I am rejecting this response because: I bought a $45,truck with 6,miles that had a JB WELDED major mechanical component (4xactuator) from themThere is no disputing I was misleadI Bought a $45,truck with a JB welded 4xactuator that had 35"x12.5"x17R (12.5" wide rims) mounted on 6" wide wheelsThere is no disputing this eitherDiscount Tire in Katy, TX made it clear my blowout resulted in this dangerous practice. No accredited tire shop will mount tires on wheels like this due to the dangerThis is also undisputableIf it is ok with the Revdex.com to sell $45,trucks with JB WELDED major mechanical components and 12.5" wide tires on 6" wide wheels then please do not take action against Southpoint automotiveHowever, if the Revdex.com finds Southpoint as misleading (which they are) and guilty of negligence (which they are) then I suggest something should be done about their "good standing" with the Revdex.com. Think back to my blow out, my family and I were very fortunate that we did not get injured or killedWhat if Southpoint automotive sells another truck just like mine to a customer but they are not so lucky? What if they get into a crash because of a blow out and it is ruled that the tire blew out because it was too wide for the rimAs you can imagine there will be a lawsuit bigger than Southpoint could ever handle and who would have partial blame because they let this happen? Regarding Mr& Mrs***. They purchase the vehicle form us on December 31st at 9:a.mThe truck is a Silverado with 106,miles. This is an nine year old vehicle with over 100k miles. We do offer a powertrain warranty to all our customers for months or
thousand miles. This does not cover maintenance or wear and tare on the vehicle. Such as oil changes, batteries, or tires. They both signed a Texas buyers guide acknowledging the warranty that does come with our vehicles. Which states that we will pay 100% parts and labor for covered systems that failed during the warranty period. Which was written in the Buyers Guide. The systems covered are the engine, all internal lubricated parts, timing belt, pulleys, water pump, manifold, harmonic balancer, crankshaft pulley and manifold, engine mounts, transmission and all internal lubricated parts, transfer case and all internal lubricated parts as well as the front and rear drive case and all lubricated parts. It also states that all electrical components are excluded from this warranty and will be out of pocket expenses. Our shop manager was aware of her concern and offered to help her internally with pricing on the repairs that were not covered under our warrantyHowever she stated that she had moved to Washington where her husband was stationed. At this point the shop manager stated that we would be unable to look at her vehicle due to her location. Since these items she mentioned were not covered under our warranty, reimbursement for her repair bill could not be paid due to them not being covered items. One month later her battery went out, she called very irately cursing at the owner of the company stating that she had called several times and no one would help her. We do record all our phone calls and reviewed her calls. She did call several times, and each time she was told that these items were not covered under warranty. SouthPoint Automotive is one of the few independent dealers that offer a free warranty on vehicles. This is a limited warranty and set up to protect the consumer from major mechanical breakdowns such as Engine, transmission, and differentials. The owners of SouthPoint Automotive have over years in the automotive industry and know that unfortunately bad things do happen to good people. We have to follow a code of ethics in the way we run our business. This particular incident does not fall under our warranty policy. We realize the customer is upset, however it is a year old vehicle with over 106,miles and will continue to require maintenance as all vehicles do. We do feel that we have followed our internal policies and by no means would refuse to cover an item covered under warranty clearly stated in black and white and signed by both buyers. To whom this may concern at the RevDex.com:This letter is in reference to Mr*** ***
