We contracted with this company to build a pond for us. The contract was $35,000 for a two acre pond. It included fees for mobilization, clearing and seeding. The price for the actual pond specifically stated $24,000 for a two acre pond. After construction we specifically measured the pond and calculated that it is only 1 1/3 acre at most.
During the initial phone call discussing our project, Mr. stated that they charged $3,000 per acre for land clearing. After beginning the project, I asked Mr. to clear about 1/3 - 1/2 acre of land close to the house. Unfortunately this part of our agreement was not in writing.
Our original conversation was to have the pond wrap partially around the house and not be a simple circle. The finished product is a circle and does not in any way wrap around the house.
Refund of $8,000 for the smaller size of the pond. We paid $33,000 of the $35,000 contract price *** The seeding ($2,000) was not completed because we asked them not to return to our property. While they offered to come back to the property -- we do not want them on our property any more.
Revdex.com received a response on behalf of the business, however Revdex.com was asked that the response not be published.
(The consumer indicated he/she DID NOT accept the response from the business.)
We are definitely not satisfied with the response of Southern Paradise Construction. That letter contains a lot of excuses and misrepresentations.
Our complaint filed with the Revdex.com is related to the size of the pond. There were other issues during the contract period, but there was no contract for that portion of the work, which we regret, and we figure that we have no recourse on those matters.
The contract clearly states that out of the $35,000 contract they were charging us $24,000 for a 2 acre pond. We have hired a surveyor to tell us the exact area of the pond. That will be completed in the next two weeks. Once completed we will forward that information to the Revdex.com and give our final claim.
Ms. H states that I said I was satisfied with the size of the pond. And that is due to the fact that in no circumstance would I ever want this company back on my property.
Further the letter tries to paint a picture of Mr. H as a generous benefactor in "giving" us a lot of extra work. This is so ridiculous as to be comical if it wasn't so sad. Though not specifically addressed in the contract, before the contract was signed we were told that Mr. H did not leave piles of dirt and trees and that his plan was to spread the excess dirt and topsoil around the house where practicable.
The only time Mr. H mentioned bringing in sand was to add sand where he had been parking his truck and equipment and his truck got stuck. Mr. H offered to move the fruit trees. This was not addressed in the contract but probably took him 30 minutes. For which I did express my appreciation.
The work related to the land clearing that we asked for is not part of this complaint. We certainly disagreed with Mr. H's account of the agreement and the discussions that ensued, but as we had nothing in writing we are chalking this up to lessons learned. Although I will state that Mr. H had a temper when being told that we were not satisfied with his work.
The size of the pond is our complaint. The fact that it is much less than a 2 acre pond and we were charged for a full 2 acre pond. When the survey report comes in, that will prove our point on this and we will immediately share that report with the Revdex.com. So all of the extraneous mischaracterizations in the letter from Southern Paradise are moot.
Again, our complaint is about the size of the pond. We will give our final statement to the Revdex.com when we get our survey report. There is nothing Southern Paradise Construction can say that will change the contract or the size of the pond. Mrs. H never saw the pond when it was finished. ***

This complaint is about the size of the pond and the money charged in that regard. Because of the issues described above, we do not want this company back on our property and would like a refund of the overpayment. If we do not receive a refund, we ask that our complaint be publicized by the Revdex.com to prevent anyone else from being cheated by this company.
Please find attached the final addendum to the contract signed by all parties with boundaries and pricing agreed upon.

We built them a pond exactly within their specifications for a specific price agreed to on the addendum. We were not authorized to make the pond any larger than they specified. They wanted the pond exactly where they indicated, which is what we built, and what they paid for. They also stated that they do not want a 2-acre pond, and that the pond we built looks good! This is all in writing. And as I mentioned before, this project was bid as a whole with conditions taken into consideration. Pond building is not like installing flooring or roofing. It is not priced by the square foot or yard or acre. This customer indicated what they wanted in writing, said it looked good, that they don't want it any larger, all for an agreed-upon price, which they paid.
