Mr*** contacted *** ***, Inc regarding repair of a mower that would not start. Mr*** did not indicate any issues regarding a previous oil leak at the time arrangements were made for the repair or at the time the unit was picked upIn fact he attempted to
start the unit while on the trailer prior to leaving his home. The units Carburetor was repaired and the unit started. Mr*** was contacted and technician asked if any additional servicing was needed. Mr*** agreed to have the blade sharpened and the total repair came to $100.00. The next time the unit was started the engine seized due to lack of oil. The location has made what they believe to be a fair offer of covering 50% of the repair. I have attached communication between Mr*** and Don T***, who is a Southern States employee and works directly with *** ***.
*** *** *** is owned and operated by the farmer members. Southern States works with *** *** *** but the location is independently owned. The final decision on how this matter will be resolved is with the Manager and Board of *** *** ***

Our Manager Warren A*** spoke with Mrs*** on 12/21. He apologized for overfilling the tank, but explained during heating season gallons will not go a long way and he would have to return within weeks with additional fuel. Our protocol for customers not on automatic
delivery is to receive at a minimum 50% of the total usable tank gallons. The *** have a gallon tank. Fills less than 50% typically receive a short fill surcharge.Mr A*** offered Mrs *** options, Southern States could come and pump off the excess fuel or she could make payments over the next several months, anticipating the current fuel should carry her through the majority of the winter. Mrs*** accepted the monthly payment option and it was agreed she would make $per month payments.
Southern States believes the company and the customer have come to a agreed upon solution and no further action is required

The [redacted] opened an account with Southern States Tri County Petroleum in October, 2015.  The attached credit card authorization form was placed on file to bill delivery of LP gas as well as installation of a...

tank.  
Tank installation and the first delivery of product was made in November (November 5, 2015).  That was billed to the credit card on file.  A delivery was made January 5, 2016 and billed to the credit card on file.  A delivery was made on March 8, 2016, but the credit card on file declined the transaction.  Our location contacted Mr. [redacted] and he indicated he would come to the location and make payment March 11, 2016.  Mr. [redacted] did not follow through on that commitment.  Over the next two weeks, the location attempted to put through the sale multiple times.  Finally on March 24, 2016, the transaction went through on the credit card on file.  Mr. [redacted] contacted the manager, Warren A[redacted],  on March 25th, indicating Southern States could not bill the credit card he had previously provided.  Mr. [redacted] was to come in to the location and pay the amount, at which time Southern States would process through a credit to the credit card.   Several days later, Mr. [redacted] requested Southern States pick up the tank and credit the card for the LP gas in the tank.  Southern States picked up the tank April 4, 2016 and issued a credit to the card for $265.89, the same amount billed to the card on March 24, 2016.
 
The [redacted] have a remaining balance due Southern States of $48.27 for the fuel used from March 8, 2016 through April 4, 2016.   
 
Based on the events outlined above, Southern States handled this account in the same fashion from November 2015 through March 2016, and billed to a credit card that Mr. [redacted] provided authorization to bill.

In response to the letter, that southern states wrote they tried to say that or inform you that their was one credit  card used.
 1. Only card that was on file was my ( [redacted]) card that  was given to used, to have tank install in November and propane in January, have documentation for that used. In January when purchasing profane  was 54.22. short, at which time my wife card was used for that one time payment ([redacted] ). Mrs. Judy spoke to my wife on the phone when she give her card number and Ms. Judy state that she would not keep record of her card my wife. No one should keep other people cards on file to use when they decide to do so. Their  no documentation or  verbal  authorization that  was given bye my wife  [redacted]  to use her card on March 25, 2016  by Southern States. the installation and payment of tank is in my name only not my wife.  [redacted] wish was debit $265.89  illegally. This issue need to be address using a customer Credit card with out their permission. Mrs. [redacted] did not authorized any transaction card.
2. Southern States delivered propane to my house with out informing me via phone or writing their no documentation or phone call  requesting propane to be delivered to my home in  March 08, 2016 the paper work that, I received from southern states stated that it will be delivered  on my  call only.
3. My card should not been used at all , and definitely not my wife card because we did not give them any authorization  Southern States to bring propane or use our's card this has caused me  and my wife pain and overdrafts or her card that should not have happen, taken money out her account that was schedule for a bill that we had schedule to pay. when southern state used Mrs. [redacted] card illegal it cause overdraft of her account we have documentation to show the damage that southern states did to Mrs. [redacted]  credit card account when take money out and did not inform her that they was going take $265.89 with out her permission. Mrs [redacted] was not aware that her account  was short of the money in question until she checked her account this issue need to be address immediately.
4. When, my wife called Mr. Warren  on march 28, 2016 he stated that my wife card should not be used. Mr. Warren called my wife back and stated that they was their mistake and he would resolve it then and place money back on account.
5.  southern States is stating that, we own them for propane $48.27 that we did nit ask for. southern States need to pay my wife  the overdraft fees and pain that they caused by take money out of her account with out her authorization.

Review: I moved from [redacted] on 7/10/15 and there had been a for sale sign posted at the house since June 2015. Petroleum gas was delivered to the old address in September. I received my first bill after 12/8/15 in that this was the date it was postmarked. I wrote a letter dated 12/11/15 (a copy of which I can supply) to the indicated address to appeal. I stated that admittedly I was on an automatic refill and that I had failed to call to stop that. (The petro was delivered in September (I didn't know that until December. I had called to stop any delivery in October or November.) I said, however, that shouldn't the delivery person seeing the for sale sign maybe questioned the delivery and suggested to the office that they call to confirm? If so, they would have found the telephone number no longer in service. I asked in the letter if the petro could be drawn back out of the tank (which I imagine was possible) or that I at least be given some consideration as to the amount charged. On 12/24/15 I received another bill plus interest. I have still received no response to my letter of appeal.Desired Settlement: I would like them to withdraw the petro from the tank and give me a refund.

If that is not possible, then I would like to be refunded the interest plus 25% to 100% of the bill.