***’s complaint to the Revdex.com on August 22, 2015. Mr
*** purchased a Dodge Ram Dually with miles on it.
He found the vehicle on Craigslist
and made an appointment to come and test
drive it with David, our internet manager. *** was unavailable to help
him when he arrived, as being the owner, I took it upon myself to help
him. During our sales process he mentioned to me that the only reason he
came to see this truck was because it had a leveling kit on it, as well as
oversized tires, which he was looking for. Since he had just sold an
older Dodge pickup that was customized with a lift kit and oversized tires. He
was unsure of purchasing this truck because it wasn’t as fully loaded or as
lifted as the truck he just sold. I pointed out to him that this truck
did not have a scratch on it and that it was “***” since it only had
miles. However we never led Mr*** to believe this was in any way
a brand new vehicle. We are a used car dealer, and it is obvious that we
do not sell new cars. Mr*** was also presented with a Carfax, which he
read and signedThis Carfax indicated that there was a previous owner, as well
as that it had never been in any accidents. He appeared to be very
satisfied with his purchase of this vehicle. We didn’t have any
further contact with Mr*** until November 2nd when
the dealer would not cover a repair under the original factory warranty due to
the fact that it had been tampered with prior to them repairing it. I
have attached a repair order from Benny Boyd Dodge in Gonzales, Texas showing
that the warranty was denied due to the fact the front 4Xactuator had been
glued and stayed engaged causing damage to the passenger side axle. This
concerned us, causing us to investigate further by contacting the auction where
we originally purchased this truck. They stated that they performed a
pre-sale inspection and found nothing abnormal. Even though this is a
used vehicle, it’s not in SouthPoint Automotive’s policy to ignore customer
complaints. After doing our own research and contacting Benny Boyd Dodge,
we noticed that someone other than Mr*** *** had taken the truck into the
dealer. An individual by the name of Baldemar Segovia, was the name on
the repair order. At this point things began to look a little
suspicious. Especially after noticing that there were miles accrued
on the odometer within a two month period since he purchased the truck.
To put that into perspective, this is the distance driving from LA to New York
and back times. We received a phone call from Mr*** only after he
was denied a warranty from the dealer. We didn’t have any contact with him
again until the day prior to Thanksgiving, November 25thThis
phone call was in regard to a blow out that he had on this day. I myself
was not in the office, regardless of his beliefs, however I did advise my staff
to give him my personal cell phone number should he call again. He did
call me on my personal line and was very irate, stating that he had a blowout,
and he had his truck towed to discount tire. I can’t speak for Discount
Tire in regard to the conversation they had, However Mr*** stated that he
was forced to purchase six new tires for his truck because Discount Tires
policy conflicted with the size of tires that were on the vehicle at the time
of the blowout. Mr*** wanted us to pay for his towing since he did not
have a spare tire, implying that we never placed a spare on this
vehicle. We find it hard to believe that someone would plan a family
vacation in a dually, pulling a foot trailer and not check for a spare
tire. In further research into Mr***’s social media, we found pictures
of the truck we sold Mr***, hunting in an off-road environment, which would
have required him to engage in 4X4, and noticed that there was a 5th wheel
hitch attached to the bedI do have these pictures and can include if
needed. To install this hitch Mr*** would have had to bolt it onto the
frame, where he would have noticed at this point, had there not been a spare
tireIn trying to accommodate Mr***, I *** *** offered to replace all
six tires as well as remove the leveling kit. He stated that the truck
would look “stupid & wimpy”He at that point demanded that I buy it back
at the full price that he originally paid. We do not have a return a
policy, not to mention that there were now an additional more miles totaling
since it was originally purchased. Out of good faith, I offered
$to apply towards his blowout. At this point he threatened me that if
I didn’t by the truck back he would destroy me on social media and make sure
that no one would ever buy another car from us again. So far, on Facebook
he and his friend have called me a “***” which I have proof as wellHe
threatened physical violence by stating that he would “love to smack me around
but would rather ruin his name and get paid for the loss”. In closing we have a truck that has one mechanical
issue and a flat tire. It has
accrued in just three months, the annual national average of 12,miles per
year Regardless of the threats made against us we tried helping Mr***
by offering him monetary compensation for his loss We are currently
working on this issue due to the slander against SouthPoint Automotive’s name
on social media as well as the multiple bad reviews from his friends, who have

In response to Mr. [redacted]'s rebuttal, the vehicle which he purchased was never presented to him as a new truck.  He signed an "As Is" as well as a Carfax indicating that there was a prior owner.  We do understand that the vehicle only had 6,500 miles on it at the time of purchase. However, we are neither the manufacture nor a franchise dealer to represent this truck as a brand new vehicle.  Texas law requires that in conjunction with the transfer of ownership we disclose the buyers guide which reads as follows - IMPORTANT: The information on this form is part of any contract to buy this vehicle. Removal of this label before consumer purchase (except for purpose of test-driving) is a violation of federal law (16 C.F.R. 455). On this buyers guide which Mr. [redacted] signed, was clearly marked "As Is - No Warranty.  You will pay all cost for any repairs.  The dealer assumes no responsibility for any repairs regardless of any oral statements about the vehicle".  SouthPoint Automotive, n good faith attempted to compensate him, and try to assist with repairing his vehicle, which was out of our legal obligation in accordance with Texas law.  Mr. [redacted] demanded that we buy the vehicle back at the full retail price that he paid, after he had accumulated over 12.000 additional miles.  This would be the national average annual usage of a vehicle, accrued in just three months.  He ceased to cooperate with us unless we buy his truck back and swore to us that he would destroy our reputation on every social media outlet, which he has attempted to do and has done on multiple review sites.  Southpoint Automotive has been in business for over 11 years and sold thousands of vehicles and has had thousands of satisfied customers.  We are an accredited business and have an A+ rating with the Revdex.com.  Along with no complains.  This is something that is very important to SouthPoint Automotive.  We refuse to be Cyber bullied and or slandered online by him as well as his friends how have never had any dealings or relationship with SouthPoint Automotive. 
