My name if ***. I am writing this as a translator on behalf of *** whose English is poor to average. On 28 February 2020 she met with a representative from Southern Solar and they sold her solar for her house. She does not know the exact service they agreed to except that she won't have to pay any electric bill after 25 years and have a set monthly payment of $181. She was given a folder with 4 sheets of paper: 1. Our Process 2. a chart with cost estimates 3. $1000 discount | $1000 cash bonus 4. Dear Family, letter.

On 13 March 2020, the President ordered shutdown due to Covid19.
On 12 March 2020, ***'s employment, told them not to come to work. Her husband, a self-employed landscaper also lost most of his work due to the shutdown.
On 21 March 2020, *** called ***-***-*** at 12:28 pm spoke with a *** and explained, due to the shutdown they have no income, no money and didn't know how long the shutdown will last and asked if they can cancel. *** responded, yes okay, he "will let them know." *** thanked him and she hung up with the understanding it was canceled.

On 7 April the HEB-ISD cafeteria *** works for called her to return to work 3 days a week.
On 7 April 2020, *** received a text from Solar (signed ***) letting her know the installers were scheduled to come to her house to install on 9 April 2020. *** text back, please not to come install, she already called and canceled and received verbal confirmation from ***.

After this at 11:18am *** text *** that she is breaking the State Law by breaking the contract (that he took, she doesn't have copy of) and will have to pay 15 to 20% out of pocket fee for this. *** replied to this text, that "I call last month...and talk to you (***) and you said okay, you will let them know." *** text back you "to pay a restock fee of the total price." if not then as of now you are setup to install for Thurs. 9 April." *** replied I cannot afford to do this due to no work and the shut down. sorry. *** text her back, then "you will have to pay 20% of your total price to cover for the material, that means you have to pay $8,300 before you can cancel. (all *** had done at this point is took photos of the meter).

Later on 7 April 2020 around noon, *** called her to talk her into proceeding with the work. *** said she was sorry, but please no, her husband has no work. *** replied he will 3way call with *** to *** speak about installation. *** asked her daughter to help her and text him asked him to: "can you email me what you guys want and try to settle because my English is not good and I need record what we talk about" she also told them they are out of work from Coronavirus, etc.

24 April 2020, today, ***-***-*** text ***, saying "give me a call when you can, your solar payment are going to start since Mosaic(?) has released 50% of the funds.

*** is begging for help because they cannot afford to pay for this, due to the coronavirus. She was called by Solar and was talked to doing this service over the phone. *** came to her house and took a photo of her outside meter and "a powerbox inside her garage." Then he wrote her a contract and had her sign it. She was explained the contract, she understood that *** told her "she will not pay electricity after 25 years and her payment will be set $181 a month" no matter the temperature outside. Solar has not installed anything at her house. If her husbands business continued to florish like it was before the shutdown and if she was able to work full time, but now with the shut down they can barely pay their rent and buy food to eat. She is asking for help she feel that she was misled, the virus changed their financial situation, they cannot afford to pay, they are uncertain of their future and she is being threatened by Southern Solar at a time when she is vulnerable. The government has been asking people and business not to do these things and to forgive some of these stations because of the Coronavirus, regular Americans are suffering, yet *** and *** and Southern Solar are threatening, harassing and pressuring *** whose income is barely making it and whose English is minimum to a contract she does not understand. *** took the contract and did no copy of the contract is here for me (translator) can even review. She canceled the work and a month later they called to schedule. The sheet titled "Our Process" says step number #5 permits will be pulled, however, on one of the text from Solar they said they already pulled the permit. How can they do this when step #1 Site Assessment, #2-System Agreement, #3 Engineer site survey, #4 System design & 3d shade report, #5 HOA/Permits #6 Installation, etc., etc. By submission of this email, I testify that I am submitting ***'s true desires, and requests to the best of my abilities. ***.

Our representative met with Mrs. on February 28th ,
2020. Where she signed a contract that states everything she agreed to. Mrs.
*** didn’t just have her contracts that she signed and dated to refer to
but she also ran through a Welcome call with the finance company that walks you
through exactly what you are doing while also informing her about her 3 day
right of recession. The call is reordered

To cancel there must be a call made to the finance company
to ensure that the loan will be terminated and there must be a letter written
and signed that is sent to us for a cancellation. Mrs. did not take these steps. April
9th 2020 was the day scheduled for install which is 29 business days after the
signed contract and 26 days after the 3 day right of recession. In our contract (that Mrs. has a copy of) on pg. 4
paragraph 14. It states the Buyers right to cancel “ If this agreement was solicited
at or near your residence, you may cancel this agreement by mailing a notice to
the seller. This notice must say that you do not want the goods or services and
must be mailed to: Southern Dollar LLC, *** 76092. If
you cancel within 3 days of signing Southern Solar, LLC will not keep any part
of your initial down payment. There is a 15% contract cancellation fee after 3
days.”

After the 3 days we start taking the necessary steps to get the installation
started, that do cost us money as a company. We pull
the permits and design the system. Site surveys are done internal sometimes and there is no need for us to go to the homeowners house because our representative takes the pictures he needs during the time his there and we handle the rest in the back end. As a solar company we pride ourselves in getting our home
owners to save money, Mrs. is still paying her electric bill under the
COVID-19 circumstances, while her average electric bill runs as high as $260 a
month, and with Solar we got her in pocket $80. Which means her bill would be
$181. We are not putting any more stress onto Mrs.s situation in fact we
are helping her since she will be in pocket $80 a month compared to her
electric company.

Our company has not threatened, harassed nor pressured
Mrs., only informed her that a customer cannot cancel the day before
install, as we have already started the process. A customer is allowed 3 days to
cancel and decline the services.

When the salesman states that the 26% Tax Credit is refundable and your net cost is gross minus the tax credit amount, and later you find out that tax credits are a non refundable amount from the IRS Southern Solar LLC makes its sales based upon this approach.

We took care of Mr. and his family the tax credit is refundable depending on your tax liability we always recommend talking to your cpa to make sure you can qualify for it . Mr *** came to us with his family and we took care of it we cut him a rebate check to help him when he left our office he was happy . We strive to help homeowners and make sure all of them are taken care of we’re not tax advisor we are sales consultants furthermore this case should be closed the customer was taken care of .
