by Mr[redacted]. SLC, Incis going to compose a document with all releases and a guarantee that all negative complaints will be removed from record, and I will meet him to exchange signatures. The $1,will be donated to Mr[redacted] and SLC, Incwill close the books on this situation when document is signed

Review: Southern Landscaping and Construction is in breach of contract for continual and unnecessary delays. I entered into a signed written contract with Southern Landscaping and Construction, INC on 6 December 2014. This contract is for $27,100. The contract stated that work will start on 6 January 2015 with a completion date of 15 April 2015. I agreed to pay a premium price for this project when I was assured that the completion date was understood by Southern Landscaping and Construction to be of the utmost importance due to the waterfront nature of the property. Southern Landscaping and Construction has been deceiving in every communication that concerns scheduling and project completion, while demonstrating no desire to complete the project in a timely manner. Supporting information is attached. Southern Landscaping and Construction is costing me estimated damages of $1800-2200 per week in vacation rental income, for a total loose of rental income to date of $14,400-$17,600. This has been made clear to Southern Landscaping and Construction, however they will not increase the rate of work on the project.

6 December 2014 - Signed Contract

6 January 2015 - Project start date per contract

15 April 2015 - Project completion date per contract

I complained to Southern Landscaping and Construction on the lack of progress on the following dates (supported by phone records):

April 6, 8, 13, 29 - May 7, 8, 15, 22, 26, 28 - June 2, 11, 12

I sent certified letter of breach of contract on 26 May 2015.Desired Settlement: I request Revdex.com intervene in this project on my behalf and reprimand Southern Landscaping and Construction as soon as possible. Additionally, I request Revdex.com recommend to Southern Landscaping and Construction to refund $15,000 with additional penalties for additional delays.

Review: We contracted with Southern Landscaping to address drainage and grade problems concerning our home. The "completion by" was on or before August 29, 2015. We set up cameras to check the progress of the work. Materials began showing up on our property in July. Yet, no work began until the first week of August. After several emails, we were assured that ALL the work would be completed. It wasn't. We had our family reunion in the midst of several truck loads of sand and rock in our front yard. I can only assume that our funds were being used to complete some elee's project. At the beginning of October, several big tractors were delivered and sat for several weeks on our property. I sent an email that the owner confirmed, along with his secretary, he had received and read. The email was specific that these big tractors not travel over our septic and leech field due to the age of the system. TWO days later, I recorded his crew driving heavy machinery over the said area, even after we posted markers around the area. Upon my phone call to complain, the owner made it a point to discredit my concerns. I now have the additional financial burden of having our septic system inspected as the ground was already soft due to a nor'easter and his tractors left deep tracks over the leech field. We did take pictures. The next day his crew filled in the tracks with dirt to smooth them over. We had also spoken about filling and grading the yard towards the water to avoid the "pool" that occurs when it rains. Mo showed up to our property on a Saturday afternoon to collect his final payment. My husband showed him where the job was incomplete. He then proceeded to the following day-a Sunday morning-bring a load of dirt and had his crew "fill in" low spots. No grading or rolling to pack down the dirt. We still have a pool in the yard and you sink to your ankles in mud when it rains. Southern Landscaping should fulfill the drainage and grading issues in our back yard as contracted.Desired Settlement: As it was dry when he "completed the job", the past rainy week has proven the job was not done correctly and needs to be corrected.

Review: I wrote 4 contracts with Southern Landscaping to do construction and landscaping work in November of 2014. Southern landscaping finished the construction portion of the work in late december but delayed the irrigation and lawn establishment project for 6 months leaving my yard unusable with their 3 pieces of construction equipment stored on my lot. After several delayed finish dates in April, May , June they sent me a final bill saying the work was completed.

The contract called for 16 tons of topsoil or a discount of $886 would be applied. The final bill included the $886. I am also disputing a credit for pavers as part of a second contract that I claim was quoted at $16 a linear foot but when canceled I was only given credit for $11.36 a linear foot. The contract was canceled due tot he many delays on establishing the lawn. The final result of the work is that I have a partially established lawn that is weed invested and although the contractor claimed that the lawn would be evenly graded it is less level than when the contractor started the work. [redacted] the principal I dealt with told me that one of the delays was that he had to wait three weeks for the herbicide to work before he could plant the lawn. In late May before the Memorial Day weekend he sprayed the herbicide killing the old lawn. After 4 weeks of inactivity including not working on the irrigation system, new weeds emerged, this time they sprayed herbicide on the lawn 2 or 3 days before they planted. The result is that I have a weed infested lawn that now has huge puddles from the sprinkler system and I believe because no topsoil was used on the lawn the grass is not emerging in over half of the lawn. The work was not done to my satisfaction, proper credits were not issued ,the details of the contract were not followed, the work was delayed for 6 months, the lawn was not useable and is still not useable after 7 months, I will have to hire another firm to put the lawn in correctly.Desired Settlement: Southern Landscaping sent me a "final bill" for $1697 due on completion dated June 29 the day they finally left my property. The total of all contracts written for a total amount of $$15,245. I had pre-paid for the pavers as part of the deck construction side of the contract on 12/22. After several months of inquiries, Southern issued me a credit of $1246 for the pavers and that should have been $1800. In good faith I offered to split the difference but was never given the consideration of even having it addressed. $11.36 is a funny number for a per linear foot adjustment and I would challenge that he offers this price to customers for paver work. The landscaping contract called for a discount of $886 for both the irrigation and lawn with no topsoil. I was billed for that amount. I sent a check for $555 citing my deduction reasons to close the account and received a harassing call from [redacted] calling my dispute a "comedy show" that he would address. The $555 check was canceled.