 
- Southpoint Automotive has established and maintained a positive track record in San Antonio, Texas. 
- We have been in business for over eleven years without any unresolved claims, judicial problems, or licensing issues.
- We have met all applicable standards of the Revdex.com.
- We have honestly represented our products and services and have exhibited transparency in doing so.
- We have clearly disclosed all paperwork to Mr. [redacted], including any guarantees or warranties that the Texas law requires us to give the customer in conjunction with transfer of ownership of the vehicle.
 
You can clearly see in Mr. [redacted]'s closing that there is no resolution for his complaints other than to destroy SouthPoint Automotive's credibility.  As he stated, he speaks for himself as well as every other individual who has had a horrible experience with a used car dealership.  SouthPoint Automotive is a family owned and operated business that has been proudly serving our community for over eleven years.  We are deeply disheartened that we were unable to come to a resolution with Mr. [redacted], however we won' tolerate him committing slander and cyber bull threats to our employees and our business.

This email is in response to the complaint we received Monday April 18 as date stamped. Complaint number [redacted].  Mrs. [redacted] and her spouse did purchase a vehicle with us on February 19, 2016.  On 2-26-2016, seven days later, the customer came in with the complaint of a change oil...

light, stating that we had never changed the oil.  I myself personally, [redacted] went to see what the problem was.  Since the oil change had been overlooked and it was missing the oil change sticker, we offered to change the oil.  We have documentation and receipts showing the synthetic oil and supplies needed for the oil change we performed.  We will gladly provide this.  As we were servicing her car we also did a tune up and changed the air filter.  Somehow the oil light was not reset, however the customer did see us servicing her car along with the oil change.  On this same day she picked up her care late that evening.   Several days later She stated that she had gone to Wal-Mart who told her that the oil had not been changed.   She never called or contacted us prior to changing the oil at another service facility to confirm if the oil change had in fact been done.  On March 16th she came in again with the complaint of the A/C blowing warm air.  We told her that we would run it through our service department the following day if she left the vehicle with us.  The next day we performed a diagnostic check on it that afternoon.  At this point we discovered that it needed a sensor assembly, which was ordered from the Ford dealer and would not be delivered until the following day.  This same afternoon she came back and I told her that her car would be ready this day, not knowing that it was a special order part and would not be here until the following day.  This was a mistake on my part.  I assumed it would be a same day part.  Our finance manager [redacted],  spoke to her after she had been waiting several hours and stated that it wouldn't be ready until the following day.  At this point she became irate due to the fact that she had been waiting several hours and it would not be ready until the next day.  We are conscious of the fact that she did spend her afternoon waiting on her car.  We did apologized for the inconvenience.  Mrs. [redacted] demanded a rental car.   Our warranty company will not provide a rental if the service repair does not meet the criteria.  A sensor is not considered something they would issue a rental for, which is written in her service agreement which she signed and has a copy of.  The following day when her car was ready to be picked up, she demanded that I reimburse her for her time spent waiting for her repair, stating that she was not going to pay us her deductible for her warranty, which was $100.00 due to her lost wedges at work while waiting for her car.  I told her that not paying for the parts and work we had done on her vehicle was a criminal act and theft of service.  I also offered to call the police department so that she could see that her position was in fact not reasonable and a criminal offence and that we could press charges on her if we wanted to.  As my part in trying to keep this issue from escalating any further, I told her to just forget the deductible for her repair and find somewhere else to have her repairs done in the future.  She demanded a receipt for services rendered on these repairs that she never even paid for.   As I hand her keys to her, I advised her not to ask for service from us again.  She is asking for a reimbursement for something she didn't pay for.  She paid nothing for the repair or the deductible.  We don't quite understand what she is looking to get reimbursed for when she didn't pay for anything.  If Mrs. [redacted] would have taken her vehicle to any ASC certified repair facility she would only have to pay a $100.00 deductible to repair her A/C.  This is all she needs to do, she has a warranty contract.  It is unclear to me whether she had her A/C repaired or just checked.  Either way she can file a claim with the warranty company prior the repairs as stated in her warranty contract.  if she needs our step by step help in filing a warranty claim, SouthPoint is willing to assist her in making this claim or help her find a facility other than us to do the repairs.  Please note that the warranty company is a separate entity from SouthPoint Automotive that does require notice prior to any service repairs.  Please feel free to contact me with any further questions or concerns.  Regards [redacted]

I am rejecting this response because:In response to South Point’s reply, I would like to correct and address some of the things [redacted] discussed in his response. Please see the list below and my rebuttals.1.     [redacted]: “Since he had just sold an older Dodge pickup that was customized with a lift kit and oversized tires.”ME: I did not sell a dodge I sold a 2012 FORD F-2502.     [redacted]: “we noticed that someone other than Mr. [redacted] had taken the truck into the dealer.  An individual by the name of Baldemar Segovia, was the name on the repair order. “ME: This was an error made by Benny Boyd, they have my information incorrect. I did bring in the truck myself and I did miss work because of it. Please call Benny Boyd Service Dept. at 830- 445- 4001 to speak with [redacted] to verify this.3.     [redacted]: “Especially after noticing that there were 8185 miles accrued on the odometer within a two month period since he purchased the truck.”ME: First of all I bought the truck with 6,500 K miles on it. And yes the Odometer read 8,185 miles within two months. My concern is what else do you do with a vehicle besides drive it? We have a place in Boerne, TX and live in Luling, TX. To “Put that into perspective” that’s 96 miles one way. I make this drive very frequently and it is highway the whole way. (I-10) 4.     [redacted]: “We received a phone call from Mr. [redacted] only after he was denied a warranty from the dealer.  We didn’t have any contact with him again until the day prior to Thanksgiving, November 25th” ME: That is exactly the problem… “WE DIDN’T HAVE ANY CONTACT WITH HIM AGAIN UNTIL THE DAY PRIOR TO THANKSGIVING, NOVEMBER 25TH”.  To whom is reading this if you read my original complaint you would have read when I talked about getting stuck in the wet grassy field. This was the first time I ever had to use my 4 wheel drive. After realizing it did not work I took it to Benny Boyd where they showed me what had previously been done and what South point automotive sold me. After this knowledge I DID contact South Point and explain them the situation. [redacted] blamed it on the auction house because he said they sold it to him as a “green light” vehicle and that he would get into contact with them. I had to call and check in weekly where it was almost impossible to talk to [redacted] because he was always out or not in the office. So I called again on NOVEMBER 24th, the day of the blow out (not the 25th as [redacted] explained) to find that once again [redacted] was nowhere to be found. I am unsure of who I talked to but it was a woman and once I told her who I was the phone went silent for a few moments and she came back on saying that the auction house was not going to cover any of the expenses I had endured with the JB welded Actuator. She said all this to me before I even told her about the blowout which was my main reason for calling. So South Point and [redacted] went all that time without contacting me about the status of the auction house being at fault. 5.     [redacted]: “He did call me on my personal line and was very irate, stating that he had a blowout, and he had his truck towed to discount tire.  I can’t speak for Discount Tire in regard to the conversation they had, However Mr. [redacted] stated that he was forced to purchase six new tires for his truck because Discount Tires policy conflicted with the size of tires that were on the vehicle at the time of the blowout.”ME: After calling the dealership several times they finally gave me [redacted]’s personal cell phone. Yes, I was “very irate” when I called him because I had just found out the danger South Point Automotive put my family, myself, my dogs, and my side by side utility vehicle in. Discount Tire would not mount the tire size that [redacted] had mounted on the truck because it is against their company policy. Why is it against company policy? Ah yes, because the tires balloon when they are too wide for the rims they are mounted to. This can cause a side wall blow out which is exactly what happened to my tire. Keep in mind the tire that blew out was put on brand new by South Point Automotive. So yes, this did leave me with no choice but to put on all new tires. Please contact [redacted] ( [redacted]) the senior assistant manager at Discount Tire in Katy, TX for his testimonial where he can explain everything in further detail and the dangers of mounting tires like [redacted] did. Also [redacted] said he had been mounting tires like this for years so there is no telling how many other people he has put in danger.  6.     [redacted]: “Mr. [redacted] wanted us to pay for his towing since he did not have a spare tire, implying that we never placed a spare on this vehicle.  We find it hard to believe that someone would plan a family vacation in a dually, pulling a 40 foot trailer and not check for a spare tire. “ME: Yes, I wanted South Point to pay for my towing. Why? Because their negligence not only endangered my family but cost me money that shouldn’t have costed me.  Yes, it is true I did not have a spare tire. A 35” tire will not fit where the stock spare is stored. No, I was not pulling a 40’ trailer, I was pulling a 12’ trailer with my side by side on it.7.     [redacted]: “In further research into Mr. [redacted]’s social media, we found pictures of the truck we sold Mr. [redacted], hunting in an off-road environment, which would have required him to engage in 4X4, and noticed that there was a 5th wheel hitch attached to the bed. The 4x4 had already been fixed prior to that picture 2. I don’t need 4x4 on my truck anywhere I go hunting because I have a Polaris Ranger and a Yamaha Viking I take hunting every time I go. His statements are completely false. Also, [redacted] has no clue about how that fifth wheel hitch operates. When I bought that truck from him it came with a factory prep. This means that all you have to do in drop the hitch in and lock pins. There is no bolting to the frame or altering of the truck in any sort. I was very aware that there was not a 35” spare tire but yes there is a stock spare tire. I hope you are seeing now most of the things he said is his reply are speculation and completely false.8.     [redacted]: “In trying to accommodate Mr. [redacted], I [redacted] offered to replace all six tires as well as remove the leveling kit.  He stated that the truck would look “stupid & wimpy”. He at that point demanded that I buy it back at the full price that he originally paid.ME: Yes, it is true [redacted] did offer to replace all six tires and to remove the leveling kit.  It was [redacted] himself who said that the truck would look bad with stock tires and the leveling kit and I agreed with him. It was my idea to remove the leveling kit, not him offering. It is also true I asked for him to buy back the truck OR PAY FOR THE EXPENSES SOUTH POINTS NEGLIGINCE COSTED ME which was JB WELDED 4x4 actuator, tire negligence which resulted in a blowout, and the tow.9.     [redacted]: “Out of good faith, I offered $700 to apply towards his blowout.  At this point he threatened me that if I didn’t by the truck back he would destroy me on social media and make sure that no one would ever buy another car from us again.  So far, on Facebook he and his friend have called me a “[redacted]” which I have proof as well. He threatened physical violence by stating that he would “love to smack me around but would rather ruin his name and get paid for the loss”. ME: Yes, [redacted] did offer me $700 for my troubles. For the record, my total out of pocket expenses were nearly $4,000 for everything. These expenses should have not been endured by me if South Point would have took the time to make sure the vehicles they were selling were safe and free from mechanical laziness. (using JB weld to fix a major mechanical component is about the worst thing you can do as a mechanic please contact ANY certified mechanic and ask about using JB Weld on major mechanical components of vehicles.) It is also true that I told him if he did not pay for my expenses or buy back the truck I would share my experience all over social media. I feel it is fair for everyone to know what I went through and that no one should have to pay 45 grand for a like new truck then have to pay almost 4 grand more in fixing it when it was sold as “[redacted]” and “wont have a problem with it”. Yes it is true a Facebook friend of mine got on his page and commented that. I did not tell him too. I simply shared my experience and he made a comment which had nothing to do with me making him. There were also several other comments from people I did not even know supporting me and bashing South Point. The guy who commented that is my Facebook friend (keep in mind I have never seen this person before in my life) was the one who said I should go down there and kick his as and so on. I simply replied with saying that would be nice but I would rather ruin his name. So I don’t see that as a Psychical Threat at all considering I literally said I would rather ruin his name which would be by sharing my experience which is exactly what I did. PLEASE read their Facebook reviews and see all the comments from people on my review. In closing I want the Revdex.com to know exactly what kind of Dealership South Point Automotive is. My whole reason for posting my experience with SPA is to help others in not making the same mistake I did. People like you and me work very hard for their money. If a person like myself spends 45 grand on a like new truck with only 6,500 miles on it they should expect it to be safe to drive and that all the major mechanical parts are in good condition without the use of JB Weld. Please investigate all of my claims and contact the businesses I have listed phone numbers for to get testimonials. I urge you to do the right thing and take action on this dealership for their negligence. I speak for myself and on behalf of every person who has ever had a horrible experience with a used car dealersh
